The National Commission for Scheduled Castes (NCSC) is a constitutional body established under Article 338 of the Constitution of India. How to File RTI with NCSC
NCSC is a Central Government body under the Ministry of Social Justice and Empowerment. RTI applications are filed online through the Central Government RTI portal.
Step-by-step process:
- Visit rtionline.gov.in
- Register or log in with your email address
- Click "Submit Request" and select Ministry of Social Justice and Empowerment as the ministry, then search for and select National Commission for Scheduled Castes as the public authority
- Type your information request clearly — describe what you want (complaint numbers, copies of reports, expenditure data, recommendations) with specific dates or reference numbers wherever possible
- Pay the application fee of ₹10 via online payment (net banking, debit/credit card, or UPI). BPL cardholders are exempt — upload a copy of your BPL card
- Submit and note down the registration number for tracking
Under Section 7(1) of the RTI Act, 2005, the CPIO must respond within 30 days of receipt. If the matter pertains to the life or liberty of a person, the proviso to Section 7(1) requires a response within 48 hours.
Filing Fees and Exemptions
The application fee is ₹10 payable under the RTI (Regulation of Fee and Cost) Rules, 2005. If you belong to a Below Poverty Line (BPL) family, you are fully exempt from all RTI fees — attach a copy of your BPL ration card or relevant certificate to your application.
If the CPIO asks for additional charges to provide voluminous documents (such as lengthy inspection reports), those must be calculated at ₹2 per page for photocopies. You have the right to inspect records free of charge for the first hour.
Appealing an Unsatisfactory or No Response
First Appeal — Section 19(1): If NCSC does not respond within 30 days, provides incomplete information, or refuses your request without adequate grounds, file a First Appeal with the First Appellate Authority (FAA) at NCSC within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. The FAA must decide within 30 days (extendable to 45 days in writing).
Second Appeal — Section 19(3): If the FAA's response remains unsatisfactory or no decision is given, file a Second Appeal with the Central Information Commission (CIC) within 90 days. NCSC is a Central Government body, so the second appeal goes to the CIC — not a State Information Commission.
Penalty under Section 20: The CIC can impose a penalty of ₹250 per day of delay (up to ₹25,000) on a PIO who fails to respond without reasonable cause, and can recommend disciplinary proceedings.
Practical Tips
- Quote reference numbers: If you have a complaint number or diary number for a matter already filed with NCSC, include it in your RTI to get focused information on that specific case.
- Specify the state and period: Inspection reports and recommendations are state-specific and time-specific. Mention the state name, district (if relevant), and the financial year or date range in your request.
- Ask for certified copies: For inspection reports you intend to use as evidence before courts or tribunals, ask specifically for "certified copies" in your RTI request.
- Atrocity-related urgency: If the information you seek relates to the life or safety of an SC individual (e.g., an ongoing atrocity situation), clearly state this in your application — it triggers the 48-hour response requirement under the proviso to Section 7(1).
- Distinguish NCSC from state SC commissions: RTI to NCSC covers NCSC's own records only. For state-level records held by state SC commissions or state social welfare departments, file a separate RTI with those bodies through the respective state RTI portals.
