Why RTI Matters for Tribal Welfare in Chhattisgarh

Chhattisgarh is home to approximately 31% Scheduled Tribe population — one of the highest proportions among non-north-eastern states in India. With 26 tribal-dominated districts spanning the Bastar, Surguja, Bilaspur, and Durg-Rajnandgaon belts, the state has a large network of tribal welfare schemes administered through the Tribal Welfare Department and District Tribal Development Officers (DTDOs). Despite significant budgetary allocations, many beneficiaries face persistent problems: scholarships approved but never credited, Van Dhan Vikas Kendra payments withheld from tribal producers, Forest Rights Act pattas not distributed despite claims being recognised, and Vanbandhu Kalyan Yojana funds utilised on paper but not on the ground.

RTI (Right to Information Act, 2005) is a powerful tool to cut through this opacity. Under Section 6 of the Act, any citizen can file a written application with the CPIO of a public authority (Section 2(h)) requesting specific documents. The CPIO must respond within 30 days under Section 7(1), or within 48 hours if the information concerns the life or liberty of a person (Section 7(1) proviso).

Tribal Communities and PVTG Status

The major tribal communities in Chhattisgarh include the Gond (dominant across Bastar, Kanker, Narayanpur, Dantewada, Sukma, and Bijapur), Halba, Oraon (Kurukh), Korku, and Bhattra. Five communities are classified as Particularly Vulnerable Tribal Groups (PVTGs): Kamar, Pahari Korva (Hill Korva), Abujhmaria, Baiga, and Birhor. PVTGs receive targeted welfare under sub-missions of the PM PVTG Development Mission, which provides additional rights and entitlements on top of general ST schemes.

Vanbandhu Kalyan Yojana: The Flagship Scheme

Launched in 2014, the Vanbandhu Kalyan Yojana (VKY) is the overarching tribal welfare framework in Chhattisgarh. It converges multiple central and state schemes under one umbrella:

  • Education: Pre-Matric and Post-Matric scholarships, Eklavya Model Residential Schools (EMRS), Ashram schools, hostels for ST students, and the Merit-cum-Means scheme.
  • Health: Tribal health sub-centres, mobile health units, and nutrition programmes in PVTG habitations.
  • Livelihoods: Van Dhan Vikas Kendras (VDVK), MFP procurement at MSP, forest rights regularisation, and MGNREGS convergence.
  • Infrastructure: Tribal area road connectivity, electrification, and drinking water in forest habitations.
  • Cultural rights: Tribal language preservation, Bastar Dussehra and tribal festival support, and tribal museum development.

Van Dhan Vikas Kendras (VDVK)

VDVKs are tribal enterprise clusters promoted under the Van Dhan Scheme by TRIFED. Each VDVK consists of approximately 300 tribal beneficiaries (15 Self-Help Groups of 20 members each) who collectively collect and process minor forest produce such as tendu leaves, mahua, amla, lac, chironji, and bamboo products. The VDVK model is intended to eliminate middlemen and ensure better prices. However, problems of delayed or no payment to tribal members are widespread. RTI can establish the VDVK's registration, procurement records, TRIFED reimbursement received, and outstanding dues to tribal collectors.

Forest Rights Act (FRA) Implementation

Chhattisgarh — particularly the Bastar division — is at the centre of Forest Rights Act (FRA) implementation issues. The FRA (Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006) grants individual and community forest rights to tribals who have traditionally occupied forest land. RTI can extract village-wise data on the number of claims filed, claims recognised, claims rejected (with reasons), pattas distributed, and PVTG habitat rights recognised. Given the significance of FRA land rights to tribal livelihoods, these RTI queries can challenge unlawful evictions and expose non-implementation.

