Rajasthan Land Records Terminology: A Reference Guide

Before drafting an RTI application, it is essential to use the correct Rajasthan-specific revenue terminology. The key terms and their meanings are:

Jamabandi (जमाबंदी): The Record of Rights (RoR) — the primary legal register for each village (Gram) that records every Khasra (plot), its owner(s) in the Khewat column, the cultivator(s) / possessor(s) in the Khudkasht / Gair-Khudkasht column, the area (in Bigha / Biswa / Biswaansi), the classification of land, and any encumbrances or government charges. It is the authoritative proof of land ownership and is updated only when a Namanantaran (mutation) is sanctioned by the Tehsildar. The Jamabandi is prepared for a settlement period (typically every few years) and kept current through mutation entries.

Girdawari (गिरदावरी): The biannual crop and possession inspection record maintained by the Patwari. The Patwari visits each field twice a year — once during the Kharif crop season (approximately May to October) and once during the Rabi crop season (October to April) — and physically records the name of the person in actual possession of the land, the crop being grown, and the state of the land (cultivated, fallow, encroached). The Girdawari is distinct from the Jamabandi: it captures actual ground-level possession at the time of each inspection rather than legal ownership. Discrepancies between the Girdawari and the Jamabandi can indicate disputes, tenancies, encroachments, or Patwari-level misrecording.

Namanantaran (नामान्तरण): Mutation — the formal process of updating the Jamabandi to reflect a change in ownership or possession. A Namanantaran application is filed at the Tehsil office after a registered sale deed, inheritance, partition, gift, or court decree. It is processed by the Patwari (field verification) and sanctioned by the Tehsildar or Naib Tehsildar. Until a Namanantaran is sanctioned, the buyer's or heir's name does not appear in the Jamabandi as owner, even if they hold a registered sale deed or a succession certificate.

Khasra (खसरा): The plot number — the unique identifier for each physical parcel of land within a village (Gram). Every piece of land has a distinct Khasra number, which is the primary identifier used in all revenue records.

Khata (खाता): The account number — a holding that groups together all Khasra plots belonging to the same landowner or co-owners in a village. A single landholder may have one Khata containing multiple Khasra plots.

Khewat (खेवट): The portion of the Jamabandi that records the name(s) of the owner(s) and their co-ownership shares (Hissa). The Khewat number refers to the serial number of the ownership entry. This is the definitive column for establishing who is the recorded legal owner of a Khasra.

Khatoni (खतौनी): The portion of the Jamabandi that records the names of cultivators or possessors (Khudkasht — self-cultivating owner; Gair-Khudkasht — tenant or occupant other than the owner). The Khatoni captures who is actually working the land, which may differ from the Khewat (ownership) entry.

Apna Khata (अपना खाता): Rajasthan's official land records portal at apnakhata.raj.nic.in (also accessible through E-Dharti), which provides free online access to Jamabandi and Girdawari records for all villages in the state. While extremely useful for reference, Apna Khata printouts are not certified copies.

Board of Revenue, Rajasthan: The highest revenue court and appellate authority for land and revenue matters in Rajasthan, headquartered at Todarmal Marg, Ajmer – 305 001. It handles revenue appeals and also functions as a public authority under the RTI Act for matters at its level.

What RTI Can Reveal About Rajasthan Land Records

Filing an RTI with the appropriate Revenue Department authority can deliver the following concrete outcomes:

  1. Certified Jamabandi copy: The authenticated Record of Rights for a specific Khasra/Khata — owner names in the Khewat, cultivator names in the Khatoni, area, land classification, and any mortgage or encumbrance entry — bearing the Tehsildar's seal and signature, admissible as documentary evidence in court
  2. Certified Girdawari entries: Patwari's biannual crop and possession records for specific Kharif and Rabi seasons — establishing actual possession at the time of each Patwari inspection
  3. Namanantaran history: Every mutation in the last 10+ years — who transferred to whom, on what legal basis, and which Tehsildar sanctioned it
  4. Pending mutation status: Whether your Namanantaran application has been registered, the stage it is at, who is holding the file, and the reason for any delay
  5. Mutation order copy: A certified copy of the Namanantaran Aadesh (mutation order) once sanctioned
  6. Encumbrance details: Whether a mortgage (Rehan), charge, or lis pendens is recorded against a Khasra in the Jamabandi or related revenue registers
  7. Government / Shamlat land classification: Whether a plot or part of it is Sarkari Zameen (government land), Shamlat Deh (village common land), Charaagah (grazing land), or Banjar (barren/fallow) — and whether any encroachment is formally recorded
  8. Patwari measurement and field records: Details of any Paidaish (field measurement) conducted and the resulting records

