Owning a home is among the most significant financial decisions in a person's life, and for millions of middle-income families across Uttar Pradesh, the UP Avas Vikas Parishad has been the gateway to that goal. Established under the UP Avas Vikas Parishad Act, 1965, the Parishad operates hundreds of housing schemes across the state — offering residential plots and flats to citizens through lottery-based allotment across cities such as Lucknow, Kanpur, Agore, Varanasi, Meerut, Allahabad, Ghaziabad, Aligarh, and beyond. Yet allottees frequently face years of uncertainty: lottery results that appear opaque, possession letters that never arrive, registry processes that stall without explanation, maintenance charges with no corresponding maintenance, and encroachments on colony open spaces that go unchecked.

UP Avas Vikas Parishad is a public authority under Section 2(h) of the Right to Information Act, 2005. Any citizen can, for a single payment of ₹10, file a written application compelling the Parishad to disclose allotment records, lottery results, possession letter status, registry timelines, maintenance fund utilisation, lease deed terms, and encroachment actions. Understanding UP Avas Vikas Parishad and Its Housing Schemes

UP Avas Vikas Parishad — often called the UP Housing Board — is a statutory body under the Housing and Urban Planning Department of the Government of Uttar Pradesh. Its mandate covers the development and sale of residential plots and flats under self-financing schemes, the construction of group housing complexes, and the maintenance of developed colonies until they are transferred to local bodies or resident welfare associations.

The Parishad operates through a network of regional offices in major cities, each administering a portfolio of housing schemes. Schemes are typically announced with a fixed number of plots or flats, and applicants register by paying a token deposit. After the registration window closes, allotments are made through a public lottery draw. Successful allottees pay the scheme cost in instalments, after which the Parishad issues a possession letter and, eventually, executes a sale deed or lease deed for the property.

Several recurring problems affect allottees at different stages of this process. At the lottery stage, applicants may not receive intimation of results or may be excluded from draws without explanation. At the possession stage, development work in the scheme — roads, drainage, streetlights, boundary walls — is often incomplete, delaying possession indefinitely. At the registry stage, title transfer stalls due to pending dues, missing No Objection Certificates, or administrative bottlenecks. And for long-standing allottees, maintenance charges are levied on colony infrastructure that visibly deteriorates, raising questions about how the fund is spent. RTI reaches into all of these stages.

What Records Does UP Avas Vikas Parishad Hold?

The Parishad maintains a wide range of records across its scheme operations, all of which are disclosable under the RTI Act unless covered by a specific exemption under Section 8. Key categories include:

Plot and flat allotment registers: The Parishad maintains scheme-wise registers of all applications received, each application's registration number, the lottery draw conducted, and the allotment made. These registers show whether a given registration was included in the draw and what the outcome was. Waiting lists — maintained for oversubscribed schemes — are also part of these records.

Lottery draw documentation: For every lottery draw, the Parishad holds records of the date and method of draw (computerised or manual), the presiding officer, the total number of applications, the total number of units available, and the list of allottees. These records are important for citizens who wish to verify whether the draw was conducted fairly and whether their registration was genuinely in the draw pool.

Possession letter files: The Parishad tracks the issuance of possession letters scheme-wise and plot/flat-wise. Files contain the date on which possession was due per scheme terms, communications with the allottee, and internal notes on any delay — including whether the delay is due to incomplete development, litigation, pending state approval, or revenue regularisation.

Registry and sale deed records: The title transfer process involves payment of balance dues, stamp duty computation, and execution of a sale deed or long-term lease deed. The Parishad's registry section holds the procedural checklist, the current status of each allottee's registry file, and records of any objection or encumbrance that is preventing execution.

Maintenance charge accounts: The Parishad levies maintenance charges on allottees in developed colonies and is required to maintain and audit these funds. Accounts show the amount collected per year, the items of expenditure (road repair, park maintenance, common area lighting, sewerage upkeep), and the agency or contractor engaged. Audit reports are also held at the Parishad's accounts section.

