  6. Shamlat Deh / village common land details: The area of village common land in your mauza, whether any encroachment has been recorded, and whether any illegal mutation of Shamlat land to a private party has taken place

Where to File: The Right Authority

The Revenue Department in Himachal Pradesh operates through a three-tier hierarchy for land record matters:

Patwari (at the village / Patwar Circle level): The Patwari is the ground-level revenue official who maintains the physical Jamabandi, Khasra Girdawari, and field registers. Mutation applications are first verified by the Patwari. However, the Patwari's office typically is not separately designated as a public authority under the RTI Act — RTI is filed one level up.

Tehsildar's Office (at the tehsil level): This is the most appropriate and effective first point of RTI filing for land record disputes. The Tehsildar sanctions mutations, hears Tarmeem (rectification) applications, and maintains the tehsil-level revenue records. The PIO at the Tehsildar's office can provide: Jamabandi certified copies, mutation histories, status of pending mutations, and Shamlat Deh records for the tehsil area.

Deputy Commissioner (District Collector): For district-level queries — land classification orders, Section 118 HP Tenancy Act permission records, district-level encroachment data, or if the Tehsildar's PIO is unresponsive — the PIO at the Deputy Commissioner's office is the appropriate authority.

Revenue Department, HP Secretariat, Shimla: For policy-level queries, Himbhoomi system-wide issues, or matters involving multiple districts, the PIO at the Revenue Department headquarter (HP Secretariat, Shimla – 171002) can be approached.

File using the Himachal Pradesh RTI online portal at himachalservices.nic.in/himRTI and select the relevant department (Tehsildar's office for your tehsil, or Deputy Commissioner for your district). Alternatively, a postal application may be sent directly to the PIO of the relevant office, along with an Indian Postal Order of ₹10 in favour of the Accounts Officer / Pay and Accounts Officer of that office.

The second appeal body for all Himachal Pradesh state government bodies — including the entire Revenue Department hierarchy — is the Himachal Pradesh State Information Commission (HP SIC), Shimla. Second appeals are NOT filed with the Central Information Commission (CIC).

How to File: Step by Step

  1. Identify the right PIO: For most land record disputes — Jamabandi, mutation, Himbhoomi data — file with the PIO of the Tehsildar's office covering your village. For district-level matters, file with the PIO of the Deputy Commissioner's office. Note the full name and address of the office you are addressing.
  2. Draft your RTI application: State your land particulars clearly at the top — Khasra number, Khewat/Khatauni number, village (mauza), Patwar Circle, tehsil, and district. Then state each piece of information you want as a numbered point, using specific and factual language. Use the sample draft above as a starting point and adapt it to your situation. Avoid vague or emotional language — frame each request as a factual information query.
  3. Pay the fee: Pay ₹10 via the HP RTI portal's online payment option (if filing online), or attach an Indian Postal Order (IPO) of ₹10 drawn in favour of the Accounts Officer of the relevant office (if filing by post). BPL cardholders are exempt — attach a copy of the BPL card. Do not send cash by post.
  4. File and keep records: If filing online through the HP RTI portal, note your registration number and keep a copy of the submission confirmation. If filing by post, send by registered post and retain the postal receipt. The 30-day response clock begins from the date of receipt of the application by the PIO.
  5. Follow up with appeals if needed: If the PIO does not respond within 30 days, or if the response is incomplete or unsatisfactory, file a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) — the officer senior to the PIO in the same office (typically the Additional Deputy Commissioner or Sub-Divisional Magistrate). The First Appeal must be filed within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. If the FAA fails to respond within 30 days or the response remains unsatisfactory, file a Second Appeal with the Himachal Pradesh State Information Commission (HP SIC) under Section 19(3) within 90 days of the FAA's decision or the expiry of the FAA's response deadline.

Jamabandi and Record of Rights

  1. Certified copy of the current Jamabandi entry for Khasra No. XXX, Village Name, Tehsil Name — owner name(s), rights type, co-sharer shares, area, land classification, and any encumbrances or litigation noted
  2. Whether the above Khasra is recorded as agricultural, non-agricultural (converted), Shamlat Deh (village common land), forest, or government land — and the basis of that classification
  3. Whether Khasra No. XXX has any recorded mortgage (Rehan), conditional sale, or lien against it — and the details of each such entry in the Jamabandi

Mutation (Intkal) History and Pending Applications

  1. The complete mutation (Intkal) history for Khasra No. XXX for the last 10 years — each mutation number, date, transferor and transferee names, basis of mutation (sale deed registered at Sub-Registrar's office / inheritance / partition / court decree), and the officer who sanctioned it
  2. Status of mutation application No. XXX (or any pending mutation for Khasra No. XXX filed by Name) — current stage, reason for delay if any, and the officer holding the file
  3. A copy of the Patwari's field verification report (if any) submitted in relation to mutation application No. XXX

Himbhoomi Digital Records and Rectification

  1. Whether the Himbhoomi portal (himbhoomi.nic.in) entry for Khasra No. XXX, Village Name, Tehsil Name matches the physical Patwari register Jamabandi — if a discrepancy exists, details of the discrepancy and what corrective action has been or will be taken
  2. Status of Tarmeem (rectification) application No. XXX filed for correcting the Jamabandi entry of Khasra No. XXX — current stage and reason for any delay

Shamlat Deh and Common Land

  1. The total area of Shamlat Deh (village common land) recorded in Village Name as per the current Jamabandi — and whether any encroachment has been officially reported or recorded against any portion of the Shamlat
  2. Whether any portion of Shamlat Deh land in Village Name has been mutated in favour of a private individual in the last 10 years — if yes, the mutation number, date, and the authority that sanctioned the mutation

Appeals

First Appeal (Section 19(1)): File with the FAA of the Tehsildar's office or Deputy Commissioner's office within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. No fee is payable for a First Appeal.

Second Appeal (Section 19(3)): File with the Himachal Pradesh State Information Commission (HP SIC), Shimla within 90 days of the FAA's decision or the expiry of the FAA's response deadline. No fee is payable. The HP Revenue Department — including Tehsildar offices, Deputy Commissioner offices, and the Patwari administration — are Himachal Pradesh state government bodies; second appeal is HP SIC, not the Central Information Commission.

If the PIO provides an unsatisfactory response — for example, citing Section 8 exemptions for purely revenue/land records that are ordinarily public documents — note that Jamabandi records, mutation histories, and Tarmeem orders are standard revenue records routinely provided to landowners and are not exempt from disclosure. A First Appeal citing the absence of any valid Section 8 exemption is likely to succeed.
