The state has built a reputation for flagship health programmes — most notably the Mukhyamantri Amrutum Vatsalya Yojana (popularly called "MA Vatsalya") and the National Health Mission's Ayushman Bharat PM-JAY integration — alongside critical support infrastructure such as the Gujarat Medical Services Corporation Limited (GMSCL) for centralised drug procurement and the 108 Emergency Medical Service (EMS), operated by GVK EMRI, for ambulance response.

How to File RTI

Step 1 — Identify the correct CPIO. For state-level consolidated data, policy records, or GMSCL procurement: file with the State PIO, Directorate of Health, Gandhinagar. For district hospital, PHC/CHC, or CDHO office records: file with the Chief District Health Officer (CDHO) of the relevant district — the CDHO is the nodal administrative authority for all public health facilities in that district.

Step 2 — Draft a specific application. Name the hospital, district, scheme (MA Vatsalya or PMJAY), claim ID or card number if available, time period, and the precise documents sought. Vague questions produce evasive responses; specific questions citing scheme names and reference numbers produce actionable records.

Step 3 — File online. Visit rtionline.gov.in, select the Gujarat Health Department or CDHO office from the public authority list, fill the application, and pay ₹10 online. BPL cardholders may attach a self-attested BPL card copy and claim fee exemption.

Step 4 — Offline filing. Send by registered post to the relevant CPIO with a crossed Indian Postal Order for ₹10. Retain the postal receipt and a copy of the application.

Key RTI Act Provisions

The Gujarat Health Department and all its subordinate offices — CDHOs, civil hospitals, CHCs, PHCs, and GMSCL — are public authorities under Section 2(h) of the RTI Act, 2005.

  • Section 6: Governs submission of RTI applications.

First Appeal

If the CPIO does not respond within 30 days, or the response is incomplete or unsatisfactory, file a First Appeal under Section 19(1) of the RTI Act within 30 days of the date of the decision or expiry of the 30-day response period, whichever is applicable. The First Appellate Authority is typically the Additional Director or Joint Director, Health, in the same office. No fee is payable for a First Appeal.

Second Appeal

If the First Appeal also fails, file a Second Appeal under Section 19(3) of the RTI Act with the Gujarat Information Commission (GIC), Gandhinagar — the apex RTI appellate body for all Gujarat state public authorities. The GIC is constituted under Section 15 of the RTI Act by the Governor of Gujarat. The second appeal must be filed within 90 days of the FAA's decision or the expiry of the FAA's response period.

Do not file with the Central Information Commission (CIC). The CIC has jurisdiction only over central government bodies. Gujarat state health bodies — the Directorate of Health, all CDHOs, civil hospitals, GMSCL, and the MA Vatsalya implementation agencies — are all state public authorities. Their second appeals go exclusively to the GIC.
