Uttar Pradesh is home to the largest primary school network in India. With over 1.5 lakh government primary and upper-primary schools under the Basic Education Department and more than 1.8 crore children enrolled, UP's elementary education system is the most expansive in the country — and among the most challenging to administer. Major education hubs including Lucknow, Prayagraj, and Varanasi anchor the state's academic and administrative infrastructure, but implementation gaps persist across the state's 75 districts, particularly in rural blocks of Purvanchal and Bundelkhand.

Key central and state schemes — the PM Poshan (Mid-Day Meal) scheme, the Right to Free and Compulsory Education Act 2009 (RTE), pre-matric scholarships for SC/ST/OBC/minority students, Shikshak Bharti teacher recruitment, and the Samagra Shiksha Abhiyan umbrella programme — reach crores of children but face persistent challenges: irregular food supply and contractor mismanagement in the MDM scheme; low uptake of RTE Section 12(1)(c) private school seats; disbursement delays in the NIC portal-driven scholarship system; politically sensitive teacher recruitment disputes under Shikshak Bharti; and uneven progress on school infrastructure targets under Samagra Shiksha. The NIPUN Bharat foundational literacy and numeracy mission, launched by the Central Government in 2021, is a further priority, with UP required to ensure all children achieve basic reading and arithmetic competencies by Grade 3.

The Right to Information Act, 2005 gives parents, students, civil society organisations, and researchers a legally enforceable mechanism to access official records from the Basic Education Department and its subordinate offices — records that are often the only independent check on whether schemes are functioning as intended.

What Information Can You Seek?

RTI applications to the UP Basic Education Department can access a wide range of records, including:

  • Mid-Day Meal (PM Poshan) records: Food quality test results, daily menu compliance registers, contractor agreements and payment details, per-child daily expenditure, attendance and beneficiary count records, and action-taken reports on complaints about food quality or irregularities.
  • RTE Section 12(1)(c) admissions: District-wise and school-wise data on 25% EWS/disadvantaged group seats in private unaided schools — seats reserved, applications received, admissions granted, reimbursement per child paid to schools by the state government, and reasons where eligible children were denied admission.
  • Pre-matric scholarship disbursement: Block and district-wise data on SC/ST/OBC/minority scholarship applications, sanctions, amounts disbursed through the NIC scholarship portal, and cases of exclusion or delay.
  • Shikshak Bharti teacher recruitment: Vacancies advertised, merit lists, selected candidates, complaints received against the selection process, and departmental action taken on those complaints.
  • Samagra Shiksha Abhiyan infrastructure: School-wise classroom construction, toilet provision, drinking water and electricity connectivity, funds allocated and utilised, and works pending or incomplete.
  • NIPUN Bharat learning outcomes: National Achievement Survey (NAS) and NIPUN Bharat foundational literacy assessment scores at district and block level, UP's ranking among states, and remedial action plans implemented by the department.

How to File RTI

Step 1: Identify the correct CPIO. For school-specific records (MDM quality at a particular school, RTE admissions in a specific block), file with the District Basic Education Officer (DBEO) of the relevant district. For block-level data, the Block Education Officer (BEO) may also hold records. For state-level consolidated data or Directorate-level policy, file with the State Public Information Officer, Directorate of Basic Education, Lucknow.

Step 2: Draft a specific application. Use the sample RTI questions above as a template. Name the school, block, district, and the academic or financial year. The more specific the question, the more actionable the response. Vague questions invite evasive or incomplete replies.

Step 3: File online. All UP state education bodies are accessible via the Central RTI Online portal at rtionline.gov.in. Register, select the relevant Uttar Pradesh state department (Basic Education), fill in the application, and pay the ₹10 fee online. BPL cardholders may claim fee exemption with a self-attested copy of their BPL card.

Step 4: Offline filing. Send the application by registered or speed post to the CPIO at the relevant office. Enclose a crossed Indian Postal Order (IPO) for ₹10 drawn in favour of the Accounts Officer of the concerned department. Retain the postal receipt and a photocopy of the full application.

Step 5: Track and follow up. Note the acknowledgement number and mark the 30-day response deadline on your calendar. If no response is received within 30 days, file a First Appeal immediately.

Key RTI Act Provisions

The Basic Education Department, Government of Uttar Pradesh, and all its subordinate offices are public authorities under Section 2(h) of the Right to Information Act, 2005 — bodies established and funded by the state government.

  • Section 6: Any citizen may file an RTI application in Hindi, English, or any scheduled language; no reason need be stated.
  • Section 7(1): The CPIO must provide information within 30 days of receiving the application.
  • Section 7(1) proviso: The response period is reduced to 48 hours where information concerns the life or liberty of a person.
  • Section 19(1): First Appeal may be filed within 30 days of the date of the CPIO's decision or the expiry of the 30-day response period, whichever is applicable.
  • Section 19(3): Second Appeal lies with the Uttar Pradesh State Information Commission (UPSIC).
  • Section 20: The UPSIC may impose a penalty of ₹250 per day (up to ₹25,000) on the defaulting CPIO and recommend disciplinary action.

First Appeal

If the CPIO does not respond within 30 days, or if the response is incomplete, incorrect, or unjustifiably refuses information, file a First Appeal under Section 19(1) of the RTI Act within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. Address the First Appeal to the First Appellate Authority (Additional Director of Basic Education or designated senior officer) in the same department. No fee is payable for a First Appeal. Attach a copy of your original application and the CPIO's response (if any), and state clearly which information was not provided and why the denial is unjustified. The FAA must dispose of the First Appeal within 30 days (extendable to 45 days with written reasons).

Second Appeal

If the First Appellate Authority does not respond satisfactorily, file a Second Appeal under Section 19(3) of the RTI Act with the Uttar Pradesh State Information Commission (UPSIC) in Lucknow. The UPSIC is the correct appellate body for all RTI matters relating to UP state public authorities, including the Basic Education Department, the Directorate of Basic Education, District Basic Education Officers, and Block Education Officers.

The Second Appeal must be filed within 90 days of the FAA's decision or the expiry of the FAA's response period. The UPSIC has the power to order disclosure of withheld information, impose penalties on the defaulting CPIO under Section 20, and recommend disciplinary action.

Important: Do NOT file the Second Appeal with the Central Information Commission (CIC). The CIC has jurisdiction only over Central Government bodies. The UP Basic Education Department, Directorate of Basic Education, DBEOs, and BEOs are all state bodies — the correct and exclusive appellate body is the UPSIC.
