The Delhi State Legal Services Authority (DSLSA) is a statutory body established under Section 6 of the Legal Services Authorities Act, 1987. It functions under the patronage of the Chief Justice of the Delhi High Court and the administrative framework of the Government of NCT of Delhi, with its principal office at Tis Hazari Courts, Central District, Delhi. DSLSA's mandate is to ensure that no citizen is denied access to justice because of economic or social disadvantage — it provides free legal aid, organises Lok Adalats (People's Courts), runs mediation centres, and conducts legal aid camps across Delhi's districts and underserved communities.

Below DSLSA in the hierarchy are the District Legal Services Authorities (DLSAs), one for each of Delhi's districts — covering Saket, Dwarka, Rohini, Tis Hazari, Karkardooma (Shahdara), and others. Each DLSA has its own Secretary (typically a judicial officer) and its own panel of empanelled advocates who represent legal aid beneficiaries before the district courts in that district. DSLSA coordinates policy and state-level Lok Adalats, while DLSAs handle individual legal aid applications, day-to-day panel advocate assignments, and local Lok Adalats.

Both DSLSA and each DLSA are public authorities under Section 2(h) of the RTI Act, 2005. Citizens can use the Right to Information Act to obtain documented answers about legal aid application status, panel advocate assignment, Lok Adalat award records, legal aid camp activities, mediation centre case progress, and the eligibility criteria currently in force — information that is often difficult to obtain through informal enquiry at the legal services office.

What DSLSA and DLSA Records Are Available via RTI?

The RTI Act, 2005, entitles citizens to inspect and obtain copies of records held by public authorities. For DSLSA and DLSAs, the following categories of records are routinely obtainable via RTI:

DSLSA and each DLSA maintain registers and files for all legal aid applications received. RTI can surface:

  • The current status of your legal aid application — whether approved, pending, returned for documents, or rejected — and the date on which the current status was recorded
  • If rejected, the specific ground for rejection: income limit non-compliance, ineligible category, matter excluded from legal aid scheme coverage, applicant already represented by a private advocate, incomplete documentation, or any other stated reason
  • The name and designation of the officer who processed and decided your application
  • Whether a revised or fresh application was submitted after a rejection, and its status
  • The total number of legal aid applications received and disposed of by the DLSA during a specified period, and the category-wise break-up (SC/ST, women, below poverty line, persons in custody, etc.)

Empanelled Advocate Assignment Records

Once a legal aid application is approved, the DLSA assigns a panel advocate from its list of empanelled lawyers. RTI can establish:

  • The full name, bar enrolment number, and designation of the panel advocate assigned to a specific legal aid beneficiary for a specific case
  • Whether any change-of-advocate request was submitted by the beneficiary, and if so, the date, the reason, and the current status of the request
  • The total number of cases currently assigned to a specific panel advocate (to assess workload)
  • Whether any disciplinary complaint was filed against the panel advocate and the action taken
  • The criteria applied by the DLSA for empanelling advocates — minimum years of practice, area of law, bar association membership, and any periodic re-empanelment process

Lok Adalat Award Records

Lok Adalats conducted under Chapter VI of the Legal Services Authorities Act, 1987, pass awards that are deemed decrees of civil courts under Section 21 of the Act. RTI can provide:

  • Confirmation of whether a specific case was taken up at a Lok Adalat on a specific date, and whether an award was passed or the matter was returned unresolved
  • The Lok Adalat award reference number and the terms of the settlement — amount paid or agreed, nature of relief, any instalments or timelines built into the award
  • Details of National Lok Adalats organised by DSLSA — number of cases settled, total settlement amount, categories of cases (motor accident claims, cheque bounce, matrimonial, labour, utility service disputes), and the bench composition
  • Any pending review or clarification sought after a Lok Adalat award, and the authority's response

DSLSA and DLSAs regularly organise legal aid camps at jails, hospitals, labour colonies, slum clusters, and temporary rehabilitation sites to reach persons who cannot visit the legal services office in person. RTI can establish:

  • The dates, locations, and organising DLSA for each legal aid camp held during a specified period
  • The number of persons who received legal counselling at each camp
  • The number of fresh legal aid applications registered at camp, and the number subsequently approved
  • Whether any follow-up visits were conducted after a specific camp, and the outcome
  • Whether legal aid camp records for a specific jail, hospital, or area are available and accessible under the RTI Act

Mediation Centre Case Status

DSLSA and DLSAs operate mediation centres where civil, matrimonial, commercial, and motor accident disputes are referred by courts for mediated settlement. RTI can surface:

  • Whether a specific case was referred to and registered at the mediation centre
  • The number of mediation sessions held in a specific matter, the dates of each session, and the names of the mediators assigned
  • Whether a settlement agreement was reached and recorded — the date of the agreement and a summary of its terms
  • If mediation failed, the date of closure and the reason reported to the referring court
  • The overall performance data of the mediation centre — cases received, settled, and pending during a specified year

