The Bhagalpur Tussar silk carries a Geographical Indication (GI) tag recognising its unique origin, natural texture, and the characteristic earthy brown and cream tones produced from the cocoons of wild Antheraea mylitta silkworms that feed on arjun, asan, and sal trees in Bihar's forests. Adjacent districts — Banka and Munger — form an extended silk-weaving cluster that together sustains hundreds of thousands of looms, most operated by weavers from the Ansari community, whose generational expertise in handloom silk weaving defines the cultural and economic identity of the region.

The Bhagalpur textile cluster faces significant challenges: encroachment from power looms producing cheaper imitation Tussar fabric, synthetic alternatives marketed under misleading labels, and persistent gaps in welfare scheme delivery to weavers. The Bihar State Handloom Corporation (BSHC) is the state's principal marketing and procurement body for handloom products, while the Directorate of Handloom & Sericulture under the Industries Department administers weaver welfare programmes. Patna silk — a secondary variety produced in Patna and nearby districts — is also woven in Bihar, though on a far smaller scale than Bhagalpuri Tussar.

What Information Can You Seek?

RTI applications to the Directorate of Handloom & Sericulture or BSHC can access a wide range of records:

GI Tag Enforcement: The number of market inspections and raids conducted to detect fake Bhagalpuri Tussar silk; products seized; FIRs or complaints filed under the Geographical Indications of Goods (Registration and Protection) Act, 1999; coordination with e-commerce platforms to remove listings of imitation Bhagalpur silk; and prosecutions launched and convictions obtained.

Weaver Welfare Scheme Data: District-wise beneficiary lists under the National Handloom Development Programme (NHDP) — including yarn subsidies, loom upgradation grants, design development assistance, and health insurance coverage (New Health Insurance Scheme for weavers); Weavers Credit Card (WCC) sanctions, disbursals, interest subvention payments, and NPA cases; and beneficiary selection criteria and records for each welfare component.

BSHC Procurement Records: Quantities of Bhagalpuri Tussar silk products procured from weavers in a given year; price paid per metre or per piece versus prevailing market rates; marketing channels and outlets used; unsold inventory and its valuation; and whether weavers were adequately represented in procurement price-setting processes.

How to File RTI

Step 1: Identify the correct CPIO. For district-level weaver data, welfare scheme beneficiaries, DIC-level records, and cluster implementation, file with the CPIO at the District Industries Centre (DIC), Bhagalpur. For state-level BSHC procurement records, GI enforcement, consolidated weaver scheme data, and Directorate-level policy records, file with the CPIO at the Directorate of Handloom & Sericulture, Patna. BSHC is a separate public authority — file directly with BSHC's CPIO for its procurement, marketing, and financial records.

Step 2: Draft a precise application. Specify the district, year, scheme name, and the exact records sought. Reference scheme names (NHDP, Weavers Credit Card, Samarth, BSHC procurement) explicitly. Vague queries produce incomplete responses.

Step 3: File online. Visit rtionline.gov.in, select the appropriate Bihar state public authority, complete the form, and pay the ₹10 fee online. BPL cardholders may upload a self-attested BPL card copy and claim fee exemption.

Step 4: Offline filing. Send the application by registered post or speed post to the CPIO, enclosing a crossed Indian Postal Order (IPO) for ₹10 drawn in favour of the Accounts Officer of the relevant office. Retain the postal receipt and a full photocopy of your application.

Key RTI Act Provisions

All offices of the Directorate of Handloom & Sericulture, the Bihar State Handloom Corporation, and District Industries Centres are public authorities under Section 2(h) of the Right to Information Act, 2005, as bodies established and substantially funded by the Government of Bihar.

  • Section 6: Governs how to file an RTI application — no reason required for the request.
  • Section 7(1): The CPIO must provide information within 30 days of receipt.
  • Section 7(1) proviso: Response within 48 hours if the matter concerns the life or liberty of a person.
  • Section 19(1) — First Appeal: File within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable, with the First Appellate Authority — the officer immediately senior to the CPIO (typically the Joint Director, Handloom & Sericulture). No fee payable.
  • Section 19(3) — Second Appeal: File within 90 days of the FAA's decision or the expiry of the FAA's response period with the Bihar State Information Commission (BSIC).
  • Section 20 — Penalty: The BSIC can impose ₹250 per day (up to ₹25,000) on the defaulting CPIO and recommend disciplinary action.

Note: The Central Silk Board (CSB) and the Office of the Development Commissioner (Handloom) under the Ministry of Textiles are Central Government bodies operating in Bihar — RTI to these bodies requires filing with their Central CPIOs, and second appeals go to the Central Information Commission (CIC), not BSIC.

First Appeal

If the CPIO does not respond within 30 days, or the response is incomplete or unsatisfactory, file a First Appeal under Section 19(1) of the RTI Act. Address it to the First Appellate Authority — the Joint Director or Director of Handloom & Sericulture (for applications filed at the Directorate level), or the General Manager / Competent Officer of BSHC (for applications filed with BSHC). The appeal must be filed within 30 days of the date of decision or expiry of the 30-day response period, whichever is applicable. Attach a copy of your original application and the CPIO's response (if any). No fee is payable.

Second Appeal

If the First Appellate Authority also fails to respond satisfactorily or does not decide within the stipulated period, file a Second Appeal under Section 19(3) of the RTI Act with the Bihar State Information Commission (BSIC) in Patna. The BSIC is constituted under Section 15 of the RTI Act and is the supreme appellate body for all Bihar state public authorities — including the Directorate of Handloom & Sericulture, BSHC, and all District Industries Centres. The Second Appeal must be filed within 90 days of the FAA's decision or the expiry of the FAA's response period. The BSIC has full power to direct disclosure, impose penalties under Section 20, and recommend disciplinary action against a defaulting CPIO.

Critical: Do not file the Second Appeal with the Central Information Commission (CIC). The CIC has jurisdiction only over Central Government bodies. The Bihar Handloom Directorate, BSHC, and all DICs are state public authorities — filing with the CIC will result in dismissal for lack of jurisdiction.