Where to File: The Right Authority

Rajasthan's revenue hierarchy for land records operates through several tiers for RTI purposes. Choosing the right authority ensures faster and more complete responses:

Tehsildar / Naib Tehsildar's Office (Primary Authority)

The Tehsildar's office is the most appropriate and effective first point of RTI filing for virtually all land record matters — Jamabandi copies, Girdawari records, Namanantaran status and history, encumbrance details, and field-level revenue records. The Tehsildar sanctions mutations, maintains the Tehsil-level revenue registers, and supervises the Patwaris within the Tehsil. The SPIO is typically the Tehsildar or Naib Tehsildar of the concerned Tehsil. File here for any query relating to a specific plot, pending mutation, Girdawari discrepancy, or revenue record dispute involving land within that Tehsil.

Sub-Divisional Officer (Revenue) — SDO

The Sub-Divisional Officer (Revenue) is the next level up from the Tehsildar. File here for: matters involving multiple Tehsils within a Sub-Division, appeals against Tehsildar-level orders, SDO-level revenue proceedings, or when the Tehsildar's SPIO is unresponsive. The SDO's office is also the typical First Appellate Authority (FAA) for RTI applications filed at the Tehsildar level.

District Collectorate — Collector's Office

The Collector is the highest revenue authority at the district level. File here for: district-level land acquisition records, government land classification orders, district-level encroachment data, Patta issuance records, or when the SDO's office is unresponsive. The Collector's SPIO handles queries that span multiple Sub-Divisions or involve district-level decisions.

Board of Revenue, Rajasthan, Ajmer

The Board of Revenue, Rajasthan, headquartered at Todarmal Marg, Ajmer – 305 001, is the apex revenue body in the state. File here for: policy-level queries, information about matters before the Board of Revenue in appeal or revision, systemic issues with the Apna Khata / E-Dharti digital system, or matters that cannot be addressed at the district level. The Board's SPIO handles RTI applications at the Board's level.

How to File: Step by Step

Step 1: Identify Your Land Details

Before drafting your RTI, note the exact Khasra number(s), Khata/Khewat number, village (Gram), Patwari Halka, Tehsil, and District for your land. You can verify these on the Apna Khata portal (apnakhata.raj.nic.in) by selecting your district, Tehsil, and village. Having the correct identifiers ensures the SPIO can quickly locate the relevant records and reduces the risk of a response stating "records not traceable."

Step 2: Draft Your RTI Application

Use the sample application above as your starting point. State your land particulars clearly at the top — Khasra number, Khata/Khewat number, village, Patwari Halka, Tehsil, and District. Frame each information request as a numbered, specific, factual query rather than using vague or emotional language. For example, write "certified copy of the current Jamabandi entry for Khasra No. XXX" rather than "all information about my land dispute." Specific, factual requests yield faster and more complete responses.

Step 3: File Online or by Post

Online: File through the Rajasthan RTI portal at rti.rajasthan.gov.in. Select the Revenue Department and the relevant sub-office (Tehsildar for your Tehsil, or Collector for your district). Pay the ₹10 fee via net banking, debit card, or UPI on the portal. Note the registration number after submission.

By Post or In Person: Send a written application by registered post to the SPIO, Office of the Tehsildar / Naib Tehsildar, Tehsil Name, District Name, Rajasthan — or deliver it in person at the Tehsil office. Enclose an Indian Postal Order (IPO) of ₹10 drawn in favour of the Accounts Officer of the Tehsildar's office (confirm the exact payee title with the office or its website). BPL cardholders are exempt from the fee — attach a copy of the BPL card. Do not send cash by post. Retain the postal receipt; the 30-day response clock starts from the date of receipt of the application by the SPIO.

Step 4: Track and Follow Up

The SPIO must respond within 30 days of receipt under Section 7(1) of the RTI Act, 2005. If the information requested relates to the life or liberty of a person, the deadline is 48 hours under the proviso to Section 7(1). If you filed online, track the status using your registration number on the Rajasthan RTI portal.

Step 5: Appeals if Needed

If the SPIO does not respond or provides an unsatisfactory response, proceed to the First Appeal and then, if necessary, the Second Appeal — see the Appeals section below.