The Legal Services Authorities Act, 1987, prescribes the categories of persons entitled to free legal aid. Under Section 12 of the Act, the following persons are entitled regardless of income ceiling:

  • Women and children
  • Members of Scheduled Castes (SC) and Scheduled Tribes (ST)
  • Persons in custody — in jail, observation home, or under institutional detention
  • Victims of mass disaster, ethnic violence, caste atrocity, flood, drought, earthquake, or industrial disaster
  • Persons with disabilities as defined under the Persons with Disabilities Act
  • Victims of trafficking in persons
  • Industrial workmen in matters relating to their employment

In addition, persons whose annual income does not exceed the prescribed ceiling (periodically revised by DSLSA) are entitled to legal aid. RTI can establish the current income ceiling in force and whether the DLSA applied the correct ceiling when assessing your application.

How to File RTI with DSLSA or DLSA

Step 1: Identify the Correct Public Authority

If your legal aid application was filed with a specific DLSA (for example, DLSA Saket or DLSA Rohini), address your RTI to the SPIO of that DLSA. If your matter relates to DSLSA's own policy, a state-level Lok Adalat, or the DSLSA mediation centre, address it to the SPIO, DSLSA, Tis Hazari Courts, Delhi – 110054. Do not mix queries about different DLSAs in a single application.

Step 2: Draft Specific Questions

Frame each query as a numbered, specific information request. Provide your legal aid application number, related case number, names of parties, and dates wherever relevant. Vague requests — such as "provide all records related to my legal aid" — are slower to process and more likely to be deflected. A precise question citing the application number, the date, and the exact record sought gets a more complete response.

Step 3: File Online at rti.delhi.gov.in

DSLSA and all DLSAs are Delhi State bodies. File your RTI application through the Delhi government RTI portal at rti.delhi.gov.in. Do not file on rtionline.gov.in — that portal is for Central Government bodies only and will not reach DSLSA or any DLSA. On the Delhi portal, select the correct public authority — "Delhi State Legal Services Authority" for DSLSA, or the DLSA of the relevant district for district-level queries. Pay ₹10 online. BPL cardholders are exempt; attach a scanned copy of your BPL card. Alternatively, submit a physical application by registered post to the SPIO address or in person at the DSLSA office at Tis Hazari Courts.

Step 4: Track and Follow Up

The SPIO must respond within 30 days of receipt of your application (Section 7(1), RTI Act, 2005). If the requested information concerns the life or liberty of any person, the deadline is 48 hours. Save your acknowledgement number or postal tracking reference as proof of filing.

DSLSA vs. NALSA: Why the Second Appeal Goes to DIC, Not CIC

This distinction is critical and frequently confused. The National Legal Services Authority (NALSA) is a Central Government body constituted under Section 3 of the Legal Services Authorities Act, 1987, headquartered in New Delhi. For any RTI filed with NALSA, the second appeal lies with the Central Information Commission (CIC).

DSLSA and all DLSAs in Delhi are Delhi State bodies — they operate under the Government of NCT of Delhi framework, and the second RTI appeal lies exclusively with the Delhi Information Commission (DIC), constituted under Section 15 of the RTI Act, 2005. Filing a second appeal with the CIC for a DSLSA or DLSA matter will result in the complaint being returned as not maintainable.

Appeal path for DSLSA / DLSA (Delhi):

  • First Appeal (Section 19(1)): File with the First Appellate Authority (FAA) designated within the DSLSA or the relevant DLSA within 30 days of the date of the decision or the expiry of the 30-day response period, whichever is applicable. No fee is required.
  • Second Appeal (Section 19(3)): File with the Delhi Information Commission (DIC) within 90 days of the FAA's decision or the expiry of the FAA's response period. The DIC can direct DSLSA or the DLSA to furnish the information and can impose a penalty of ₹250 per day (up to ₹25,000) on the SPIO personally under Section 20 of the RTI Act.

Tips for an Effective RTI to DSLSA or DLSA

  • Always include your legal aid application number. DSLSA and DLSAs handle large volumes of applications across multiple districts. An RTI without the application number is likely to receive a generic or incomplete reply.
  • Ask for certified copies of specific documents — the rejection order, the panel advocate assignment letter, or the Lok Adalat award — rather than asking the authority to "explain" a decision. Certified copies carry evidentiary value if you need to file a complaint or approach the Delhi High Court.
  • If you do not have the application number, provide the applicant's full name, address, related case number, and the approximate date of application, and ask the SPIO to confirm whether an application was received under those details and to provide the application number and its status.
  • For Lok Adalat award enforcement, file RTI to get the award reference number and a copy of the award before approaching the civil court for execution. Without the award copy, the execution petition cannot be filed.
  • District-specific matters go to the DLSA, not DSLSA. If your legal aid application was processed at the Saket DLSA, file RTI with the SPIO, DLSA Saket — not with the DSLSA at Tis Hazari. DSLSA handles state-level coordination, policy, and state Lok Adalats; DLSAs handle individual legal aid in their respective districts.
