Citizens of Andhra Pradesh who have lodged a police complaint or had an FIR registered often find themselves in an information vacuum. The complaint was submitted, days or weeks have passed, and there is no official record of what was done with it. The police station may have registered an FIR, or may not have. An investigation may be ongoing, stalled, or closed without the complainant's knowledge. A charge sheet may or may not have been filed in court. Without a written record in hand, the complainant has no basis to follow up effectively and no documentary trail to support further legal action. The Right to Information Act, 2005 closes this gap.

Andhra Pradesh Police is a public authority under Section 2(h) of the RTI Act, 2005. It is legally required to respond to RTI applications within 30 days of receipt, or within 48 hours if the matter concerns the life or liberty of a person. Failure to respond within the prescribed period is treated as a deemed refusal and gives the applicant the right to file a First Appeal and, thereafter, a Second Appeal to the Andhra Pradesh State Information Commission (APSIC). This guide explains what information you can obtain, which office to approach, how to file through the AP RTI portal, how to frame your questions, and the full appeals process.

Andhra Pradesh Police: Commissionerates and District Structure

Andhra Pradesh was bifurcated from the erstwhile combined Andhra Pradesh in June 2014 to create the state of Telangana. The residual state of Andhra Pradesh — with its capital functions now located at Velagapudi, Amaravati — has its own separate police force headed by the Director General of Police (DGP), Andhra Pradesh.

The state is organised into zones, ranges, and districts. However, two cities have dedicated urban police commissionerates:

  • Vijayawada City Police Commissionerate — covering all police stations within the municipal limits of Vijayawada, headed by the Commissioner of Police (CP), Vijayawada.
  • Visakhapatnam City Police Commissionerate — covering all police stations within Visakhapatnam city limits, headed by the Commissioner of Police (CP), Visakhapatnam.

All other districts — including Guntur, Krishna, East Godavari, West Godavari, Kurnool, Nellore, Prakasam, Kadapa, Anantapur, Chittoor, Srikakulam, Vizianagaram, and the new districts created under the 2022 reorganisation — are each headed by a Superintendent of Police (SP). Within each district or commissionerate, individual police stations are headed by a Station House Officer (SHO).

For RTI purposes, the SHO of the police station is commonly designated as the SPIO for records held at that station level. The SP's office and the CP's office each have their own designated SPIOs for records held at those levels.

What RTI Can Help You Get from Andhra Pradesh Police

RTI to Andhra Pradesh Police can reliably obtain factual, procedural, and administrative information about your complaint, FIR, or police matter. Citizens regularly use RTI to:

  • Obtain a certified copy of the FIR — including the section(s) of law under which it was registered — where the police station did not provide one at registration or subsequently refused to do so
  • Get the written reason for non-registration of a complaint as an FIR, and confirm whether the complaint was at least entered in the General Diary (GD)
  • Find out the current stage of investigation — whether ongoing, charge sheet filed, or case closed — along with the specific date that status was recorded
  • Know the name and designation of the Investigating Officer (IO) assigned to the FIR and the dates of any changes in the IO
  • Confirm whether a charge sheet under Section 173 CrPC / Section 193 BNSS has been filed, including the court name, date of filing, and the case number assigned by the court — or get the reason for delay beyond the statutory period
  • Obtain a copy of the Action Taken Report (ATR) prepared on your written complaint
  • Track the outcome of a departmental inquiry against a police officer — whether a disciplinary proceeding was initiated, what the inquiry found, and what the final order was
  • Access aggregated statistical data such as the number of FIRs registered under a specific provision in a district during a given year
  • Establish on record that your complaint was received at the police station on the date you submitted it, where the station later denies receiving any complaint

Important limitation — Section 8(1)(h): This provision of the RTI Act exempts from disclosure any information that would impede the process of investigation, detection, or prosecution of offenders. For active investigations, this covers the case diary, witness identities, evidence gathered, details of suspects not yet charge-sheeted, and operational methods. RTI cannot extract this operational detail. It can, however, obtain administrative and procedural facts that are not covered by the exemption. Always include a note in your RTI application that you do not seek any information that would impede investigation — this signals an understanding of the legal boundary and reduces the risk of a sweeping Section 8(1)(h) refusal.

