The Delhi Medical Council (DMC) is the statutory body established under the Delhi Medical Council Act, 1997 to regulate the registration and professional conduct of medical practitioners in the National Capital Territory of Delhi. It functions under the Government of NCT of Delhi and maintains the official register of doctors licensed to practise modern medicine in Delhi. The DMC's core functions include granting and renewing medical registrations, verifying qualifications submitted by applicants, and — critically — receiving and adjudicating complaints against registered practitioners for professional misconduct, unethical practice, or violations of medical standards.

The DMC is a public authority under Section 2(h) of the Right to Information Act, 2005, and is fully bound by the Act's disclosure obligations. Citizens can use RTI to verify a doctor's registration, monitor the progress of a misconduct complaint, obtain copies of inquiry committee proceedings and disciplinary orders, and access registration renewal records. This guide explains what records are obtainable, how to file the application, and how the appeal path works — including the crucial distinction between the DIC and the CIC.

What Records Are Available from Delhi Medical Council via RTI

Doctor Registration Records

The DMC maintains a register of all medical practitioners holding a valid registration in Delhi under the Delhi Medical Council Act, 1997. Under RTI, you can obtain:

  • The current registration status of a named doctor — whether the registration is active, suspended, cancelled, or lapsed due to non-renewal
  • The date of original registration, the medical qualification(s) on the basis of which registration was granted, and the institution from which those qualifications were obtained
  • Whether any endorsement of additional qualification or specialisation has been recorded against the registration number
  • The dates and records of all registrations and re-registrations on file for a specific practitioner

This information is particularly important for patients who wish to verify that a doctor they have consulted — or are about to consult — is legitimately and currently registered. Practising medicine in Delhi without a valid DMC registration is an offence, and RTI is a direct route to confirming registration status independently of what a hospital or clinic may represent.

Misconduct Complaint Status and Proceedings

Patients and their families who have filed misconduct complaints with DMC often face prolonged silence on the progress of those complaints. RTI can surface:

  • Whether a complaint filed by reference number and date has been admitted, referred to an Inquiry Committee, decided, or closed
  • The dates on which each stage of the complaint was reached
  • Whether an Inquiry Committee has been constituted under the Delhi Medical Council Act, 1997 to investigate the complaint, and — if so — the names and designations of committee members, the dates on which hearings were convened, and the date on which the committee submitted its report to the DMC Council
  • Copies of any interim or final order passed by DMC in response to the complaint

It is important to distinguish RTI from the complaint process itself. Filing an RTI does not constitute a misconduct complaint and does not trigger disciplinary proceedings. RTI is an information-access mechanism — it allows you to track an existing complaint, confirm that it is being processed, and obtain copies of proceedings and orders. To seek disciplinary action against a doctor, you must file a formal misconduct complaint directly with DMC.

Disciplinary Order Records

The DMC has statutory authority under the Delhi Medical Council Act, 1997 to impose a range of disciplinary sanctions on registered practitioners found guilty of misconduct — including a formal warning, suspension of registration for a specified period, removal from the DMC register, or conditions imposed on the right to practise. RTI can provide:

  • Copies of all disciplinary orders passed against a specific doctor, identified by name or registration number
  • The date of each order, the section of the Delhi Medical Council Act, 1997 under which it was passed, and the nature of the sanction imposed
  • Whether any order of removal has subsequently been followed by a restoration order, and the conditions (if any) attached to restoration
  • Aggregate statistics on disciplinary action taken by DMC during a specified period — the number of warnings, suspensions, and removals from the register

Registration Renewal Records

Medical practitioners registered with DMC are required to renew their registration periodically under the Delhi Medical Council Act, 1997 and applicable regulations. A lapsed registration means the practitioner is no longer authorised to practise. Via RTI, you can obtain:

  • Whether the registration of a specific doctor has been renewed as required, and the dates and fee receipts of all renewals on record
  • Whether the registration is currently valid or has lapsed due to non-renewal, and — if lapsed — the date on which it lapsed
  • The renewal procedure and schedule in force under the applicable regulations, along with details of any amnesty or regularisation scheme for lapsed registrations

Important Distinction: DMC Covers Delhi-Registered Doctors; NMC Governs Central Government Hospitals