Common Issues Addressed Through RTI

  • Scholarship non-disbursal: Scholarship approved through NIC portal but PFMS FTO not executed or payment rejected.
  • VDVK payment delays: Tribal MFP collectors paid partly or not at all despite TRIFED releasing funds to district-level implementing agencies.
  • FRA patta withheld: FRA individual patta recognised by Sub-Divisional Level Committee (SDLC) but physical document not issued.
  • EMRS seat irregularities: Eklavya Model Residential School admissions made outside merit/reservation criteria.
  • Vanbandhu fund diversion: Infrastructure funds allocated to a village but work not executed or of sub-standard quality.
  • PVTG sub-mission funds: PM PVTG Development Mission funds released centrally but not reaching targeted hamlets.

What Information You Can Obtain

Through RTI, you can request:

  • Beneficiary lists for any scheme at village, panchayat, block, or district level
  • PFMS Fund Transfer Order (FTO) reference numbers and disbursement records
  • Van Dhan Vikas Kendra registration, membership, procurement, and payment records
  • Forest Rights Act claim status (filed, recognised, rejected, patta issued) at village level
  • EMRS admission records, seat allocation, and fee waiver details
  • Fund allocation and utilisation statements for Vanbandhu Kalyan Yojana by component
  • Government Orders, scheme guidelines, and circulars issued by the Tribal Welfare Department
  • Inspection reports for Ashram schools and tribal hostels
  • Gram Sabha consultation records for PESA-compliant areas

How to File Your RTI Application

  1. Identify the right CPIO: For state-level matters, address to the CPIO, Commissioner, Tribal Development Department, Raipur. For district/block-level issues, address to the CPIO, District Tribal Development Officer (DTDO) of the relevant district.
  2. File online at rtionline.gov.in for state government bodies (Chhattisgarh state bodies are accessible through this portal as well). Alternatively, submit by post or in person at the department office.
  3. Pay ₹10 by postal order, demand draft, or online. BPL cardholders are exempt (attach a copy of the BPL card with your application).
  4. Describe the information specifically: Include scheme name, financial year, village/block/district name, beneficiary name or category, and the exact documents or records you need.
  5. Cite the relevant section: Mention Section 6 of the RTI Act, 2005 as the legal basis.

Appeals: First and Second

If the CPIO does not respond within 30 days, or if the response is incomplete or unsatisfactory, you have two levels of appeal:

  • First Appeal (Section 19(1)): File with the First Appellate Authority (FAA) in the same department — usually a senior officer — within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable.
  • Second Appeal (Section 19(3)): If the First Appeal also fails, appeal to the Chhattisgarh State Information Commission (CGSIC) in Raipur. CGSIC is the final appellate authority for all state government bodies in Chhattisgarh. It is NOT the CIC (Central Information Commission), which handles only Central Government bodies.
  • Penalty (Section 20): CGSIC can impose a penalty of ₹250 per day (maximum ₹25,000) on the CPIO for unwarranted delay or refusal.

Practical Tips

  1. Request PFMS records by FTO number: If you know the scholarship was approved, ask for the FTO reference and PFMS transaction ID to trace exactly where payment stopped.
  2. Combine FRA with revenue records: Cross-reference FRA claim status with revenue department pattas to confirm whether rights have been formally recorded in the land register.
  3. Use PESA provisions strategically: For tribal areas in 13 PESA-designated districts, RTI can reveal whether Gram Sabha consent was obtained before scheme implementation — a legal requirement under PESA.
  4. Name the VDVK specifically: When querying VDVK records, mention the VDVK's registered name, location, and commodity handled to get precise responses.
  5. Request EMRS inspection reports: Under EMRS norms, periodic inspections are mandatory; obtaining these through RTI can substantiate complaints about infrastructure or academic standards.
  6. Track fund utilisation with UC: Ask for Utilisation Certificates (UC) submitted by district implementing agencies for central funds — discrepancies between UC amounts and beneficiary records often reveal misappropriation.
  7. File separate applications: If your query covers both state-level policy and district-level implementation, file two separate RTI applications to the relevant CPIOs for faster, more targeted responses.
  8. Attach BPL card for fee waiver: If you are a BPL cardholder, attach a self-attested copy to avoid the ₹10 fee and ensure your application is not rejected on technical grounds.
