The National Commission for Protection of Child Rights (NCPCR) is a statutory body established under Section 3 of the Commissions for Protection of Child Rights (CPCR) Act, 2005. It functions under the Ministry of Women and Child Development, Government of India, with the mandate to ensure that all laws, policies, programmes, and administrative mechanisms are consistent with the rights of children as guaranteed by the Indian Constitution and other domestic and international instruments. NCPCR's core functions include monitoring the implementation of the Right to Education (RTE) Act, 2009; monitoring the Protection of Children from Sexual Offences (POCSO) Act, 2012; taking cognizance of and inquiring into child rights violations; examining complaints about child labour; and issuing recommendations to central and state governments.

Where to File
All RTI applications to NCPCR must be filed at rtionline.gov.in:
- Log in or register on the RTI Online portal using your mobile number or email address
- Click Submit Request

Do not file at the Delhi RTI portal: Delhi's rti.delhi.gov.in is for Delhi State bodies, including DCPCR. NCPCR is a Central Government body and must be approached through rtionline.gov.in.
What Specific Information Can You Ask For
- Complaint registration and status: Ask whether your complaint bearing reference number NCPCR/COMP/YYYY/XXXXX was received and registered, the date of registration, its current status (under inquiry, disposed, or referred), and — if concluded — the outcome and any recommendations issued.
- RTE Act Section 12(1)(c) monitoring data: Ask for aggregate data on EWS seat availability, the number of seats actually filled, the number of non-compliant private unaided schools identified in a named state, and any directions or recommendations issued by NCPCR to the state government on Section 12 compliance. This is non-personal aggregate monitoring data that is not exempt under the RTI Act.
- POCSO Act implementation data: Ask for NCPCR's compiled data on POCSO case registration, charge sheets filed, pendency of cases in designated Special Courts, and conviction rates — either nationally or for a specific state — for the most recent year available. Ask also for any recommendations NCPCR has issued regarding POCSO Special Court establishment, training of investigators, or child-friendly procedures.
- Child labour inquiry data: Ask whether NCPCR has taken cognizance of child labour violations in a specific industry, region, or category; the number of such matters in which NCPCR initiated inquiry or issued directions; and any aggregate data on referrals made to state governments or the Ministry of Labour.
- NCPCR recommendations to state governments: Ask for a copy of recommendations issued by NCPCR to the government of a specific state on a defined subject during a specified period, and whether any compliance report was received by NCPCR from that state in response.
- NCPCR regulations and annual reports: Ask for a copy of specific NCPCR regulations framed under Section 13 of the CPCR Act, or NCPCR's annual report for a given year, or any published guidelines, advisories, or circulars issued by NCPCR on a particular subject. These are public documents and are not exempt under the RTI Act.
Appeals
First Appeal — First Appellate Authority (FAA), NCPCR
If NCPCR's CPIO:
- Does not respond within 30 days of receipt of your application, or
- Provides an incomplete, incorrect, or unsatisfactory response,
file a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) at NCPCR. The appeal must be filed within 30 days of the date of the decision or the expiry of the 30-day response period, whichever is applicable. The FAA is a senior officer designated by NCPCR above the CPIO. On the RTI Online portal, the first appeal option appears in your application's tracking page once the 30-day window has elapsed or a response has been received.
Second Appeal — Central Information Commission (CIC)
If the FAA also does not respond within the prescribed period, or if the FAA's decision is unsatisfactory, file a Second Appeal with the Central Information Commission (CIC) under Section 19(3) of the RTI Act within 90 days of the FAA's decision or the date on which the FAA's decision should have been made.
NCPCR is a Central Government body under the Ministry of Women and Child Development. The second appeal body is therefore the CIC — not a State Information Commission, and not the Delhi Information Commission. This is true even if your complaint or inquiry relates to a Delhi-based matter; it is the nature of NCPCR (Central Government) that determines the second appellate authority.
The CIC can:
- Direct NCPCR to provide the information
- Impose a penalty of up to ₹25,000 on the CPIO under Section 20 of the RTI Act for failure to provide information without reasonable cause
- Recommend disciplinary action against the CPIO in cases of malafide denial
