WBPSC: One of India's Oldest State Commissions

The West Bengal Public Service Commission (WBPSC) is a constitutional body established under Article 315 of the Constitution of India. It was constituted in 1937 under the British colonial administration and is one of the oldest public service commissions in India — predating Independence. WBPSC is headquartered at Bhabani Bhaban, 161A S.P. Mukherjee Road, Kolkata – 700 026, and operates under the overall governance of the Government of West Bengal. The Commission's portal is at wbpsc.gov.in.

WBPSC conducts several major competitive examinations and recruitment processes:

West Bengal Civil Service (Executive) Examination (WBCS-Exe): The premier examination conducted by WBPSC, analogous to the Union Public Service Commission (UPSC) Civil Services Examination at the state level. The WBCS (Exe) selects candidates for West Bengal Administrative Service (WBAS), West Bengal Police Service (WBPS), West Bengal Finance Service, West Bengal Revenue Service, and other Group A and Group B gazetted posts. Officers selected as WBAS officers serve as Block Development Officers (BDOs), Sub-Divisional Officers (SDOs), and in senior district administration roles. The examination is intensely competitive, drawing candidates from across West Bengal.

West Bengal Civil Service (Judicial) Examination: Selects Civil Judge Junior Division posts for the district judiciary of West Bengal. Conducted separately with its own syllabus and eligibility requirements.

West Bengal Audit and Accounts Service Examination: Recruits for the state audit and accounts cadre under the Accountant General's office.

Miscellaneous Services Recruitment Examination: Recruits for a wide range of Group B gazetted and non-gazetted posts across various state government departments including Agriculture Service, Cooperative Service, Employment Service, Labour Department, and others. The Miscellaneous Services exam is conducted periodically and has attracted large candidate pools.

Departmental Examinations: WBPSC also conducts promotional and departmental competitive examinations for in-service government employees who seek to move into higher posts or cadres.

Because WBPSC is a constitutionally established body functioning under the Government of West Bengal, it is a state public authority within the meaning of Section 2(h) of the RTI Act, 2005. RTI applications to WBPSC are governed by West Bengal's RTI rules, and second appeals are decided by the West Bengal State Information Commission (WBSIC) — not the Central Information Commission (CIC), which has jurisdiction only over Central Government bodies.

WBCS Examination Structure: Three Stages

Understanding the WBCS examination structure is essential for drafting effective RTI requests targeting specific stages:

Preliminary Examination: An objective MCQ-based screening test carrying 200 marks. The paper tests general studies, knowledge of current affairs, English comprehension, and Bengali (or Nepali/Urdu/Hindi for eligible candidates). The preliminary examination is qualifying in nature — candidates who clear the cut-off are allowed to sit for the Mains. Preliminary scores are not counted in the final merit.

Main Examination: A descriptive written examination comprising multiple papers including compulsory papers in Bengali (or other languages), English, and General Studies, plus an optional subject paper chosen from a prescribed list. The Mains is the substantive merit-determining stage. Marks awarded here, combined with interview marks, form the final aggregate for merit ranking.

Personality Test (Interview / Viva Voce): Candidates who qualify the Mains examination are called for a Personality Test conducted by a WBPSC-constituted board. The board assesses the candidate's general awareness, personality, communication, and suitability for civil service. The Personality Test carries a specified number of marks that are added to the Mains aggregate for the final merit list.

Final selection, service allotment, and Group A vs Group B posting depend on the aggregate merit list compiled on the basis of Mains + Personality Test marks.

What RTI Can Help You Obtain from WBPSC

The RTI Act, 2005 gives candidates the legal right to access the following categories of information that WBPSC often does not proactively disclose or discloses incompletely:

1. Stage-wise Marks

WBPSC typically publishes only roll numbers of candidates shortlisted at each stage and the final merit list, without publishing individual marks. Through RTI, a candidate can obtain:

  • Preliminary examination score for a given registration number (where applicable and retained)
  • Main examination marks — paper-by-paper breakdown covering Bengali/English compulsory papers, General Studies, and the optional subject
  • Personality Test (interview) marks awarded by the board
  • Aggregate marks used for final merit ranking and service allotment

2. Evaluated Answer Scripts (Mains Examination)

The Supreme Court of India in CBSE and Another v. Aditya Bandopadhyay and Others (2011) 8 SCC 497 authoritatively held that evaluated answer scripts are "information" within the meaning of Section 2(f) of the RTI Act, and that public authorities including recruitment commissions are legally obligated to furnish photocopies on request. No exemption under Section 8 of the RTI Act applies to evaluated answer scripts merely because they contain examiner annotations.

Through RTI, a candidate can obtain certified photocopies of their evaluated WBCS Main Examination answer booklets for any specific paper. Reviewing the answer scripts allows verification of:

  • Whether every question attempted was evaluated and marks entered
  • Whether the examiner applied the correct marking scheme
  • Whether internal marks within a paper were totalled accurately
  • Whether any pages or answers were overlooked during evaluation

Note that obtaining a photocopy through RTI is a separate matter from WBPSC's own re-evaluation or re-checking scheme (if available). RTI gives you the legal right to see the script; any formal re-evaluation must follow WBPSC's prescribed procedure.