The Delhi Medical Council's jurisdiction covers doctors registered under the Delhi Medical Council Act, 1997 — doctors practising in private hospitals, clinics, and nursing homes in Delhi who hold a Delhi registration. If your complaint or information need relates to a doctor employed in a Central Government hospital — such as AIIMS Delhi, Safdarjung Hospital, RML Hospital, or a Central Government Health Scheme (CGHS) facility — the relevant regulatory body at the national level is the National Medical Commission (NMC), which is a Central Government public authority. RTI applications to NMC are filed through rtionline.gov.in, and the second appeal goes to the Central Information Commission (CIC), not the DIC. Do not send RTI applications about Central Government hospital staff to DMC — they will be returned as not within DMC's jurisdiction.

How to File RTI with the Delhi Medical Council

Step 1: Determine Your Information Need

Identify precisely what you want to know — registration status, complaint progress, a specific disciplinary order, or renewal records. Frame each query as a numbered, specific information request. Avoid broad requests such as "provide all records related to the doctor" — targeted questions get faster and more complete responses.

Step 2: Draft Your Application

Use the sample application provided above. Fill in the doctor's name and DMC registration number (if you have it), your complaint reference number (if applicable), and the specific information points relevant to your situation. If you do not have the DMC registration number, provide the doctor's full name, the hospital or clinic where they practise, and ask DMC to search its register by name.

Step 3: File Online or by Post

The Delhi Medical Council is a Delhi state public authority under the Government of NCT of Delhi. File your RTI application through the Delhi government's RTI portal at rti.delhi.gov.in, which allows online filing and payment of the ₹10 fee. Alternatively, send a physical application by registered post to the SPIO, Delhi Medical Council, F-17/19, Institutional Area, Madan Garhi, New Delhi – 110068. Pay the ₹10 fee by Indian Postal Order, demand draft in favour of "Delhi Medical Council," or via the online portal's payment gateway. BPL cardholders are exempt from the fee; attach a copy of the BPL card with the application.

Step 4: Track Your Application

The SPIO must respond within 30 days of receipt under Section 7(1) of the RTI Act, 2005. If the information sought involves a matter of life or liberty, the deadline is 48 hours. Retain the acknowledgement number or postal tracking reference as proof of filing.

Step 5: Appeal if Necessary

If DMC does not respond within 30 days, or the response is incomplete, evasive, or incorrect:

  • First Appeal under Section 19(1): File with the First Appellate Authority (FAA) designated within the Delhi Medical Council within 30 days of the date of the decision or the expiry of the 30-day response period, whichever is applicable. No fee is payable.
  • Second Appeal under Section 19(3): If the FAA's response is also absent or unsatisfactory, file with the Delhi Information Commission (DIC) — constituted under Section 15 of the RTI Act as Delhi's state information commission — within 90 days of the FAA's decision or the expiry of the FAA's response period. No fee is payable. The DIC can direct DMC to furnish the information and impose a penalty of up to ₹25,000 on the SPIO personally under Section 20 of the RTI Act.

The Appeal Hierarchy: Why DIC, Not CIC

The Delhi Medical Council is a Delhi state public authority under Section 2(h) of the RTI Act, 2005. All appeals arising from DMC RTI applications remain within the Delhi state system:

  • First Appeal: First Appellate Authority (FAA), Delhi Medical Council
  • Second Appeal: Delhi Information Commission (DIC) — constituted under Section 15 of the RTI Act

The Central Information Commission (CIC) has jurisdiction only over central public authorities — bodies established by or under the Constitution or a central enactment, or owned, controlled, or substantially financed by the Central Government. The Delhi Medical Council is constituted under the Delhi Medical Council Act, 1997, a Delhi legislature enactment, and functions under the Government of NCT of Delhi. The CIC therefore has no jurisdiction over DMC. Filing a second appeal with the CIC instead of the DIC will result in the complaint being returned as not maintainable, costing you time.

Note that certain bodies physically located in Delhi are, despite appearances, Central Government public authorities — for example, the Delhi Police (administered by the Ministry of Home Affairs) and the New Delhi Municipal Council (NDMC). RTI applications to Delhi Police and NDMC involve the CIC on second appeal, not the DIC. The Delhi Medical Council, by contrast, is unambiguously a Delhi state body, and the DIC is the correct second-appellate forum.
