3. Official Answer Key (Preliminary Examination)

The First Appellate Authority (FAA) for BPSC RTI matters is typically the Joint Secretary or Secretary of the Commission. Confirm the current FAA's name and designation from BPSC's website or from the CPIO's office at the time of filing.
The second appeal body for BPSC is the Bihar Information Commission (BIC), constituted under Section 15 of the RTI Act for Bihar state public authorities. Second appeals against BPSC never go to the Central Information Commission (CIC).
How to File: Step by Step
Bihar operates a dedicated RTI online portal at rtionline.bihar.gov.in. Filing online is the most efficient route for BPSC applications.
- Register on the Bihar RTI portal: Visit rtionline.bihar.gov.in and create an account with your name, email address, and mobile number. Verify your mobile OTP to activate the account.
- Select the public authority: After logging in, choose to file a new RTI application. From the department list, select General Administration Department and then Bihar Public Service Commission (BPSC).
- Draft your application: In the application text box, clearly mention the examination name, advertisement number, your roll number, and the specific stage (Preliminary / Mains / Interview) for which you are seeking information. List each item of information as a separate numbered point. Be precise — vague requests are easier to deflect or partially answer.
- Pay ₹10: Pay the RTI fee online through the portal's payment gateway. BPL cardholders are exempt — select the BPL option and upload a copy of your BPL ration card.
- Submit and note your registration number: After successful payment and submission, the portal issues a unique registration number. Note this carefully — you will need it for tracking and appeals.
- Track the response: Log in to the portal to check whether the CPIO has uploaded a response. You should also receive email or SMS notifications. The CPIO must respond within 30 days of receipt under Section 7(1) of the RTI Act.
Postal alternative: Address your application to the CPIO at the Patna headquarters, enclose an Indian Postal Order (IPO) of ₹10 drawn in favour of "Bihar Public Service Commission", and send by registered post with acknowledgement due (RPAD). The 30-day clock runs from the date the CPIO receives the application, not your posting date.
Fee and Timeline
- Application fee: ₹10 under the Right to Information (Regulation of Fee and Cost) Rules, 2005. BPL cardholders are fully exempt.
- Response deadline: 30 days from receipt by the CPIO (Section 7(1), RTI Act 2005).
- Life and liberty matters: 48 hours, as per the Section 7(1) proviso — not applicable to typical BPSC exam queries.
- Third-party information: If BPSC intends to disclose third-party information, it may take up to 40 days (10 extra days under Section 11).
First Appeal: Section 19(1)
If the CPIO fails to respond within 30 days, provides an incomplete or evasive response, or wrongly denies the information by claiming an exemption under Section 8:
- File a First Appeal under Section 19(1) of the RTI Act with the First Appellate Authority (FAA) within BPSC.

- The FAA must dispose of the First Appeal within 30 days of receipt, extendable to 45 days with written reasons recorded.
Second Appeal: Bihar Information Commission (BIC)
If the FAA's response is also absent, incomplete, or unsatisfactory, the next step is a Second Appeal to the Bihar Information Commission (BIC) under Section 19(3) of the RTI Act.
- The Second Appeal must be filed within 90 days of the date of the FAA's decision or the expiry of the FAA's response deadline, whichever is earlier. BIC has the discretion to condone delays for sufficient cause.
- BIC is the state-level independent quasi-judicial authority constituted under Section 15 of the RTI Act for all Bihar state public authorities, including BPSC.
- No fee is payable for the Second Appeal.
- BIC will hear the matter, may call both the applicant and the CPIO, and pass an order directing BPSC to disclose the information.
Section 20 penalty: Under Section 20 of the RTI Act, BIC has the power to impose a penalty of ₹250 per day (up to a maximum of ₹25,000) on the CPIO personally for failure to furnish information without reasonable cause. BIC may also recommend disciplinary proceedings against the erring official.
It is critical to note: Second appeals against BPSC always go to BIC, not to CIC. The Central Information Commission's jurisdiction is limited to Central Government bodies. BPSC is a state constitutional body under the Government of Bihar — its second appeals are decided by BIC.
Practical Tips for BPSC RTI Applications
Be specific about the examination and stage: Always mention the exact advertisement number, examination name (e.g., "68th Combined Competitive Examination"), and the stage (Preliminary / Mains / Interview). Vague requests invite vague or partial responses.
File for answer scripts within the time BPSC retains them: Answer scripts are not retained indefinitely. File your RTI as soon as possible after the result is declared — typically within a few months of the Mains result announcement.
Cite the Supreme Court ruling for answer scripts: Whenever requesting your evaluated Mains answer booklet, include the citation: CBSE and Another v. Aditya Bandopadhyay and Others (2011) 8 SCC 497. This pre-empts refusal on grounds of confidentiality.
Request the final answer key, not just the provisional key: Provisional answer keys are often publicly available on BPSC's website. What is more valuable for an RTI application is the final corrected answer key and the reasoning behind changes made after objections.
Reservation roster requests: If you suspect reservation irregularities, request the roster by post (category) and year so that BPSC cannot provide a summary without the full underlying document.
