How to File RTI

Step 1: Identify the correct public authority. For HPTDC hotel and contract data, file with the CPIO at HPTDC headquarters, Shimla. Step 3: File online or by post. HP Tourism Department and HPTDC accept RTI applications through the RTI Online portal at rtionline.gov.in. You may also file by registered post to the CPIO at HPTDC headquarters, Shimla, enclosing a crossed Indian Postal Order (IPO) for ₹10. BPL cardholders may claim fee exemption with a self-attested copy of their BPL card.

Step 4: Track your application. Note the acknowledgement number and track via the RTI Online portal. The CPIO must respond within 30 days of receipt.

Key RTI Act Provisions

  • Section 2(h): HPTDC and the HP Tourism Department are public authorities legally required to designate PIOs and respond to RTI applications.
  • Section 6: File your RTI application; no reason need be given for seeking information.
  • Section 7(1): CPIO must respond within 30 days of receipt. Response time is 48 hours if the matter concerns the life or liberty of a person (Section 7(1) proviso).
  • Section 20: The State Information Commission can impose a penalty of ₹250 per day (up to ₹25,000) on a defaulting PIO for unjustified delay or refusal.

First Appeal

If the CPIO of HPTDC or the HP Tourism Department does not respond within 30 days, or the response is incomplete or improperly refused, file a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) — the Managing Director of HPTDC or the senior-most designated officer in the same department. The First Appeal must be filed within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. No fee is payable. Attach your original RTI application, proof of delivery, and the CPIO's response (if any).

Second Appeal — Himachal Pradesh State Information Commission (HPSIC)

If the First Appellate Authority does not respond satisfactorily, file a Second Appeal under Section 19(3) of the RTI Act with the Himachal Pradesh State Information Commission (HPSIC) in Shimla within 90 days of the FAA's decision or expiry of the FAA's response period.

The HPSIC is the independent statutory authority constituted under Section 15 of the RTI Act for Himachal Pradesh, with jurisdiction over all HP state public authorities — including HPTDC, the HP Tourism & Civil Aviation Department, District Administration offices, and all other HP state bodies involved in tourism governance.

Do not file the Second Appeal with the Central Information Commission (CIC). The CIC handles Central Government bodies only. HPTDC and the HP Tourism Department are state bodies and fall exclusively under the jurisdiction of the HPSIC. Filing with the CIC will result in rejection or transfer, causing avoidable delay.
