How to File RTI with Delhi Labour Department — Minimum Wages, Factory Inspection and Labour Card
Step-by-step guide to file an RTI application with the Delhi Labour Department for minimum wage orders, factory/establishment inspection reports, labour card (e-Shram) status, contractor licence, and workmen compensation. Includes sample RTI draft.
The Delhi Labour Department, functioning under the Government of National Capital Territory of Delhi (GNCTD), is the primary state authority responsible for enforcing labour laws, protecting workers' rights, and administering welfare schemes for organised and unorganised workers in Delhi. Its mandate covers a wide range of labour legislation — from the Minimum Wages Act 1948 and the Factories Act 1948 to the Delhi Shops and Establishments Act 1954 and the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act 1996.
The Labour Department and all its subordinate bodies — including the office of the Chief Inspector of Factories, the Chief Inspector of Shops and Establishments, the Labour Commissioner, and the Delhi Building and Other Construction Workers Welfare Board (DBOCWWB) — are public authorities under Section 2(h) of the RTI Act, 2005. Workers, trade unions, NGOs, and citizens regularly use RTI to obtain minimum wage notifications, factory inspection reports, complaint action-taken reports, and BOCW welfare scheme status. This guide explains exactly how to use RTI with the Delhi Labour Department to assert your rights as a worker.
What Can You Achieve with an RTI to Delhi Labour Department?
Filing RTI with the Delhi Labour Department can help you:
- Obtain the current applicable minimum wage rate notification for a specific category of worker or scheduled employment under the Minimum Wages Act 1948, including the notification number and date
- Get the action taken report on a complaint filed for non-payment of minimum wages, underpayment, or other labour law violations by an employer
- Obtain a certified copy of the factory or establishment inspection report — including violations found, directions issued, and compliance status — for any factory or establishment registered in Delhi
- Verify whether a factory or establishment holds a valid registration or licence under the Factories Act 1948 or the Delhi Shops and Establishments Act 1954, and confirm the registration number and validity period
- Know whether prosecution has been initiated against an employer for violations and the current status of such proceedings
- Get information about your BOCW (Building and Other Construction Workers) welfare board registration status and eligibility for pending scheme benefits such as maternity benefit, pension, accident compensation, and education assistance
- Obtain the list of licensed contractors operating under the Contract Labour (Regulation and Abolition) Act 1970 for a specific principal employer or project
- Access details of workmen compensation cases filed with the Commissioner for Workmen's Compensation
- Understand the procedure and jurisdictional authority for filing complaints under the Minimum Wages Act 1948, Payment of Wages Act 1936, or other labour enactments
Where to File: The Right Authority
Delhi Labour Department vs. Central Ministry of Labour
This is the most critical distinction when filing RTI on labour matters in Delhi.
The Delhi Labour Department (GNCTD) handles:
- Minimum wages for establishments in Delhi (state-scheduled employments)
- Inspections of factories and establishments registered in Delhi under the Factories Act 1948 and Delhi Shops and Establishments Act 1954
- BOCW welfare board registration and benefits
- Contract labour licensing for establishments operating in Delhi
- Payment of wages and bonus complaints for Delhi-based workers
- Workmen's compensation for injuries in Delhi
The Central Ministry of Labour and Employment (a separate Central Government body) handles:
- e-Shram portal and unorganised workers' national database (UAN)
- ESIC (Employees' State Insurance Corporation) — medical, sickness, and maternity benefits for organised sector workers
- EPFO (Employees' Provident Fund Organisation) — provident fund and pension for organised sector
- Central sphere establishments (railways, coal mines, central public sector undertakings)
RTI for ESIC and EPFO goes to rtionline.gov.in, and the second appeal is to the Central Information Commission (CIC). RTI for Delhi Labour Department goes to rti.delhi.gov.in, and the second appeal is to the Delhi Information Commission (DIC), not CIC.
Key Bodies Within the Delhi Labour Department
Labour Commissioner, GNCTD: The apex administrative authority for labour law enforcement in Delhi. RTI on minimum wages policy, general labour enforcement data, and complaint statistics is addressed here.
Chief Inspector of Factories, GNCTD: Oversees registration and inspection of all factories in Delhi under the Factories Act 1948. RTI for factory registration status, inspection reports, and factory licence details is addressed here.
Chief Inspector of Shops and Establishments, GNCTD: Oversees registration of all shops and commercial establishments in Delhi under the Delhi Shops and Establishments Act 1954. RTI for establishment registration, shop licence, and inspection findings is addressed here.
