How to File RTI with ESIC (Employees' State Insurance Corporation) — ESI Card, Medical Claims, Cash Benefits
File an RTI with ESIC to resolve ESI card delays, medical claim rejections, cash benefit disputes, and contribution mismatches. Includes a ready-to-use sample RTI draft.
The Employees' State Insurance Corporation (ESIC) is a statutory body established under the Employees' State Insurance Act, 1948, to administer the ESI scheme — India's integrated social security programme covering medical care, sickness benefit, maternity benefit, disablement benefit, and dependent's benefit for workers in the organised sector.
As a body constituted under a central statute and funded substantially by employer and employee contributions, ESIC is a public authority within the meaning of Section 2(h) of the Right to Information Act, 2005. This means every insured person, employer, or member of the public has the right to seek information from any ESIC office — from branch offices to the headquarters — under the RTI Act, and ESIC is legally bound to respond within 30 days.
In practice, ESI card delays, medical reimbursement claim rejections, cash benefit disputes, and discrepancies between employer contribution deposits and insured person records are among the most common grievances that remain unresolved through informal complaints. An RTI application changes the dynamic: it creates an official, time-bound record that the CPIO must address, and non-compliance exposes the officer to penalties under the RTI Act.
What Can You Achieve with an RTI to ESIC?
- Find out the exact status of your ESI card (Pehchan card) — whether it has been generated, dispatched, or is stuck in processing
- Obtain the specific reason for rejection of your medical reimbursement claim, along with a copy of the rejection order
- Learn the current processing status of your cash benefit claim — whether for sickness, maternity, temporary disablement, or permanent disablement
- Confirm the amount and date of any cash benefit payment already processed and identify why a payment has not been credited
- Verify the total ESI contributions deposited by your employer against your IP Number for any given period
- Expose a contribution mismatch — where your employer has deducted ESI contributions from your salary but not deposited them with ESIC
- Know what action, if any, ESIC has taken against a defaulting employer
- Obtain copies of any notices, orders, or correspondence relating to your case
Where to File: The Right Authority
ESIC operates through a three-tier administrative structure: Branch Offices at the local level, Regional Offices covering groups of districts or states, and a Headquarters in New Delhi. For most individual grievances — ESI card, medical claims, cash benefits, and contribution records — the correct authority to approach is the Branch Office that has jurisdiction over your employer's establishment.
If the Branch Office cannot provide the information (for instance, if the matter was handled at the Regional Office level), you can file with the Regional Office.
How to identify the right office: Contact your employer's HR department for the name of the ESIC Branch Office. Alternatively, log in to the ESIC IP Portal at esic.gov.in — your branch office details appear in your profile or contribution history.
File online at rtionline.gov.in — no need to visit the office in person. When selecting the authority, navigate to: Ministry of Labour and Employment → Employees' State Insurance Corporation (ESIC) → Your Branch Office or Regional Office.
How to File: Step by Step
Step 1: Gather Your Details
Before drafting your RTI, collect the following information:
- Your Insurance Number (IP Number) — the 17-digit number on your ESI card or employer records
- Your employer's name and ESI establishment code number
- The name of the ESIC Branch Office having jurisdiction over your employer
- The claim reference number for any pending medical reimbursement or cash benefit claim
- The date you submitted your claim and any acknowledgement you received
Step 2: Draft Your Application
Be specific. "Why has my claim been rejected?" is less effective than "Provide the specific ground for rejection of my medical reimbursement claim reference XXX, along with a certified copy of the rejection order." The sample draft in this guide covers the four most common categories — ESI card status, medical claims, cash benefits, and contribution mismatch — and is ready to use with your details filled in.
Step 3: File on RTI Online Portal
- Visit rtionline.gov.in and register or log in
- Click Submit Request
- Select: Ministry of Labour and Employment → ESIC → Your Branch Office / Regional Office
- Paste your application text (limit: 3,000 characters; trim to the questions most relevant to your situation if needed)
- Optionally attach supporting documents — a copy of your ESI card, claim acknowledgement, or ESIC portal screenshot
Step 4: Pay and Receive Acknowledgement
Pay ₹10 online via net banking, debit/credit card, or UPI on the portal. BPL cardholders are exempt — attach a self-attested copy of your BPL card and select the BPL exemption option. After successful submission, you will receive a registration number (format: ESICG/XXXXX/2026). Keep this number for tracking.
If there is no response within 30 days, or the response is unsatisfactory, you may file a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) at ESIC within 30 days of the date of the decision or the expiry of the 30-day response period, whichever is applicable. If the FAA also fails to respond or the response remains unsatisfactory, you may escalate to the Central Information Commission (CIC) under Section 19(3) within 90 days of the FAA's decision or the date on which the decision should have been made.
