In Uttar Pradesh, three pension schemes form the backbone of the state's social security net for its most vulnerable citizens: Vridhavastha Pension Yojana (old age pension for citizens aged 60 and above), Nirashrit Mahila Pension Yojana (pension for destitute widows), and Divyang Pension Yojana (disability pension). These schemes are administered by the Social Welfare Department, Government of Uttar Pradesh, through the Directorate of Social Welfare in Lucknow and a network of District Social Welfare Offices (Jila Samaj Kalyan Karyalay) in each of the state's 75 districts. Despite being entitlements backed by government orders and budget allocations, a large number of eligible citizens face delays in approval, unexplained stoppages in monthly payments, rejection without written reasons, or removal from beneficiary lists without notice.

The Right to Information Act, 2005 is the most effective legal instrument available to a citizen in this situation. Every office of the Social Welfare Department — from the Directorate in Lucknow to the district-level Jila Samaj Kalyan Karyalay — is a public authority under Section 2(h) of the RTI Act, 2005. Any citizen can file an RTI application to obtain official records: payment histories, rejection orders, beneficiary lists, scheme eligibility criteria, and fund utilisation data. The department is legally obligated to respond within 30 days under Section 7(1). If it does not, you have a clear and enforceable right to appeal.

The Three Pension Schemes: What RTI Can Uncover

Vridhavastha Pension Yojana (Old Age Pension)

The Vridhavastha Pension Yojana provides monthly financial assistance to UP residents aged 60 years and above who fall below the income threshold prescribed by the state government. The pension is disbursed via Direct Benefit Transfer (DBT) directly into the beneficiary's Aadhaar-linked bank account. Despite the DBT mechanism, payments frequently go missing — due to Aadhaar–bank seeding failures, bank account dormancy, or database errors — with no proactive communication to the beneficiary.

RTI applications to the District Social Welfare Officer can establish: whether a specific individual is currently listed as an active Vridhavastha Pension beneficiary, the full payment history for a specified period (dates, amounts, bank account credited, any failed or returned transactions), and the reason for any stoppage. If an application was rejected, an RTI will yield the rejection order, the specific eligibility criterion cited, and the name of the deciding officer — creating the written basis for a challenge.

Nirashrit Mahila Pension Yojana (Widow Pension)

The Nirashrit Mahila Pension Yojana provides monthly financial assistance to destitute widows of UP. Eligibility is linked to income criteria and, in practice, often to possession of a BPL ration card or a Tehsildar-issued income certificate. A recurring problem is that widows who were receiving the pension are removed from the beneficiary list during periodic re-verification drives — sometimes because their Aadhaar data was not updated, sometimes due to administrative error — without any prior notice and without any written order being served.

RTI is particularly valuable here because it forces the department to put on paper: (a) whether the applicant's name was removed and on what date; (b) the specific ground(s) for removal; (c) whether a notice was issued before removal; and (d) what the procedure is to apply for reinstatement. These facts are indispensable for any grievance or legal challenge. Filing an RTI also creates a formal record that the department cannot later claim it was unaware of the beneficiary's complaint.

Divyang Pension Yojana (Disability Pension)

The Divyang Pension Yojana provides monthly financial support to persons with disabilities who meet the prescribed eligibility criteria — typically a disability of 40% or more as assessed by a designated medical board and certified through a disability certificate or Unique Disability Identity (UDID) card. The scheme is administered by the Social Welfare Department through the same district network. Applicants often face delays in approval because their disability certificate is not recognised in the state's system, or because the required UDID card has not yet been issued. RTI can establish the department's current requirement in writing and identify exactly which document is blocking the application.

How District Social Welfare Offices Fit In

The District Social Welfare Officer (Jila Samaj Kalyan Adhikari) is the key operational authority for all three pension schemes at the district level. This officer maintains the district beneficiary database, processes new applications, recommends approvals or rejections to the state Directorate, and coordinates DBT disbursement with the sponsoring banks. For any individual case — payment stoppage, application rejection, beneficiary list verification — the District Social Welfare Office is the first and most effective point of RTI inquiry.

