The Real Estate (Regulation and Development) Act, 2016 (RERA Act) established Real Estate Regulatory Authorities in every state and Union Territory to protect home buyers, regulate real estate projects and agents, and ensure timely project delivery. Every RERA authority — whether Delhi RERA (DREDA), Haryana RERA (HRERA), MahaRERA, UP-RERA, or any other — is a public authority under Section 2(h) of the RTI Act, 2005. Home buyers, allottees, and complainants before RERA can file RTI applications to obtain project registration details, complaint status, copies of RERA orders, and evidence of builder compliance.

Check the RERA Portal Before Filing RTI

Each state RERA body operates a public portal where basic project registration data is searchable. The central portal at rera.gov.in links to every state RERA website.

On these portals, you can look up a project's registration number, promoter details, project status, and often the list of registered agents. Use RTI when you need:

  • A certified copy of the project registration certificate or the promoter's registration application — for use in court or legal proceedings
  • The status of a complaint you filed with RERA (hearing dates, stage, outcome) when the portal does not reflect current proceedings
  • Enforcement details — whether RERA has initiated recovery or penalty proceedings against the builder
  • Escrow compliance data — whether the builder deposited the required 70% of collected funds as required by RERA Act Section 4
  • A certified copy of a RERA order for use in execution, recovery, or contempt proceedings

Delhi RERA (DREDA) is a Central Government authority established under MoHUA for the Union Territory of Delhi — RTI applications to DREDA are filed on rtionline.gov.in and second appeals go to the CIC. All other state RERAa are established by state governments and follow state RTI procedures with second appeal to the respective State Information Commission.

Where to File

For Delhi RERA (DREDA):

  1. Go to rtionline.gov.in
  2. Select Ministry of Housing and Urban Affairs → Delhi Real Estate Regulatory Authority (DREDA)
  3. Draft your questions — include the project RERA registration number, promoter name, and any complaint number
  4. Pay ₹10 online. BPL cardholders are exempt
  5. Submit and note your registration number

For other state RERAa: File on the respective state's RTI portal, selecting the relevant state RERA authority. Most state RTI portals are accessible through the Central Government's RTI portal at rtionline.gov.in under the respective state section, or directly from the state's own RTI portal.

What Specific Information Can You Ask For?

Project registration:

  1. Registration status of project RERA No. XXX — whether active, extended, expired, or revoked
  2. Original registration date, project completion date, and any extensions granted with stated reasons
  3. Total units in the project, units sold as disclosed by the promoter to RERA, and units for which possession has been reported as given

Promoter registration and compliance: 4. All projects registered by Promoter Name with RERA — status of each (active, completed, expired, revoked) 5. Whether the promoter's registration has been suspended or cancelled — date, reason, and RERA Act section invoked 6. Any penalty imposed on the promoter — amount, date, section cited, and whether deposited

Escrow account compliance (RERA Act Section 4): 7. The designated bank account disclosed by the promoter for the 70% escrow requirement for project RERA No. XXX 8. Whether RERA has audited or verified compliance with the 70% escrow deposit requirement — findings and any action taken for non-compliance

Complaint status: 9. Registration date and current stage of complaint No. XXX — notice, reply, hearing, adjudication, or disposal 10. Date of last hearing and next scheduled hearing date

RERA order copy: 11. A certified copy of the RERA authority's order / Adjudicating Officer's order in Case No. XXX — including the operative portion directing relief

Appeals

First Appeal (Section 19(1)): File with the First Appellate Authority (FAA) at the same RERA body within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable.

Second Appeal (Section 19(3)):

  • For Delhi RERA (DREDA): File with the Central Information Commission (CIC) within 90 days. DREDA is a Central Government public authority under MoHUA.
  • For all other state RERAa (Haryana, Maharashtra, UP, Karnataka, Tamil Nadu, etc.): File with the respective State Information Commission (SIC) within 90 days. These are state government bodies.

Under Section 20 of the RTI Act, the Information Commission may impose a penalty on the PIO of ₹250 per day (up to ₹25,000) for delay without reasonable cause.
