Madhya Pradesh is home to one of India's most ambitious inland irrigation networks, anchored by the rivers of the Narmada basin. The Narmada — India's fifth-longest river — flows 1,312 kilometres entirely through or along the borders of Madhya Pradesh before entering Gujarat, and the cascade of major dams constructed along its course forms the irrigation backbone of central India. The Indira Sagar Dam (also known as Narmada Sagar) near Narmadapuram is India's largest reservoir by storage capacity; the Omkareshwar Dam in Khandwa district provides both irrigation and power generation; the Bargi Dam near Jabalpur serves the Mahakaushal region; and the Bansagar Dam at Shahdol — a joint project between Madhya Pradesh, Uttar Pradesh, and Bihar on the Son river — extends irrigation into the Rewa-Shahdol plateau. The Tawa Project, a major irrigation scheme in Narmadapuram (formerly Hoshangabad) district with its Tawa reservoir on a Narmada tributary, commands one of MP's most intensively cultivated agricultural zones.

The Narmada Water Disputes Tribunal, constituted in 1969 and issuing its final award in 1979, governs the inter-state allocation of Narmada waters between Madhya Pradesh, Gujarat, Rajasthan, and Maharashtra. Under this award, Madhya Pradesh is entitled to use 18.25 million acre feet (MAF) of Narmada water annually — the largest share among the four states. The Narmada Valley Development Authority (NVDA), headquartered in Bhopal, is the apex body overseeing the planning, construction, and management of all major and medium irrigation projects in the Narmada basin within MP. Alongside the Narmada system, the Chambal canal network — fed by the Gandhi Sagar, Rana Pratap Sagar, and Jawahar Sagar dams — irrigates the eastern districts of Morena, Bhind, and Sheopur.

Despite this vast infrastructure, on-the-ground water distribution is marked by persistent inequities. The warabandi system — a roster-based allocation of water turns to individual farmers — governs who gets water and when, but its implementation is frequently uneven, with head-reach farmers drawing more than their allotted share at the expense of tail-end farmers. Water User Associations (WUAs), established under MP's participatory irrigation management policy, are intended to empower farmer communities to manage distributary-level water allocation and maintenance, but their effectiveness varies widely. The Right to Information Act, 2005 is a critical tool for farmers, civil society organisations, and researchers seeking to audit this system and hold irrigation officials accountable.

What Information Can You Seek?

RTI applications to the MP Water Resources Department, NVDA, or the relevant irrigation circle/division can unlock a wide range of records:

  • Warabandi schedules: The official turn-based water allocation roster for each distributary, showing each farmer's name, landholding size, allotted turn (day, time, and duration), and any modifications to the schedule — allowing verification of whether turns are correctly recorded and equitably distributed, particularly in the Tawa Project command area and other major command zones.
  • Water release and allocation data: Records of water released from Indira Sagar, Omkareshwar, Bargi, Bansagar, or Tawa reservoirs into each branch canal and distributary, head-reach versus tail-reach delivery data, documented transmission losses, and any reports on head-tail inequity in a given Kharif or Rabi season.

How to File RTI

Step 1: Identify the correct CPIO. For state-level or project-level matters (NVDA policy, inter-state water allocation data, reservoir operation data), file with the State Public Information Officer at the Chief Engineer (Irrigation), Water Resources Department, Bhopal. For division-specific or canal-specific matters, file with the Executive Engineer (EE) of the relevant irrigation division — the EE's office is usually the primary record-keeper for warabandi schedules, canal maintenance contracts, and WUA records at the distributary level. The Superintending Engineer of the relevant circle is the appropriate authority for sub-zone consolidated data.

Step 2: Draft a specific application. Identify the canal branch, distributary, or minor canal by name. State the tehsil and district clearly. Specify the season (Kharif or Rabi) and year. Where applicable, mention your khasra number, warabandi registration number, or WUA name. Use the sample RTI questions above as a template and adapt them to your specific situation.

Step 3: File online or offline. File online via the RTI Online portal at rtionline.gov.in, selecting the appropriate MP Water Resources Department or NVDA authority. Pay the ₹10 fee digitally. BPL cardholders may upload a self-attested BPL card copy to claim fee exemption. Alternatively, send the application by registered post to the relevant CPIO's office with a crossed Indian Postal Order (IPO) for ₹10.

Step 4: Track and follow up. Retain the acknowledgement number and note the 30-day response deadline. If no reply is received within 30 days, file a First Appeal immediately.

Key RTI Act Provisions

The MP Water Resources Department, NVDA, and all subordinate irrigation circles and divisions are public authorities under Section 2(h) of the Right to Information Act, 2005.

  • Section 6: Governs the filing of RTI applications; no reason need be given for requesting information.
  • Section 7(1): Requires the CPIO to provide information within 30 days of receipt of the application.
  • Section 7(1) proviso: Reduces the response time to 48 hours if the information concerns the life or liberty of a person.
  • Section 20: Empowers the MPSIC to impose a penalty of ₹250 per day (up to ₹25,000) on a defaulting CPIO and to recommend disciplinary action.

First Appeal

If the CPIO does not respond within 30 days, or the response is incomplete or unsatisfactory, file a First Appeal under Section 19(1) of the RTI Act. The First Appeal must be addressed to the First Appellate Authority — typically the Superintending Engineer (for applications filed with an EE's division) or the Chief Engineer (for applications filed at circle or project level). The First Appeal must be filed within 30 days of the date of the CPIO's decision or the expiry of the 30-day response period, whichever is applicable. No fee is payable for a First Appeal. Attach copies of the original application and any response received.

Second Appeal

If the First Appeal is also unsatisfactory or unanswered, file a Second Appeal under Section 19(3) of the RTI Act with the Madhya Pradesh State Information Commission (MPSIC) in Bhopal. The MPSIC is constituted under Section 15 of the RTI Act and is the correct appellate body for all Madhya Pradesh state public authorities — including the Water Resources Department, NVDA, and all subordinate irrigation bodies. The Second Appeal must be filed within 90 days of the FAA's decision or the expiry of the FAA's response period.

Important jurisdictional note: Do NOT file the Second Appeal with the Central Information Commission (CIC). The MP Water Resources Department and NVDA are state public authorities — their second appeal goes exclusively to the MPSIC. A separate jurisdictional note applies to the Narmada Control Authority (NCA): the NCA is a Central Government inter-state body overseeing the Sardar Sarovar Project and coordinating the Narmada water treaty between states. RTI for the NCA itself must go to NCA's own CPIO with Second Appeal to the CIC. However, RTI for MP's own water utilisation, canal operations, and irrigation records — even those touching on Narmada Tribunal compliance — goes to the MP Water Resources Department, with Second Appeal to MPSIC.