Detailed Information Requests You Can Make

Jamabandi and Record of Rights

  1. Certified copy of the current Jamabandi entry for Khasra No. XXX, Village Name, Tehsil Name, District Name — all columns including owner names (Khewat), cultivator / possessor names (Khatoni), area in Bigha/Biswa, land classification, and any mortgage, encumbrance, or government notation in the remarks
  2. Whether Khasra No. XXX or any portion of it is classified as government land (Sarkari Zameen), Shamlat Deh (village common land), Charaagah (grazing land), or any other non-private category — the recorded area, basis of classification, and details of any encroachment formally noted
  3. Whether any portion of Khasra No. XXX has been marked as Banjar (barren / fallow) — for how many seasons, and whether any conversion or de-classification application is on record

Girdawari Records

  1. Certified copy of the Girdawari entries for Khasra No. XXX, Village Name for the last four seasons (Kharif YYYY, Rabi YYYY-YY, Kharif YYYY, Rabi YYYY-YY) — the name of the person recorded in possession, the crop, and the Patwari's remarks for each season
  2. Whether the Girdawari entry for Khasra No. XXX for any of the above seasons shows a name different from the Jamabandi (Khewat) owner — and if so, the basis for that entry

Namanantaran (Mutation) Status and History

  1. Status of Namanantaran application No. XXX (or any pending mutation for Khasra No. XXX filed by Name) — current stage, name of the officer holding the file, reason for delay if beyond the prescribed period, and a certified copy of the Namanantaran order if already passed
  2. Complete Namanantaran history for Khasra No. XXX for the last 10 years — each mutation number, date, transferor, transferee, legal basis, and sanctioning officer
  3. Copy of the Patwari's field inquiry report (Goshwara) submitted in connection with Namanantaran application No. XXX
  4. Copy of any notice (Suchna) issued to parties in connection with Namanantaran application No. XXX and the record of hearing(s) conducted

Encumbrance and Mortgage Records

  1. Whether any mortgage (Rehan), conditional sale, charge, lis pendens, or court injunction is noted against Khasra No. XXX or Khata No. XXX in the Jamabandi or any other revenue register maintained at your office — and if so, full details of each entry

Government and Shamlat Land

  1. Whether any encroachment on Shamlat Deh, Charaagah, or Sarkari Zameen has been formally recorded in Village Name — the Khasra numbers and area affected, and the action taken by the Tehsildar's office
  2. Whether any portion of Shamlat Deh or Charaagah in Village Name has been mutated in favour of a private individual in the last 10 years — if yes, the mutation number, date, transferee, and the authority that sanctioned it

Apna Khata vs RTI: When to Use Each

Rajasthan's Apna Khata portal at apnakhata.raj.nic.in (also accessible through E-Dharti) is one of the most developed land record portals in India. It provides free, instant online access to Jamabandi data, Girdawari records, and Namanantaran status for virtually every village in the state. It is genuinely useful and should be consulted before filing an RTI application.

However, the Apna Khata portal has inherent limitations that make RTI indispensable for serious land matters:

The practical approach: Use Apna Khata to identify your Khasra and Khata numbers, review the current Jamabandi, and check the initial Namanantaran status. Use RTI when you need certified copies for legal proceedings or banking, when you need historical mutation records, when your mutation is stalled and you need accountability, or when the portal entry appears incorrect and you need the authoritative physical register entry.

Appeals

First Appeal (Section 19(1)): If the Tehsildar's SPIO does not respond within 30 days, or provides an incomplete or evasive reply, file a First Appeal with the First Appellate Authority (FAA) — typically the Sub-Divisional Officer (Revenue) of the concerned Sub-Division, or an officer senior to the SPIO within the same Tehsildar's office as designated. The First Appeal must be filed within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. No fee is required. The FAA must decide within 30 days (extendable to 45 days with written reasons).

Second Appeal (Section 19(3)): If the FAA's response is absent or unsatisfactory, file a Second Appeal with the Rajasthan State Information Commission (RSIC) within 90 days of the FAA's decision or the expiry of the FAA's response deadline. No fee is required. The RSIC is constituted under Section 15 of the RTI Act as the state-level information commission for Rajasthan. The Central Information Commission (CIC) has no jurisdiction over Rajasthan state government bodies — including the Revenue Department, Tehsildar offices, District Collectorates, and the Board of Revenue, Ajmer. The RSIC can direct the SPIO to furnish the information and impose a penalty of ₹250 per day (up to ₹25,000) on the SPIO personally under Section 20 of the RTI Act for failure or obstruction without reasonable cause.

Jamabandi records, Girdawari entries, Namanantaran orders, and field inquiry reports are standard revenue records routinely provided to landowners. They do not attract any Section 8 exemption under the RTI Act. If the SPIO cites a Section 8 exemption for such records, a First Appeal pointing out the absence of any valid exemption is likely to succeed before the FAA or the RSIC.
