PMAY is a Central Government scheme — should I file RTI with the Central Government or with my city corporation?

Both are public authorities and the correct target depends on what information you need. PMAY is a Centrally Sponsored Scheme — the Ministry of Housing and Urban Affairs (for PMAY-U) or Ministry of Rural Development (for PMAY-G) sets the policy, guidelines, and fund allocation. However, beneficiary selection, application processing, waiting lists, and implementation decisions are made by the State Housing Authority, Urban Local Body (city/town corporation), or District Collector's Office — and these are the correct authorities for questions about your individual application. File with the Urban Local Body or State Housing Authority (through the state RTI portal) for individual application status, rejection reasons, and beneficiary lists. File with the Central Ministry (rtionline.gov.in) for national policy, eligibility guidelines, and fund release data.

My PMAY application was rejected but I was not told why. What RTI questions should I ask?

Ask for: (1) the specific reason(s) for rejection of your application bearing registration number [XXX], with reference to the eligibility criterion or condition under which you were found ineligible; (2) whether the rejection was based on a document deficiency, an Aadhaar mismatch, a prior house ownership record, or income limit — if so, which specific document or record; (3) the name and designation of the officer who made the rejection decision and the date of the decision; (4) whether you were given an opportunity to correct any deficiency before rejection — if yes, the date and nature of such communication; and (5) the procedure for challenging the rejection. A written RTI response often reveals procedural errors or factual inaccuracies in the rejection that can form the basis of a formal representation.

The credit-linked subsidy (CLSS) under PMAY has not been credited to my home loan account. What should I do?

CLSS is processed by a Central Nodal Agency (CNA) — either National Housing Bank (NHB) or Housing and Urban Development Corporation (HUDCO) — and disbursed directly to your lending bank or Housing Finance Company (HFC), which then credits it to reduce your principal. If the subsidy has not been credited despite your application being approved, file an RTI with: (1) your lending bank or HFC — asking whether the subsidy has been received and credited, and if not, the reason; (2) the Ministry of Housing and Urban Affairs (rtionline.gov.in) — asking whether your application's subsidy request has been processed by the CNA and the date of disbursal if done. CLSS under PMAY-Urban has been closed for new applications since March 2022 (for EWS/LIG/MIG categories), so this question is primarily relevant for applications submitted before that date.

How do I know if my PMAY-Gramin (rural) application is on the waiting list or has been excluded?

For PMAY-Gramin, beneficiary lists are prepared at the district/block level using the Socio-Economic and Caste Census (SECC) 2011 data, prioritised by the Gram Sabha. RTI with the District Collector's Office or the District Rural Development Agency (DRDA) for your district can reveal: (1) the complete permanent waiting list (PWL) for PMAY-G in your Gram Panchayat / village, with priority numbers; (2) your name's position on the list; (3) the criteria used by the Gram Sabha for prioritisation; and (4) the names and priority numbers of beneficiaries selected ahead of you in recent tranches. This is public information — the SECC-based beneficiary list is not exempt under Section 8 of the RTI Act.

What if the public authority does not respond to my RTI within 30 days?

File a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. For Second Appeal: if you filed with the Central Government (Ministry of Housing and Urban Affairs on rtionline.gov.in), the second appeal goes to the Central Information Commission (CIC). If you filed with a state-level authority (Urban Local Body, State Housing Authority, District Office), the second appeal goes to the relevant State Information Commission. For Delhi, that would be the Delhi Information Commission (DIC). The CIC/SIC can impose a penalty of ₹250 per day (up to ₹25,000) on the errant CPIO under Section 20 of the RTI Act.

Appeals

First Appeal (Section 19(1)): If no response within 30 days, file with the First Appellate Authority (FAA) within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable.

Second Appeal (Section 19(3)):

For Central Government authorities (MoHUA, MoRD, NHB, HUDCO): appeal to the Central Information Commission (CIC) within 90 days
