How to File Your RTI Application
Step 1: Identify the Specific Information You Need

Step 3: File Online via rtionline.gujarat.gov.in
Gujarat operates a dedicated RTI online portal at rtionline.gujarat.gov.in. This is the recommended filing method. The steps are:
- Visit the portal and register with your email address and mobile number.
- Select "Gujarat Secondary and Higher Secondary Education Board (GSEB)" as the public authority under the Education Department.
- Enter your application text in the provided form, stating that you are filing under Section 6 of the RTI Act, 2005.
- Pay the ₹10 application fee online through the portal's payment gateway.

Step 4: Track the Response

Step 5: First Appeal (Section 19(1))
If GSEB does not respond within 30 days, or the response is incomplete, evasive, or amounts to an unjustified refusal, file a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) designated within GSEB. The First Appeal must be filed within 30 days of the date of the SPIO's decision or the expiry of the 30-day response period, whichever is applicable. No fee is payable. Step 6: Second Appeal (Section 19(3))
If the FAA also fails to respond satisfactorily, file a Second Appeal under Section 19(3) of the RTI Act with the Gujarat Information Commission (GIC) within 90 days of the FAA's decision or the expiry of the FAA's response period. The GIC is Gujarat's state information commission, constituted under Section 15 of the RTI Act. It can direct GSEB to provide the information, impose a penalty of ₹250 per day (up to ₹25,000) on the SPIO personally under Section 20 of the RTI Act, and recommend departmental action against the defaulting officer.

GSEB is a State Authority: Appeals Go to the GIC, Not the CIC
This is a critical point that students and parents frequently misunderstand. GSEB is a state public authority under Section 2(h) of the RTI Act, established under Gujarat law and functioning under the Education Department, Government of Gujarat. Under Section 15 of the RTI Act, the state information commission — the Gujarat Information Commission (GIC) — is the prescribed second appeal body for all Gujarat state public authorities. The Central Information Commission (CIC), constituted under Section 12 of the RTI Act, has jurisdiction only over Central Government bodies. Practical Tips for Filing GSEB RTI Applications
- File within the academic year where possible: While there is no legal deadline for filing an RTI about examination records, GSEB is more likely to have older records readily accessible if you file in the same or following academic year. For older examinations (more than three to five years ago), add a specific request asking GSEB to confirm whether the records are still held or have been weeded out under any retention policy.
- Cite the Aditya Bandopadhyay judgment: When requesting a copy of your evaluated answer script, explicitly cite CBSE v. Aditya Bandopadhyay (2011) 8 SCC 497 in your application. This signals to the SPIO that the disclosure is legally settled and discourages a blanket refusal.
- Specify every subject separately: If you want answer scripts for three subjects, list each one as a separate numbered request. Do not use phrases like "all subjects" — GSEB may interpret this ambiguously and provide incomplete information.
- Keep copies of everything: Retain copies of your original application, the fee receipt or IPO, the postal acknowledgement, GSEB's response, and all appeal documents. The GIC will need these if the matter escalates to a Second Appeal.
