It functions under the Housing Department, Government of Karnataka, and is responsible for planned urban development in and around Bengaluru — acquiring land, forming residential layouts, allotting sites, developing civic amenities, and regulating urban land use. BDA's major layout schemes — including the Arkavathy Layout, the Nadaprabhu Kempegowda Layout (NKLA), and the Rajiv Gandhi Housing Corporation-linked schemes — are among the most sought-after residential land allocations in Karnataka.
Because BDA schemes are oversubscribed and long-running, applicants routinely face uncertainty about allotment status, opacity in the site formation scheme selection process, questions about the conduct of e-auctions, and delays in layout formation and possession. BDA is a state public authority under Section 2(h) of the RTI Act, 2005, and is fully subject to the disclosure obligations of the Act. What BDA Records Are Available via RTI?
The RTI Act, 2005, entitles citizens to inspect and obtain copies of records held by public authorities. For BDA, the following categories of records are obtainable via RTI:
Plot Allotment Status and Registration Records
- Your current application status — active, waitlisted, allotted, cancelled, or rejected — under a specific BDA scheme and registration number
- The total number of applicants registered in your category (General / SC / ST / OBC / EWS / Ex-Serviceman / Physically Handicapped) and the total number of sites offered in your category and plot-size class
- The date and reason for any status change on your application, including the name and designation of the officer who recorded the change
- Copies of any allotment letter, demand notice, or cancellation letter issued in your name
- The refund status of any registration fee or cost deposit paid, if your application was cancelled
Site Formation Scheme Records
The BDA Site Formation Scheme (SFS) is a periodic scheme through which BDA allots formed sites to eligible applicants on a priority and draw-of-lots basis. RTI can surface:
- The complete eligibility conditions and priority rules applied for a specific scheme year — income ceiling per category, minimum years of residence in Bengaluru, property-ownership disqualification criteria, and supporting documents required
- The basis for assigning priority within a category — whether by date of application, points system, or computerised draw of lots, and the methodology of the draw if one was conducted
- The total number of applications received, the number of valid applications after scrutiny, the number of sites offered in each category and plot-size class, and the list or range of application numbers of selected applicants
- Copies of allotment committee resolutions approving the SFS allotment list
Auction Records
BDA periodically conducts e-auctions and public auctions for premium or corner sites that are not covered under the standard allotment scheme. RTI can provide:
- The reserve price for a specific auctioned site and the basis on which it was fixed (valuation report or government guideline value)
- The number of registered bidders and active bidders who participated in the auction
- The final auction price, the name and reference number of the successful bidder, and the date of the auction
- Any complaints received about the conduct of the auction and the action taken on such complaints
- The minutes of the BDA board meeting or auction committee that approved the auction and the reserve price
Encroachment Notices and Eviction Proceedings
BDA has enforcement powers to remove encroachments from BDA-formed layouts and acquired land. RTI can help affected parties or neighbours obtain:
- All encroachment notices, demolition orders, or eviction proceedings issued for specific sites or layouts during a specified period
- The legal basis for each action (Section of the BDA Act under which it was initiated), the officer who issued it, and the current status of each proceeding
- Whether any stay orders or court orders have been passed affecting BDA's enforcement action on specific sites
- The action taken on complaints about encroachments received from members of the public
Layout Approval and Planning Records
- The layout plan sanction order number, date, and sanctioning authority for a specific BDA layout
- The total area of the layout, number of residential, commercial, and civic amenity (CA) sites, and the area and percentage earmarked for parks and open spaces
- Whether a Completion Certificate or Deemed Completion Certificate has been issued for the layout, and if not, the pending steps and expected date
- Any modifications to the original sanctioned layout plan — the modification order number, date, authority, and nature of the change (conversion of CA site, change in road width, reduction in park area, etc.)
How to File RTI with BDA
Step 1: Determine Your Information Need
Identify precisely what you want to know — your allotment status, the SFS selection criteria, an auction record, or a layout approval. Frame each query as a specific, numbered information request. Avoid broad requests such as "provide all records related to my file" — specific questions get faster and more complete responses.
Step 2: Draft Your Application
Use the sample application provided above as the base. Fill in your scheme name, registration number, category, and the specific information points that apply to your situation. If you are not an applicant but a general citizen seeking layout or auction information, omit the personal applicant details and keep only the relevant information requests.
Step 3: File Online or in Person
BDA is a Karnataka state public authority. File your RTI application through the Karnataka government's RTI online portal at rtionline.karnataka.gov.in. This portal allows online filing and online payment of the ₹10 fee. Alternatively, submit a physical application by registered post or in person to the SPIO, Bangalore Development Authority, T.T. Nagar, Bengaluru – 560032. Pay the ₹10 fee by Indian Postal Order, demand draft in favour of "Bangalore Development Authority," or as directed by the portal. BPL cardholders are exempt from the fee; attach a copy of your BPL card.
Step 4: Track Your Application
The SPIO must respond within 30 days of receipt (Section 7(1), RTI Act 2005). If the requested information involves life or liberty, the deadline is 48 hours. Keep the acknowledgement number or postal tracking reference as proof of filing.
Step 5: Appeals
If BDA does not respond within 30 days, or the response is incomplete, incorrect, or evasive:
- First Appeal under Section 19(1): File with the First Appellate Authority (FAA) designated within BDA within 30 days of the date of the decision or expiry of the 30-day response period, whichever is applicable. No fee is required.
- Second Appeal under Section 19(3): If the FAA's response is also absent or unsatisfactory, file with the Karnataka Information Commission (KIC) under Section 15 of the RTI Act within 90 days of the FAA's decision or the expiry of the FAA's response period. No fee is required. The KIC can direct BDA to furnish the information and impose a penalty of ₹250 per day (up to ₹25,000) on the SPIO personally under Section 20 of the RTI Act.
Understanding the Appeal Path: BDA is a State Body
BDA is a state public authority under Section 2(h) of the RTI Act, 2005. All appeals from BDA RTI applications remain entirely within the Karnataka state system:
- First Appeal: First Appellate Authority (FAA), Bangalore Development Authority, Bengaluru
- Second Appeal: Karnataka Information Commission (KIC) — constituted under Section 15 of the RTI Act. The Central Information Commission (CIC) has no jurisdiction over BDA or any other Karnataka state body.
This distinction matters. Filing a second appeal with the CIC instead of the KIC will result in the complaint being returned as not maintainable. Always address your second appeal to the KIC.
Tips for an Effective BDA RTI Application
- Include your registration number and scheme name in every RTI about your allotment. BDA administers multiple concurrent schemes and hundreds of thousands of applications; an RTI without these identifiers will typically result in a response saying the information cannot be located.
- Specify the time period for any request about encroachment notices or audit proceedings to limit the scope and get a complete response.
- Ask for certified copies of specific documents — allotment committee resolutions, layout sanction orders, auction proceedings — rather than asking BDA to "explain" a decision. Certified copies are admissible as evidence in legal proceedings.
- File separately for each scheme or layout if your queries relate to more than one scheme or layout. Bundling multiple unrelated schemes into a single application can slow the response.
- Cross-check layout records with the BDA's published layout plans to identify discrepancies — any deviation from the sanctioned plan is actionable through RTI disclosure and subsequent complaint to the Town Planning department or the Karnataka Lokayukta.