Delhi Building and Other Construction Workers Welfare Board (DBOCWWB): Administers welfare schemes for construction workers in Delhi under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act 1996. RTI for BOCW registration status, scheme benefits, and cess collection is addressed here.
Commissioner for Workmen's Compensation: Handles compensation claims for work-related injuries and deaths under the Employees' Compensation Act 1923. RTI for case status and orders is addressed here.
e-Shram vs. BOCW: A Common Confusion
e-Shram is a Central Government portal operated by the Ministry of Labour and Employment. It creates a national database of unorganised workers and provides a UAN number along with accident insurance coverage under the Pradhan Mantri Suraksha Bima Yojana. RTI for e-Shram goes to the Central Ministry and the second appeal is to CIC.
BOCW registration in Delhi is handled by the DBOCWWB under the Delhi Labour Department. It provides welfare benefits specific to construction workers in Delhi — maternity benefit, education assistance, pension, accident compensation, and more. RTI for BOCW goes to the Delhi Labour Department and the second appeal is to DIC.
Workers in the construction sector in Delhi should ideally be registered under both. They serve different purposes and involve different government bodies entirely.
How to File: Step by Step
Step 1: Identify the Specific Body
Before drafting your application, determine whether your issue falls under the Labour Commissioner, the Chief Inspector of Factories, the Chief Inspector of Shops and Establishments, or the DBOCWWB. For most minimum wages and general labour complaints, the Labour Commissioner's office is the right entry point. For factory-specific inspection reports, address it to the Chief Inspector of Factories.
Step 2: Gather Your Reference Details
Collect all relevant information before drafting:
- Name and address of the employer/factory/establishment
- Your complaint reference number (if you have already filed a complaint)
- Category of employment (unskilled/semi-skilled/skilled, or the specific scheduled employment)
- BOCW registration number (for welfare scheme queries)
- Period of concern (specific financial year or date range for inspection/complaint)
Step 3: Draft a Focused Application
Write your questions with specificity. "What is the current minimum wage for unskilled workers in the scheduled employment of construction" will get a better response than a vague query. Use the sample draft above as your starting template. Limit each application to one subject area — minimum wages or inspections or BOCW — to keep responses organised and reduce the risk of partial refusals.
Step 4: File Online at rti.delhi.gov.in
Go to rti.delhi.gov.in and follow these steps:
- Click on "Submit RTI Application" and register or log in.
- Select "Labour Department, GNCTD" as the public authority. For factory-specific issues, you may also see subordinate offices listed separately — select the relevant one.
- Fill in your personal details (name, address, mobile, email).
- Type or paste your application text in the provided field. Attach supporting documents (complaint receipt, BOCW card, etc.) if relevant.
- Pay the ₹10 fee online via net banking, UPI, or debit/credit card. Note the payment reference number and include it in your application. BPL cardholders are exempt from the fee and must attach a copy of their BPL card.
You can also submit a physical application in person at the Labour Department office, by post, or through a designated Labour Sub-Inspector's office. The online route through rti.delhi.gov.in is recommended for the automatic acknowledgement and tracking.
Step 5: Track, Appeal if Needed
After filing, you will receive an acknowledgement with a unique registration number. Track the status on rti.delhi.gov.in using this number. The SPIO must respond within 30 days under Section 7(1) of the RTI Act, 2005 (48 hours if the matter involves life or liberty).
If there is no response within 30 days, or the response is incomplete or unsatisfactory, file a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) at the Labour Department, GNCTD, within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable.
If the First Appeal also fails to yield a satisfactory response, file a Second Appeal under Section 19(3) with the Delhi Information Commission (DIC), constituted under Section 15 of the RTI Act, within 90 days of the First Appellate Authority's decision or its expiry. The DIC — not the CIC — has jurisdiction over all Delhi state bodies including the Delhi Labour Department, DBOCWWB, Chief Inspector of Factories, and Chief Inspector of Shops.

Using RTI systematically alongside direct complaints to the Labour Department creates a documented paper trail that is difficult to ignore. Workers who combine an RTI application — establishing what the applicable rate is and that a complaint was filed — with a formal wage recovery claim before the authority under the Minimum Wages Act are in a significantly stronger position than those who rely on verbal follow-ups alone. The Delhi Labour Department is obligated by law to respond, and the DIC can impose a penalty of up to ₹25,000 on an officer who fails to do so without reasonable cause under Section 20 of the RTI Act.