For state-level records — overall scheme guidelines, government orders setting eligibility criteria, budget allocation and utilisation data, or statewide beneficiary statistics — the RTI should be addressed to the SPIO, Director, Social Welfare, Government of UP, Lucknow. If the district office claims records are held at the state level, the SPIO at Lucknow must either provide the information or transfer the application under Section 6(3) of the RTI Act.

Filing Your RTI: Step by Step

Step 1 — Identify the right authority. For individual payment records, application status, or beneficiary list queries, file with the SPIO at the District Social Welfare Office (Jila Samaj Kalyan Karyalay) of your district — this office has direct access to your case file. For scheme guidelines, eligibility criteria, government orders, or statewide data, file with the SPIO, Directorate of Social Welfare, Lucknow.

Step 2 — Prepare your application. Use the sample RTI draft provided above, replacing the bracketed placeholders with your specific details: scheme name, registration or application number, relevant district and block, and the precise information you need. Under Section 6(2) of the RTI Act, you are not required to state any reason for seeking the information. Be specific — reference the exact document you need (e.g., "the DBT payment transaction record for my Vridhavastha Pension for the period April 2024 to March 2025 under Registration No. XXX") rather than asking for general information.

Step 3 — Pay the fee and submit. The RTI application fee is ₹10. BPL cardholders are fully exempt under Section 7(5) of the RTI Act — attach a copy of your BPL card and state the exemption in your application. UP citizens can file online at rtionlineup.up.nic.in, or submit by post or in person at the relevant office. Keep proof of submission (postal receipt or portal acknowledgement number).

Step 4 — Track the response. The SPIO must respond within 30 days of receiving your application under Section 7(1) of the RTI Act. If your request concerns information related to the life or liberty of a person, the response must be provided within 48 hours under the Section 7(1) proviso.

Step 5 — File a First Appeal if needed. If the SPIO fails to respond, responds incompletely, or refuses information without adequate justification, file a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) — a senior officer designated within the same Social Welfare Department office — within 30 days of the date of the SPIO's decision or the expiry of the 30-day response period, whichever is applicable. No fee is payable for a First Appeal.

Step 6 — File a Second Appeal with UPSIC if needed. If the First Appeal is also unsatisfactory, file a Second Appeal under Section 19(3) of the RTI Act with the Uttar Pradesh State Information Commission (UPSIC) within 90 days of the FAA's decision or the date it should have been made. UPSIC is established under Section 15 of the RTI Act and has exclusive jurisdiction over all UP state public authorities. Under Section 20 of the RTI Act, UPSIC can impose a personal penalty of ₹250 per day (up to ₹25,000) on the SPIO for unjustified refusal or delay, and can recommend disciplinary action.

What Specific Records Can You Ask For?

Pension Application Status and Rejection Orders

Ask for: (1) the current approval status of your application, with the stage at which it is currently pending; (2) a certified copy of the rejection or suspension order if your application was rejected or your pension was stopped; (3) the specific eligibility criterion on which the rejection is based; (4) the name and designation of the officer who passed the order; and (5) whether a notice or show-cause was issued to you before rejection.

Payment Disbursement and DBT Records

Ask for: (1) a complete month-wise statement of pension payments credited to your Aadhaar-linked bank account for the period you specify; (2) the bank account number and IFSC code to which payments are currently mapped in the department's database; (3) whether any DBT transaction was returned or failed — and if so, the failure reason and the date it was flagged; (4) whether the issue was flagged for correction and by whom.

Eligibility Criteria and Scheme Guidelines

Ask for: (1) certified copies of current scheme guidelines and government orders setting eligibility criteria for the specific pension scheme; (2) the income limit currently in force; (3) whether a BPL card is mandatory or whether an income certificate suffices; (4) for Divyang Pension, the minimum disability percentage and whether a UDID card is required; and (5) any circulars or orders modifying the scheme issued in the last three financial years.

Beneficiary List and Fund Utilisation

Ask for: (1) the complete beneficiary list for your village, ward, or block showing names and last payment dates; (2) the total number of beneficiaries in your district under each pension scheme for the current financial year; (3) the total funds allocated and disbursed for each scheme in the district; and (4) the number of pending applications yet to be processed.
