The Delhi Commission for Protection of Child Rights (DCPCR) is a statutory body established under the Commissions for Protection of Child Rights (CPCR) Act, 2005, by the Government of National Capital Territory of Delhi. DCPCR is responsible for examining and reviewing safeguards for the rights and welfare of children in Delhi, inquiring into child rights violations, monitoring the Right to Education Act 2009, inspecting Child Care Institutions (CCIs) and Observation Homes, and taking suo motu action on matters involving child labour, child trafficking, child abuse, and denial of education.

DCPCR is a public authority under Section 2(h) of the RTI Act, 2005. Citizens — parents, advocates, child rights researchers, and civil society organisations — use RTI with DCPCR to track complaint status, obtain copies of inquiry reports and inspection findings, access data on RTE Section 12 admissions, and verify the implementation of welfare schemes for children. This guide explains how to file an effective RTI with DCPCR and what information you can legally request.

What Can You Achieve with an RTI to DCPCR?

DCPCR versus NCPCR — A Critical Distinction

DCPCR is a Delhi State body constituted under the CPCR Act, 2005, by the Government of NCT of Delhi. It handles child rights matters within Delhi and is accountable to the GNCTD. RTI applications to DCPCR must be filed at the Delhi RTI portal (rti.delhi.gov.in), and second appeals go to the Delhi Information Commission (DIC) under Section 19(3) of the RTI Act.

NCPCR (National Commission for Protection of Child Rights) is a Central Government body under the Ministry of Women and Child Development, Government of India. It addresses child rights at the national level and handles matters involving Central Government institutions, inter-state cases, or national-level policy. RTI for NCPCR must be filed at rtionline.gov.in, and second appeals go to the Central Information Commission (CIC) — not DIC.

Rule of thumb: For Delhi-specific child rights issues — a Delhi school denying RTE Section 12 admission, a Delhi CCI, a child labour case in Delhi, or a DCPCR inquiry — file at rti.delhi.gov.in under DCPCR. For national-level policy, inter-state trafficking, or Central Government institutional matters, file with NCPCR at rtionline.gov.in.

DCPCR versus Other Delhi Authorities

  • Directorate of Education, GNCTD: Holds records of the actual EWS/DG lottery draw and seat allocation at private schools. If your complaint is about the lottery process itself, file RTI with the Directorate of Education. If your complaint is about DCPCR's inquiry into a school's RTE non-compliance, file RTI with DCPCR.
  • Child Welfare Committee (CWC): A quasi-judicial body handling cases of children in need of care and protection. CWC is separate from DCPCR. For CWC case status, contact the relevant District CWC under the Department of Women and Child Development, GNCTD.
  • Delhi Police (Delhi Anti-Human Trafficking Unit): For FIR registration, immediate rescue, or police action on child trafficking. Delhi Police is a Central Government body — second appeal for Delhi Police RTI goes to CIC, not DIC.
  • CHILDLINE (1098): A 24-hour emergency helpline for children in distress. Not an RTI-able body, but can be the first point of contact before approaching DCPCR for an inquiry.

How to File: Step by Step

Step 1: Gather Your Reference Details

Before drafting your RTI application, collect:

  • Your complaint reference number at DCPCR (from the acknowledgement slip, email, or SMS received when you filed the complaint), if applicable
  • The date of filing your complaint and the subject matter (child labour, child abuse, RTE admission, POCSO violation, trafficking, etc.)
  • The name of the school or institution involved, if the complaint relates to a specific school or CCI
  • The academic session (e.g., 2024-25) and the district, if the query relates to RTE Section 12 admissions
  • Any previous correspondence from DCPCR — acknowledgements, notices, or letters

If you are seeking aggregate or policy-level data rather than the status of a personal complaint, you do not need a complaint reference number — simply describe the information you need clearly.

Step 2: Draft Your Application

Use the sample RTI draft provided above as a starting point and tailor it to your specific situation:

  • Be precise: Ask for complaint status by reference number and date. Vague questions get vague or partial answers.
  • Request certified copies: If you want a copy of a DCPCR inspection report or recommendation letter, explicitly ask for "a certified copy."
  • One subject per application where possible: If you need both the status of a personal complaint and aggregate child labour data, consider two separate applications to avoid delays caused by partial responses.
  • Avoid seeking personal data about third parties: Do not ask for the names, addresses, or contact details of children or families in cases that are not your own — such information is likely to be withheld under Section 8(1)(j) of the RTI Act as personal information unrelated to public activity.

