Maharashtra is one of India's most diverse and economically vital tourism destinations — a state that encompasses UNESCO World Heritage Sites, dramatic hill stations, a long Konkan coastline, pilgrimage towns, and wine country, all administered through one of India's largest state tourism corporations. The Maharashtra Tourism Development Corporation (MTDC) is the principal public authority responsible for tourism promotion, infrastructure, accommodation, and permits across the state. The Right to Information Act, 2005 gives citizens, journalists, researchers, tour operators, and local communities a legally enforceable right to access MTDC contracts, resort operational data, site management records, permit details, and scheme utilisation — making it an essential tool for accountability in one of Maharashtra's most public-facing departments.

What Information Can You Seek?

MTDC and the Tourism & Cultural Affairs Department, Government of Maharashtra, are public authorities under Section 2(h) of the RTI Act, 2005. Citizens can seek information on a wide range of matters:

MTDC Resort and Contract Records: MTDC operates resorts, tourist bungalows, and beach properties across Maharashtra — at Aurangabad (gateway to Ajanta-Ellora), Ganpatipule, Tarkarli, Mahabaleshwar, Matheran, Lonavala, and Nashik. RTI can reveal the tender procedures followed for awarding construction, operation, and maintenance contracts; the names of contractors and awarded amounts; project completion status; and whether contract conditions — including quality standards and timelines — were met. PPP (Public–Private Partnership) arrangements, where private operators run MTDC properties, are a particular area of interest since the terms of such agreements are matters of public record.

Ajanta and Ellora Caves — Site Management and Infrastructure: The Ajanta Caves (30 Buddhist rock-cut cave monuments, dating from 2nd century BCE to 6th century CE, a UNESCO World Heritage Site inscribed in 1983) and Ellora Caves (34 caves representing Buddhist, Hindu, and Jain traditions, also a UNESCO World Heritage Site inscribed in 1983) are among India's most visited monuments. Aurangabad (now officially Chhatrapati Sambhajinagar) serves as the gateway city. While the Archaeological Survey of India (ASI) — a Central Government body — maintains the physical monuments, MTDC manages associated tourism infrastructure: approach roads, visitor facilities, parking, restaurants, and promotional activities. RTI can reveal: visitor statistics, entry ticket revenue collected at MTDC-managed facilities, infrastructure funds allocated and spent, pending works with reasons for delays, and vendor licensing near the cave complexes.

Hill Station Development — Lonavala, Mahabaleshwar, Matheran: Lonavala (Pune district, approximately 83 km from Pune and 96 km from Mumbai) is one of Maharashtra's most popular hill stations and weekend getaways, known for its scenic valleys, chikki, and proximity to the twin towns of Lonavala and Khandala. Mahabaleshwar (Satara district) is the largest hill station in the Western Ghats, known for strawberries and sweeping plateau views. Matheran (Raigad district), a unique hill station with no motor vehicles of any kind permitted within its limits, is accessible only by toy train or on foot, preserving an atmosphere of rare tranquillity. RTI can reveal funds allocated to hill station development under state tourism schemes, project-wise expenditure on infrastructure (parking, sanitation, approach roads, tourist signage), and the status of pending projects with reasons for delays.

Coastal Tourism — Konkan Coast, Alibag, Ganpatipule, Tarkarli: Maharashtra's Konkan coast — stretching from Dahanu in the north to Vengurla in the south — is home to some of India's most scenic and culturally rich beaches. MTDC operates beach resorts at Ganpatipule, Tarkarli (Sindhudurg district, at the confluence of the Karli River and the Arabian Sea), and other locations. RTI can reveal licences and permits issued to beach shacks, water sports operators, and boat tour operators; revenue collected from coastal tourism permits; safety inspection records; and action taken against unlicensed operators. The Alibag and Murud-Janjira coastal belt (Raigad district), popular as a weekend destination from Mumbai, is another area where RTI on coastal permits has practical application.