3. Interview / Personality Test Marks and Board Composition

The Personality Test is the most opaque stage of the WBCS examination, and candidates rarely receive any information about how their interview marks were determined. RTI can be used to seek:

  • Aggregate marks awarded in the Personality Test for a specific registration number
  • Composition of the Interview Board (names and designations of members) on the date of the candidate's interview
  • Interview schedule records confirming the date and time of the candidate's appearance
  • General instructions issued to Interview Board members regarding assessment criteria (though deliberative privilege may apply to individual scoring rationale)

WBPSC cannot validly claim that interview marks are entirely exempt under Section 8. Aggregate scores and panel composition are disclosable information.

4. Category-wise Cut-off Marks and Merit List

Transparency in cut-off marks enables candidates to assess their relative standing and verify that reservations were correctly applied. RTI can yield:

  • Preliminary cut-off marks by category (General/UR, Scheduled Caste, Scheduled Tribe, OBC-A, OBC-B, Persons with Disabilities / PwD)
  • Main Examination qualifying cut-offs for call to Personality Test, category-wise
  • Final cut-off marks for each Group A and Group B post or service in the merit list
  • The number of candidates at each stage and the total vacancies notified per category

5. Reservation Roster and Category-wise Appointments

West Bengal maintains reservation rosters for state government posts under the West Bengal Scheduled Castes and Scheduled Tribes (Reservation of Vacancies in Services and Posts) Act and related rules. WBPSC must comply with these reservation mandates in its recruitments. RTI can compel WBPSC to produce:

  • The reservation roster maintained for each service/post notified in a given advertisement
  • Number of vacancies advertised versus actually filled, broken down by category (SC, ST, OBC-A, OBC-B, EWS, PwD)
  • Carry-forward of backlog vacancies into subsequent recruitment cycles
  • Category-wise merit list showing which posts were filled against which reserved category

Candidates from reserved categories who suspect under-representation or improper allocation can use this information to verify compliance and, if warranted, file complaints with WBSIC or approach courts.

6. Waiting List Status

WBPSC maintains waiting lists for certain recruitments. If a candidate is in the waiting list zone, RTI can help establish:

  • The current waiting list position for a given registration number
  • Whether and how waiting list candidates have been absorbed into service
  • The policy or order governing waiting list activation for a specific advertisement

7. WBPSC Annual Report and Recruitment Statistics

WBPSC is required to publish an Annual Report detailing all examinations conducted, vacancies filled, and reservation compliance statistics. If the Annual Report is not available on WBPSC's website, RTI can compel its disclosure. The Report is valuable for candidates and researchers tracking WBPSC's performance across years.

Recruitment Controversies and Heightened RTI Interest

West Bengal has seen significant public controversy over government recruitment in recent years. The West Bengal School Service Commission (WBSSC) teacher recruitment scam — popularly called the SSC or SLST scam — involved allegations of large-scale irregularities in teacher appointments for state-aided schools, leading to multiple rounds of litigation including Supreme Court intervention and cancellation of thousands of appointments. While this scandal related to WBSSC (not WBPSC), the public controversy has sharply heightened RTI interest in all West Bengal recruitment bodies.

Candidates who appeared for WBPSC examinations and suspected discrepancies between their assessed performance and their recorded marks have increasingly used RTI to demand transparency. It is important to maintain the distinction: WBPSC handles Group A and Group B gazetted civil service posts (WBCS Executive, Judicial, Accounts, Miscellaneous Services); WBSSC handles teacher appointments for aided schools; and the West Bengal Staff Selection Commission handles Group C and Group D non-gazetted government employee recruitment. RTI applications must be directed to the correct public authority depending on the nature of the post.

The First Appellate Authority (FAA) for WBPSC RTI matters is a senior officer designated within the Commission, typically at the level of the Secretary or an officer above the CPIO. Confirm the current FAA's name and designation from WBPSC's website or from the CPIO's office at the time of filing.

The Second Appeal body for WBPSC is the West Bengal State Information Commission (WBSIC), constituted under Section 15 of the RTI Act for West Bengal state public authorities. Second appeals against WBPSC never go to the Central Information Commission (CIC).

How to File: Step by Step

West Bengal operates a dedicated RTI online portal at wbrti.in. Filing online is the most efficient and trackable route.

  1. Register on the West Bengal RTI portal: Visit wbrti.in and create a citizen account using your name, email address, and mobile number. Verify your mobile OTP to activate the account.
  2. Select WBPSC as the public authority: After logging in, initiate a new RTI application. From the list of public authorities, select West Bengal Public Service Commission (WBPSC).
  3. Draft your application carefully: In the application text box, clearly state the examination name, advertisement number, your registration number, and the specific stage (Preliminary / Main / Personality Test) for which you are seeking information. List each item of information as a separate numbered point. Precision matters — vague requests invite deflecting or incomplete responses.
  4. Pay ₹10: Pay the RTI application fee through the portal's online payment gateway. BPL cardholders are exempt from payment — select the BPL exemption option and upload a copy of your BPL ration card.
  5. Submit and record your registration number: After successful payment and submission, the portal assigns a unique registration number to your RTI application. Note it carefully — you will need it to track responses and file appeals.
  6. Monitor the response: Log in to the portal to check whether the CPIO has uploaded a reply. You should also receive notifications via email or SMS. Under Section 7(1) of the RTI Act, the CPIO must respond within 30 days of receipt.