Step 3: File Online via rti.delhi.gov.in

  1. Visit rti.delhi.gov.in and register or log in.
  2. Select Delhi Commission for Protection of Child Rights (DCPCR) as the public authority.
  3. Fill in the application form, paste your application text, and attach any supporting documents if relevant (e.g., your complaint acknowledgement).
  4. Pay the ₹10 application fee online. BPL cardholders are exempt from the fee — attach a copy of the BPL card.
  5. Submit and save the unique registration number — this is your tracking reference for follow-up and appeals.

You may also submit a physical application by post or in person to the SPIO at the DCPCR office, along with a ₹10 Indian Postal Order (IPO) or demand draft in favour of "Delhi Commission for Protection of Child Rights."

Step 4: Track and Follow Up

Log in to the Delhi RTI portal to monitor the status of your application. DCPCR must respond within 30 days of receipt under Section 7(1) of the RTI Act, 2005. If the matter concerns the life or liberty of a child — for example, a missing child, a child in confinement, or an ongoing trafficking case — the response is required within 48 hours under the proviso to Section 7(1).

Step 5: File Appeals if Needed

  • First Appeal: If DCPCR does not respond within 30 days, or if the response is incomplete or unsatisfactory, file a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) at DCPCR within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. The FAA must decide within 30 days (extendable to 45 days with reasons).
  • Second Appeal: If the FAA's response is absent or unsatisfactory, file a Second Appeal under Section 19(3) with the Delhi Information Commission (DIC), constituted under Section 15 of the RTI Act, within 90 days of the FAA's decision or the expiry of the FAA response period. The DIC can direct disclosure and may impose a penalty on the SPIO under Section 20 for wilful denial or delay.

Important: Do not file a second appeal with the Central Information Commission (CIC). CIC has jurisdiction only over Central Government public authorities. DCPCR is a Delhi State body, and DIC is the correct second appeal authority.

What Specific Information Can You Ask For?

Child Labour and Child Abuse Complaints

  1. Total number of child labour complaints received by DCPCR in FY 2024-25, number disposed of, and number pending — along with outcome categories (rescued, referred to police, matter closed, etc.)
  2. Total number of child abuse complaints (physical, sexual, emotional) taken up by DCPCR in 2024-25, broken down by type and district, and the disposal status of each category
  3. Number of complaints in which DCPCR recommended prosecution under child labour or POCSO laws, and whether the recommendation was acted upon
  4. Action taken on a specific child abuse or neglect complaint bearing reference number XXXXX filed on DD/MM/YYYY

RTE Section 12 Admissions

  1. Total number of children for whom DCPCR monitored or facilitated admissions under Section 12(1)(c) of the Right to Education Act, 2009, across Delhi in academic session 2024-25, district-wise
  2. Number of complaints received by DCPCR against private unaided schools for denial of EWS/DG admissions in 2024-25, and the outcome or recommendation in each case
  3. Whether any school-specific complaint about RTE Section 12 non-compliance bearing reference number XXXXX has been disposed of, and a copy of DCPCR's recommendation or notice issued to the school

Child Care Institution Inspections

  1. The complete list of Child Care Institutions (CCIs), Observation Homes, and Children's Homes in Delhi inspected by DCPCR during 2024-25
  2. A certified copy of the most recent DCPCR inspection report for specific CCI name, including findings of non-compliance and the action taken
  3. Number of CCIs found non-compliant with the Juvenile Justice (Care and Protection of Children) Act, 2015, and the follow-up action taken by DCPCR

Child Trafficking

  1. Number of child trafficking cases or matters taken up suo motu or on complaint by DCPCR in 2024-25, the status of each, and whether the matter was referred to Delhi Police Anti-Human Trafficking Unit
  2. Outcome of DCPCR's inquiry in trafficking matter bearing case reference XXXXX, including any recommendation issued

POCSO Compliance in Schools

  1. List of schools in Delhi inspected by DCPCR for POCSO Act 2012 compliance during 2024-25, with findings and recommendations issued