Nashik Wine Country and Aurangabad Heritage Tourism: Nashik has emerged as India's leading wine country — Sula Vineyards, York Winery, and several other producers have transformed the Nashik Valley into a recognised wine tourism destination. Aurangabad (Chhatrapati Sambhajinagar) is the heritage tourism hub — gateway to Ajanta-Ellora, and home to Bibi Ka Maqbara (often called the "Taj of the Deccan"), Daulatabad Fort, and Panchakki water mill. MTDC's tourism promotion expenditure for these regions — including costs of wine festival events, heritage walks, and promotional campaigns — is accessible through RTI.

Pandharpur and Religious Tourism: Pandharpur (Solapur district), the seat of Vitthal-Rukmini temple, is one of Maharashtra's most important pilgrimage centres, attracting millions of devotees during the bi-annual Wari procession. RTI can reveal arrangements MTDC or the Tourism Department makes for pilgrim facilities, infrastructure funds, and coordination with local authorities during the Wari.

Tourist Guide Licensing: MTDC and the Tourism Department license tour guides across Maharashtra's major tourist circuits. RTI can reveal the number of licensed guides by city or district, complaints received against guides, action taken against unlicensed operators, and examination and licensing procedures.

How to File RTI

Step 1 — Identify the correct authority. MTDC (a state PSU) holds records on resort contracts, coastal permits, promotional expenditure, and guide licensing. The Archaeological Survey of India (ASI), Aurangabad Circle, holds records on physical monument conservation at Ajanta-Ellora — ASI is a Central Government body and its second appeal goes to the Central Information Commission (CIC), not the MSIC. Determine which body holds the specific records you need before filing.

Step 2 — Draft a specific application. Vague applications invite vague or evasive responses. Name the resort, location, year, and contract type for procurement queries; name the site and financial year for infrastructure fund queries; name the district and licence type for coastal permit queries.

Step 3 — File online or by post. Maharashtra state bodies accept RTI applications through the RTI Online portal at rtionline.gov.in. Alternatively, send a written application by registered post to the CPIO at MTDC headquarters in Mumbai, enclosing a crossed Indian Postal Order (IPO) for ₹10. BPL cardholders may claim fee exemption with a copy of their BPL card.

Step 4 — Track and follow up. Note the acknowledgement number. You must receive a response within 30 days of receipt.

Key RTI Act Provisions

MTDC and the Tourism & Cultural Affairs Department are public authorities under Section 2(h) of the RTI Act, 2005, as bodies established and substantially funded by the Government of Maharashtra.

  • Section 6: Governs RTI filing; no reason need be given for requesting information.
  • Section 7(1): CPIO must respond within 30 days.
  • Section 7(1) proviso: Response within 48 hours if information concerns life or liberty.
  • Section 20: The MSIC can impose a penalty of ₹250 per day (up to ₹25,000 maximum) on a defaulting CPIO and recommend disciplinary action.

First Appeal

If the CPIO does not respond within 30 days, or if the response is incomplete, incorrect, or wrongly refused, file a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) — the officer immediately senior to the CPIO within MTDC (typically the Managing Director or a designated senior officer). The First Appeal must be filed within 30 days of the date of the CPIO's decision or the expiry of the 30-day response period, whichever is applicable. No fee is payable for a First Appeal. Attach copies of your original application, the postal acknowledgement, and the CPIO's response (if any), and clearly state why the response was unsatisfactory.

Second Appeal — Maharashtra State Information Commission (MSIC)

If the First Appellate Authority also fails to respond satisfactorily, file a Second Appeal under Section 19(3) of the RTI Act with the Maharashtra State Information Commission (MSIC) in Mumbai. MSIC is the state-level appellate authority constituted under Section 15 of the RTI Act, 2005, and has jurisdiction over all Maharashtra state public authorities — including MTDC, the Tourism & Cultural Affairs Department, and all associated regional offices.

The Second Appeal must be filed within 90 days of the FAA's decision or the expiry of the FAA's response period. MSIC has full powers to order disclosure, impose penalties under Section 20, and recommend disciplinary action against erring officers.

Important jurisdiction note: Do not file the Second Appeal with the Central Information Commission (CIC). The CIC has jurisdiction only over Central Government public authorities. MTDC is a Maharashtra state body. The only exception is if your RTI was directed to a Central body such as the Archaeological Survey of India (ASI) — in that case, the second appeal correctly goes to the CIC. Always verify which body holds the records before choosing the second appellate authority.