Postal alternative: Address your application to the CPIO at Bhabani Bhaban. Enclose an Indian Postal Order (IPO) of ₹10 drawn in favour of "West Bengal Public Service Commission", and send by registered post with acknowledgement due (RPAD). The 30-day response clock runs from the date the CPIO receives the application.

Fee and Timeline

  • Application fee: ₹10 under the Right to Information (Regulation of Fee and Cost) Rules, 2005. Free for BPL cardholders.
  • Response deadline: 30 days from receipt by the CPIO (Section 7(1), RTI Act 2005).
  • Life and liberty matters: 48 hours as per the Section 7(1) proviso — generally not applicable to WBPSC exam mark queries.
  • Third-party information: If WBPSC intends to disclose information about third parties, it may extend by up to 10 additional days (40 days total) under Section 11.

First Appeal: Section 19(1)

If the CPIO fails to respond within 30 days, provides an incomplete or evasive response, or wrongly refuses information by invoking an exemption under Section 8:

  • File a First Appeal under Section 19(1) of the RTI Act to the First Appellate Authority (FAA) designated within WBPSC.
  • The First Appeal must be filed within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable.
  • No fee is payable for the First Appeal.
  • Include in the appeal: the registration number of your original application, the filing date, the information sought, the nature of the CPIO's failure or deficiency, and a specific prayer for relief.
  • If WBPSC refused to provide your evaluated Mains answer script, cite CBSE and Another v. Aditya Bandopadhyay and Others (2011) 8 SCC 497 and assert that the refusal is contrary to binding Supreme Court precedent.
  • The FAA must dispose of the First Appeal within 30 days of receipt, extendable to 45 days with written reasons.

Second Appeal: West Bengal State Information Commission (WBSIC)

If the FAA's response is absent, incomplete, or unsatisfactory, the next step is a Second Appeal to the West Bengal State Information Commission (WBSIC) under Section 19(3) of the RTI Act.

  • The Second Appeal must be filed within 90 days of the FAA's decision or the expiry of the FAA's response deadline, whichever is earlier. WBSIC has the discretion to condone delays for sufficient cause.
  • WBSIC is the state-level independent quasi-judicial authority constituted under Section 15 of the RTI Act for all West Bengal state public authorities, including WBPSC.
  • No fee is payable for the Second Appeal.
  • WBSIC will hear the matter, may summon both the applicant and the CPIO, and pass binding orders directing WBPSC to disclose the information.

Section 20 penalty: Under Section 20 of the RTI Act, WBSIC has the power to impose a penalty of ₹250 per day (up to a maximum of ₹25,000) on the CPIO personally for failure to furnish information without reasonable cause. WBSIC may also recommend disciplinary proceedings against the defaulting officer.

It is critical to remember: Second appeals against WBPSC always go to WBSIC, not to CIC. The Central Information Commission (CIC) has jurisdiction only over Central Government public authorities. WBPSC is a state constitutional body under the Government of West Bengal — its second appeals are decided exclusively by WBSIC.

Practical Tips for WBPSC RTI Applications

Be precise about the examination and stage: Always cite the full examination name (e.g., "West Bengal Civil Service (Executive) Examination 2023"), the advertisement number, and your registration number in every RTI application. Ambiguity gives WBPSC grounds to seek clarification and delay response.

File for answer scripts promptly after results: Answer scripts are retained for a limited period. File your RTI for evaluated Mains answer booklets as soon as possible after the Mains result or final result is declared — typically within a few months. Do not wait until you have exhausted other remedies.

Cite the Supreme Court ruling for answer scripts: When requesting your evaluated Mains answer booklet, include the citation: CBSE and Another v. Aditya Bandopadhyay and Others (2011) 8 SCC 497. This pre-empts refusal on confidentiality grounds.

Request interview marks and board composition together: A single RTI can ask for both the aggregate Personality Test marks and the composition of the board. These are disclosable and together allow an assessment of whether the interview was conducted properly.

Separate applications for separate examinations: Consolidate related questions about a single examination into one application, but do not mix questions from different examinations or advertisement numbers. WBPSC may treat mixing of unrelated requests as grounds for partial rejection.

Keep copies of all filings: Retain copies of your application, proof of payment, the registration number, and every response received. This documentation is essential for maintaining the appeal chain through the FAA and up to WBSIC.

WBSSC vs WBPSC: Before filing, confirm you are targeting the correct public authority. Teacher recruitment scam-related RTIs go to WBSSC. Group C and Group D non-gazetted recruitment RTIs go to the West Bengal Staff Selection Commission. WBPSC RTIs relate specifically to Group A and Group B gazetted civil service, judicial service, and Miscellaneous Services recruitments.