Encroachment and anti-encroachment records: The Parishad's estate wing maintains records of encroachments detected on unallotted plots, open spaces, parks, and common areas — along with eviction notices issued, demolition proceedings conducted, and the current status of each encroachment case.

Lease deed terms and scheme brochures: Original scheme brochures, allotment letters, and model lease deed formats are held by the Parishad and are disclosable, allowing allottees to verify the exact terms under which their plot or flat was offered.

How to File: Step by Step

  1. Identify the correct SPIO: For queries about a specific scheme, the SPIO of the relevant regional or divisional office of UP Avas Vikas Parishad is the appropriate authority — for example, the SPIO at the Lucknow, Kanpur, Agra, or Varanasi regional office for schemes in those cities. For state-level policy records, aggregate data, or matters involving the Parishad's headquarters, the SPIO at 104 Mahatma Gandhi Marg, Lucknow – 226001 is the right address.
  2. Draft your application with specifics: Include your registration or application number, the name and number of the scheme, your plot or flat number, the city or district, and the financial year relevant to your query. Set out each information request as a separate numbered point. Specific, targeted questions receive faster and more complete responses than general ones.   3. Pay the application fee: Pay ₹10 online through the UP RTI portal at rtionlineup.up.nic.in or enclose an Indian Postal Order of ₹10 drawn in favour of the relevant Accounts Officer of UP Avas Vikas Parishad if filing by post. Citizens below the poverty line (BPL cardholders) are exempt — attach a self-attested copy of the BPL card. Do not send cash by post.
  4. Preserve all acknowledgements: Save the application number and receipt. The 30-day response period under Section 7(1) of the RTI Act begins from the date the SPIO receives your application.
  5. Escalate through appeals if needed: If no response arrives within 30 days, file a First Appeal under Section 19(1) with the First Appellate Authority (the officer senior to the SPIO) within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. No fee is payable. If still unsatisfied, file a Second Appeal under Section 19(3) with the Uttar Pradesh State Information Commission (UPSIC) within 90 days. The UPSIC can order disclosure, impose a penalty of ₹250 per day (up to ₹25,000) on the defaulting SPIO under Section 20 of the RTI Act, and recommend departmental action.

Appeals: First Appeal and Second Appeal

If the SPIO provides no response, an incomplete response, or withholds information without citing a valid exemption under Section 8 of the RTI Act, the appeals process provides two further levels of recourse.

First Appeal (Section 19(1)): Address your First Appeal to the First Appellate Authority — typically the Housing Commissioner, the Additional Chief Executive Officer, or another officer senior to the SPIO at the relevant office of UP Avas Vikas Parishad. The First Appeal must be filed within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. No fee is payable. The First Appellate Authority is required to decide the appeal within 30 days, or in exceptional circumstances within 45 days with reasons recorded in writing.

Second Appeal (Section 19(3)): If the First Appellate Authority fails to respond within the prescribed period or gives an unsatisfactory response, you may file a Second Appeal with the Uttar Pradesh State Information Commission (UPSIC) under Section 15 of the RTI Act. The Second Appeal must be filed within 90 days of the date of the First Appellate Authority's decision or expiry of its response deadline. The UPSIC is the final adjudicatory authority for all Uttar Pradesh state public authorities, including UP Avas Vikas Parishad. All second appeals against the Parishad go to the UPSIC — never to the Central Information Commission (CIC), which has jurisdiction only over Central Government bodies.

The UPSIC can issue orders directing disclosure of withheld information, impose a daily penalty of ₹250 (up to ₹25,000 total) on the defaulting SPIO under Section 20 of the RTI Act, and recommend disciplinary proceedings where delay or suppression was willful. Many allottees have found that filing a Second Appeal with the UPSIC, combined with the documentary trail built through RTI, provides the leverage needed to resolve long-pending housing grievances that years of ordinary correspondence with the Parishad failed to move.
