The National Consumer Disputes Redressal Commission (NCDRC) is India's apex consumer disputes redressal body, constituted under the Consumer Protection Act, 2019 (which replaced the earlier 1986 Act). It is the highest tier of the three-level consumer forum system in India, situated under the Ministry of Consumer Affairs, Food and Public Distribution. NCDRC handles original consumer complaints where the value of goods, services, or compensation claimed exceeds ₹1 crore, and hears appeals against orders of State Consumer Disputes Redressal Commissions (State CDRCs). Because NCDRC is established by an Act of Parliament, substantially funded by the Central Government, and performs functions of a public nature, it is a public authority under Section 2(h) of the Right to Information Act, 2005 — and is obligated to provide information on valid RTI applications within 30 days.

RTI vs. Consumer Complaint: The Key Distinction

These are two entirely separate legal processes and must not be confused:

Filing a consumer complaint with NCDRC is the substantive proceeding. You file a complaint to seek compensation, replacement, refund, service correction, or other relief from a seller, manufacturer, developer, or service provider who has caused you deficiency in service or defect in goods. The complaint is adjudicated by NCDRC Benches, the opposite party is given notice, evidence is heard, and an order is passed. This is the process that gives you relief.

Filing an RTI with NCDRC is an administrative information request. RTI does not give you compensation. It does not direct the opposite party to act. What RTI does is give you information held by the NCDRC secretariat — case registration status, cause list dates, case pendency data, procedural regulations, and copies of orders in already-decided cases (when Registry channels are slow).

Use the consumer complaint when you want relief from an unfair trade practice or service deficiency. Use RTI when you want information about how the Commission is handling your complaint — or information about the Commission's administrative operations.

Consumer Forum Hierarchy: Which Body to RTI and Which Portal to Use

India's consumer forum system has three tiers. For RTI purposes, each tier belongs to a different government and uses a different RTI portal with a different second appeal body:

Critical point: State CDRCs and District Consumer Commissions are state government bodies. RTI applications for information about cases at these forums must go through the relevant state's RTI portal, and any second appeal lies with that state's SIC — not the CIC. Filing an RTI at rtionline.gov.in for a State CDRC matter will not work.

What Specific Information Can You Ask For

RTI with NCDRC can legitimately obtain the following categories of information:

  1. Case registration status — whether your consumer complaint or appeal has been registered in the NCDRC's case management system, and the assigned case number if registration was not confirmed at the time of filing
  2. Next date of hearing (cause list) — the scheduled date on which your case is listed before a NCDRC Bench, and the Bench number or composition
  3. Case status and stage — whether the matter is pending admission, admitted, listed for arguments, listed for orders, or has been decided / disposed of
  4. Copy of order or judgment in a decided case — the text of the final order or any interim order passed in a case number you specify (useful when you need the order quickly and the Registry process is slow; note that RTI copies are not certified copies)
  5. Appeal status against a State CDRC order — whether an appeal filed against a State CDRC order has been registered at NCDRC and the current stage of that appeal
  6. NCDRC case pendency statistics — the total number of consumer complaints and appeals pending before the Commission for a specified year or period, categorised by year of filing
  7. NCDRC Practice Regulations and procedural rules — copies of the NCDRC Practice Regulations or the Consumer Protection (Consumer Disputes Redressal Commissions) Rules governing filing of complaints and appeals before the Commission

Where to File

NCDRC is a Central Government body. RTI applications are filed online at rtionline.gov.in:

  1. Go to rtionline.gov.in and click Submit Request
  2. Register or log in with your email address
  3. In the ministry/department selection, choose Ministry of Consumer Affairs, Food and Public Distribution, then select National Consumer Disputes Redressal Commission (NCDRC)
  4. Draft your RTI application — include your case number, complainant name, opposite party name, and date of filing wherever relevant to your queries
  5. Pay the application fee of ₹10 online. BPL cardholders are exempt from the fee (attach a copy of your BPL card)
  6. Submit and save the registration number — you will need it to track your application and for filing appeals

For State CDRCs or District Consumer Commissions: Do not use rtionline.gov.in for state forum cases. Use the RTI portal of the relevant state government (for example, Delhi's state RTI portal for the Delhi CDRC or Delhi District Consumer Commissions).

Note on certified copies: If you need a certified copy of an NCDRC order for use in court or enforcement proceedings, apply separately to the NCDRC Registry following its prescribed procedure and fee. An RTI copy is useful for reference but does not serve as a certified copy for legal proceedings.

Appeals

First Appeal — Section 19(1): If the CPIO at NCDRC does not respond within 30 days, or provides an incomplete or unsatisfactory response, file a First Appeal with the First Appellate Authority (FAA) at NCDRC within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable.

Second Appeal — Section 19(3): If the FAA's response is also absent or unsatisfactory, file a Second Appeal with the Central Information Commission (CIC) within 90 days of the FAA's decision or its expiry. NCDRC is a Central Government body — the second appeal always goes to the CIC. State CDRCs and District Consumer Commissions are state bodies, so second appeals for those go to the relevant State Information Commission (SIC).

The CIC has powers under Section 20 of the RTI Act to impose a penalty of ₹250 per day (up to ₹25,000) on a CPIO who fails to provide information without reasonable cause, and can recommend disciplinary proceedings against the officer.
