For communities living near these operations, the consequences of inadequate pollution control are immediate and serious: contaminated rivers, dust-laden air, polluted groundwater, and damaged farmland. Yet the records of the regulatory authority responsible for controlling this pollution — the Jharkhand Pollution Control Board (JPCB) — are rarely visible to affected residents.

The Right to Information Act, 2005 changes this. JPCB is a public authority under Section 2(h) of the RTI Act, constituted by the Government of Jharkhand under the Water (Prevention and Control of Pollution) Act, 1974. Jharkhand Pollution Control Board (JPCB) is the correct authority for all matters relating to industrial pollution regulation within Jharkhand. JPCB is headquartered at Parivesh Bhawan, Dhurwa, Ranchi, and has regional offices in districts with high industrial density.

File your RTI application online through the Jharkhand Government's RTI portal at rti.jharkhand.gov.in, selecting the Jharkhand Pollution Control Board from the department list. Alternatively, submit by post or in person at the JPCB office in Ranchi.

Distinguishing JPCB from Central Bodies

A critical jurisdictional distinction applies here:

  • JPCB is a Jharkhand state body. RTI to JPCB is filed on the Jharkhand RTI portal, and the second appeal goes to the Jharkhand State Information Commission (SIC).
  • CPCB (Central Pollution Control Board) is a Central Government body under the Ministry of Environment, Forest and Climate Change (MoEFCC). RTI to CPCB is filed at rtionline.gov.in, and the second appeal goes to the Central Information Commission (CIC).
  • MoEFCC is also a Central Government body — RTI to MoEFCC for Environmental Impact Assessments, National Board for Wildlife approvals, or national environmental standards goes to the CIC.

For mine or factory pollution affecting your locality in Jharkhand, file with JPCB for state-level consent and inspection records. For national-level Environmental Clearance (EC) granted by MoEFCC, or for comparative national pollution data from CPCB, file those as separate RTI applications with the relevant central authority.

Second Appeal — always Jharkhand SIC for JPCB matters: The Jharkhand State Information Commission (SIC) is the final appellate body for RTI disputes involving Jharkhand state bodies, including JPCB. If JPCB or its First Appellate Authority fails to respond satisfactorily, a Second Appeal under Section 19(3) of the RTI Act goes to the Jharkhand SIC — not the CIC.

How to File: Step by Step

Step 1: Gather Your Details

Before drafting your RTI, collect as much identifying information as possible:

  • Name and full address of the factory, mine, or industrial unit you are asking about — including the district
  • JPCB consent or application number, if visible on any board or notice displayed at the unit's premises (not mandatory, but useful)
  • Reference number of any complaint you have already filed with JPCB (if applicable)
  • Time period for which you want inspection reports or monitoring data
  • Location of the nearest JPCB monitoring station, if known

Step 2: Draft Specific, Targeted Questions

Your RTI should identify the unit clearly and ask for specific categories of documents — consent orders, inspection reports, show cause notices, penalty orders, monitoring data. Avoid vague or omnibus requests like "all information about pollution." The sample draft in this guide covers the most commonly needed categories — adapt it to your specific situation.

Step 3: File on the Jharkhand RTI Portal

  1. Visit rti.jharkhand.gov.in and register or log in
  2. Select Jharkhand Pollution Control Board (JPCB) from the list of public authorities
  3. Fill in the application form and paste or type your RTI request
  4. Attach supporting documents if helpful — photographs, earlier complaint receipts, or public notices related to the unit

Step 4: Pay the Application Fee

Pay ₹10 online via the portal. If filing by post, include an Indian Postal Order (IPO) for ₹10 drawn in favour of the State Public Information Officer, JPCB, Ranchi. BPL cardholders are fully exempt — attach a self-attested copy of your BPL ration card.

Step 5: Track and Use the Appeal Process

Note your registration number and track status on the portal.

  • First Appeal (Section 19(1)): If JPCB does not respond within 30 days, or the response is incomplete or unsatisfactory, file a First Appeal with the First Appellate Authority (FAA) at JPCB within 30 days of the date of the decision or the expiry of the 30-day response period, whichever is applicable.
  • Second Appeal (Section 19(3)): If the First Appeal is also unsatisfactory or unanswered, file a Second Appeal with the Jharkhand State Information Commission (SIC) within 90 days of the FAA's decision or the date by which it should have been made. The SIC has the authority to order disclosure, impose a penalty of up to ₹25,000 on the erring SPIO under Section 20, and recommend disciplinary action.

What Specific Information Can You Ask For?

Consent to Establish (CTE) and Consent to Operate (CTO) are the two primary environmental regulatory permissions issued by JPCB to industries under the Water Act and Air Act. You can request:

  1. Whether the unit at address currently holds a valid CTE and CTO — and if yes, the consent number, date of issue, validity period, and all conditions attached to the consent
  2. Whether JPCB has ever refused, revoked, or refused to renew the consent for this unit — and if so, the reasons stated
  3. Whether the unit has applied for an amendment to its consent for expansion of capacity or change in process — and the status of that application

For mines — coal, iron ore, quarrying, or other — JPCB maintains inspection records covering dust suppression, water body protection, effluent from ore washing, and overburden management. Ask for:

  1. Copies of all JPCB inspection reports for the mine/quarry at address for the last three years — including the date, inspecting officer, and findings on each visit
  2. Whether the mine at address has been found to be in violation of the conditions of its consent or environmental permissions — and copies of any directions or orders issued as a result
  3. Whether JPCB has issued any notice to the mine for violation of the Environment (Protection) Act, 1986, the Water Act, 1974, or the Air Act, 1981 in the last three years
  4. Whether JPCB has filed any prosecution or complaint in court against the mine operator under environmental laws — and the current status of any such proceedings

Pollution Violation Notices and Enforcement Records

Enforcement records reveal whether JPCB is actually holding polluters to account. You can ask:

  1. Copies of all Show Cause Notices issued to the unit/mine at address under Section 31A of the Air Act or Section 33A of the Water Act in the last three years
  2. Copies of any closure orders, consent revocation orders, or direction orders issued to the unit — and current enforcement status (i.e., whether the unit was actually closed or directions were complied with)
  3. Details of penalties imposed on the unit/mine under the Environment (Protection) Act, 1986 — penalty amount, date of imposition, and whether it has been realised
  4. Whether any cases filed against the unit/mine by JPCB are pending before any court or tribunal — and the case reference numbers

Air and Water Quality Monitoring Data

JPCB monitors ambient air quality and surface/groundwater quality at industrial and mining zones across Jharkhand. This data is essential for affected communities and for legal proceedings. You can ask:

  4. Whether the effluent treatment plant (ETP) or air pollution control equipment installed at the unit at address has been inspected by JPCB — and whether it was found to be operational and effective during the most recent inspection

NOC for Mine or Factory Expansion

When a mine seeks to expand its area or a factory applies for capacity expansion, JPCB's role in granting or refusing NOC and recommending environmental clearance is critical. Ask:
