Backed by a 2011 Supreme Court ruling that confirmed answer scripts are information under the RTI Act, this guide walks you through exactly how to exercise that right.

BSEB: Matric and Inter Examinations

The Bihar School Examination Board (BSEB) is a statutory body established under the Bihar School Examination Board Act, 1952. It functions under the Education Department of the Government of Bihar and is headquartered at Sinha Library Road, Patna – 800 017.

BSEB conducts two major annual public examinations:

Matric (Secondary Examination — Class 10): The Matric board exam is the end-of-Class 10 assessment for students across Bihar's schools. It is conducted in February–March each year and results are declared typically in April–May. Subjects include Hindi, Mathematics, Science, Social Science, and a compulsory third language.

Intermediate (Higher Secondary / Class 12): The Inter examination covers students in the three streams — Arts, Science, and Commerce — who have completed Class 12. It is also conducted in February–March and results are declared around April–May. The Inter exam is critical for undergraduate college admissions across Bihar and nationally.

Because BSEB is established under a Bihar state law and is funded and controlled by the Government of Bihar, it is a state public authority under Section 2(h) of the RTI Act, 2005. This has two important consequences: RTI applications are filed under Bihar's RTI rules and fee structure, and second appeals are decided by the Bihar State Information Commission (BSIC) — not the Central Information Commission (CIC).

  1. Subject-wise marks breakdown: BSEB's published result typically shows only the aggregate or pass/fail status. Through RTI, a student can obtain a certified, subject-by-subject breakdown of marks — theory, practical, internal assessment — for every paper in the examination.
  2. Copy of the evaluated answer script: The single most significant benefit of RTI for students. The Supreme Court of India in CBSE and Another v. Aditya Bandopadhyay and Others (2011) 8 SCC 497 ruled categorically that evaluated answer books are "information" under Section 2(f) of the RTI Act, and that examination boards are obligated to provide copies to examinees. The Court found no valid Section 8 exemption applicable to answer scripts. BSEB, as a public authority, is bound by this ruling. A student who receives their answer script can personally check for totalling errors, unanswered but marked questions, and whether the marking scheme was correctly applied.
  3. Model answers and marking scheme: The evaluation key or model answers provided to examiners by BSEB can be sought through RTI. Comparing your answer with the official model answer can reveal whether the examiner applied the scheme correctly or penalised a valid alternative approach.
  4. Toppers' answer scripts (public interest): RTI can be used to seek the highest-scoring answer script in a subject (redacted of personal information) as a public interest request to understand the standard of evaluation applied by the Board. This has been accepted in numerous RTI cases involving other examination boards.
  5. Re-evaluation and scrutiny status: If you applied for BSEB's scrutiny or re-evaluation scheme and are awaiting a result, RTI can compel the Board to disclose the current status, the revised marks (if re-evaluation is complete), and the reason for any delay.
  6. Evaluation process details: The instructions issued to evaluators — such as any minimum award norms, whether second-level moderation was applied, and the number of examiners who assessed a script — can be sought under RTI to verify whether the examination was conducted fairly.

Where to File

BSEB is a single unified public authority covering both Matric and Inter examinations. There is one SPIO for the entire Board:

You do not need to approach separate offices for Matric versus Inter queries. Both are handled at BSEB's Patna headquarters.

The First Appellate Authority (FAA) is a senior officer within BSEB, designated to hear First Appeals under Section 19(1) of the RTI Act. The FAA's details are typically available on the BSEB website or can be confirmed from the SPIO's office at the time of filing.

The second appeal body for BSEB is the Bihar State Information Commission (BSIC), constituted under Section 15 of the RTI Act for Bihar state public authorities.

How to File: Step by Step via rtionline.bihar.gov.in

Bihar operates a dedicated RTI online portal at rtionline.bihar.gov.in. Filing online is the most efficient route.

  1. Create an account: Visit rtionline.bihar.gov.in and register with your name, email address, and mobile number. Verify your mobile OTP to activate the account.
  2. Select the public authority: After logging in, choose to file a new RTI application. From the department list, select Education Department and then Bihar School Examination Board (BSEB).
  3. Draft your application: In the application text box, clearly state your examination details (Matric or Inter, year, roll number, roll code) and list each piece of information you are seeking as a numbered point. Be specific and factual. Use the sample RTI draft above as a template.
  4. Pay the fee: Pay ₹10 online through the portal's payment gateway. BPL cardholders are exempt — select the BPL option and upload a copy of your BPL ration card.
  5. Submit and note your registration number: After successful payment and submission, the portal will generate a unique registration number. Note this number — you will need it to track the status, follow up, and file any appeals.
  6. Track the application: Log in to the portal periodically to check whether the SPIO has responded. You should also receive an email or SMS notification when a response is uploaded.

Postal alternative: If you prefer to file by post, address your application to the SPIO at the address above, enclose an Indian Postal Order (IPO) of ₹10 drawn in favour of "Bihar School Examination Board", and send by registered post. Retain the postal receipt — the 30-day response clock starts from the date of receipt by the SPIO, not your posting date.

Detailed Information Requests

Subject-wise Marks

Request a subject-by-subject breakdown of marks for every paper in the examination — theory / written component, practical marks, internal assessment marks, and the total for each subject — along with the maximum marks in each component and the aggregate percentage recorded.

Answer Script

Cite CBSE v. Aditya Bandopadhyay (2011) 8 SCC 497 directly in your application. Specify the subject name, paper number (if multiple papers exist), and the examination year and roll number. Request certified photocopies of the evaluated answer script — including all pages of the answer booklet and any supplementary answer booklet(s) used.

Model Answers and Marking Scheme

Ask for "the model answers or evaluation key / marking scheme prepared and distributed to evaluators for subject name, Matric / Inter examination year, if such a document was prepared." This is often held by BSEB's examination division and is disclosable under RTI.

Scrutiny or Re-evaluation Status

If you have applied through BSEB's own scrutiny scheme, your RTI should ask: the date the scrutiny application was received, the current stage of processing, whether re-evaluation has been completed, the revised marks (if any), the reason for delay if the result is pending, and the name and designation of the officer responsible.

Appeals

First Appeal (Section 19(1)): File with the FAA at BSEB, Patna within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. No fee is payable. Attach your original RTI application and proof of filing. If BSEB refuses to provide your answer script citing confidentiality or any other ground, cite the Aditya Bandopadhyay Supreme Court ruling (2011) prominently in the First Appeal.

Second Appeal (Section 19(3)): If the FAA's response is absent or unsatisfactory, file a Second Appeal with the Bihar State Information Commission (BSIC) within 90 days of the FAA's decision or the expiry of the FAA response deadline. No fee is payable. BSIC has jurisdiction over all Bihar state public authorities including BSEB. Under Section 20 of the RTI Act, BSIC may impose a personal penalty of ₹250 per day (up to ₹25,000) on the SPIO for failure to furnish information without reasonable cause, and may recommend disciplinary action. Second appeals against BSEB always go to BSIC — never to the Central Information Commission (CIC), which handles only Central Government bodies.