Where to File: Choosing the Right SPIO

File your RTI application with the SPIO at the office that is most likely to hold the records you need:

  • FIR at a specific police station: File with the SPIO at that police station (the SHO), or with the SPIO at the district SP's office or commissionerate CP's office covering that station.
  • Complaint where no FIR was registered: File with the SPIO at the police station where you submitted the complaint, or with the SPIO at the Sub-Divisional Police Office (SDPO) or district SP's office covering that station.
  • Vijayawada commissionerate area: File with the SPIO, Office of the Commissioner of Police, Vijayawada City Police Commissionerate.
  • Visakhapatnam commissionerate area: File with the SPIO, Office of the Commissioner of Police, Visakhapatnam City Police Commissionerate.
  • Other districts: File with the SPIO, Office of the Superintendent of Police, concerned district.
  • Unsure which unit holds the record: File with the SPIO, Home Department, Government of Andhra Pradesh, Secretariat, Velagapudi, Amaravati – 522 237. Under Section 6(3) of the RTI Act, the receiving SPIO must transfer your application to the correct office within five days and notify you of the transfer. The 30-day response period continues from the date of receipt at the correct unit.

How to File: Using the AP RTI Portal

Step 1: Gather Your Details

Before drafting the application, compile:

  • The name and address of the police station where the complaint was filed or the FIR was registered
  • The FIR number and year, if available, and the date of registration
  • If no FIR was registered, the date you submitted the complaint and any acknowledgement, GD entry number, or receipt given to you
  • A brief factual description of the matter — without accusations, emotional language, or rhetorical claims

Step 2: Draft Your Application

Use the sample draft provided above as a template. Limit your questions to procedural status and administrative facts. Explicitly state that you do not seek information that would impede investigation. Be specific: name the police station, give the FIR number and year, and state the date of your complaint. Vague applications invite vague responses.

Step 3: File Online via rti.ap.gov.in

The Government of Andhra Pradesh maintains the RTI online portal at rti.ap.gov.in. To file through this portal:

  1. Visit rti.ap.gov.in and register or log in.
  2. Select the department — navigate to the Home Department or directly to the Andhra Pradesh Police / concerned SP's office or CP's office.
  3. Complete the online application form, enter your information sought, and upload any supporting documents.
  4. Pay the ₹10 fee online. BPL cardholders may upload a self-attested copy of their BPL card and claim the fee exemption under Section 7(5) of the RTI Act.
  5. Submit the application and note the acknowledgement number — this is essential for tracking your application and filing appeals.

Offline filing: If the specific unit you are targeting is not available on the online portal, send your application by registered post or speed post to the SPIO at the concerned police station, SP's office, or CP's office. Enclose a crossed Indian Postal Order (IPO) for ₹10 drawn in favour of the Accounts Officer of the concerned department. Retain the postal receipt and a photocopy of the full application with enclosures.

Step 4: First Appeal under Section 19(1)

If there is no response within 30 days of the date of receipt (or 48 hours for matters concerning life or liberty), or if the response is incomplete, evasive, or amounts to an unjustified refusal, file a First Appeal with the First Appellate Authority (FAA) within Andhra Pradesh Police. This is typically the officer immediately senior to the SPIO — such as a Deputy Commissioner of Police (DCP) in a commissionerate, or an Additional SP at the district level. The First Appeal must be filed within 30 days of the date of the SPIO's decision or the expiry of the 30-day response period, whichever is applicable. No fee is payable for a First Appeal. Attach copies of the original RTI application, postal proof of delivery, and the SPIO's response, if any.

Step 5: Second Appeal to APSIC under Section 19(3)

If the FAA also fails to respond or responds unsatisfactorily, file a Second Appeal with the Andhra Pradesh State Information Commission (APSIC) under Section 19(3) of the RTI Act, within 90 days of the FAA's decision or the expiry of the FAA's response period. APSIC can direct disclosure of the withheld information, impose a daily penalty of ₹250 (up to ₹25,000) on the defaulting SPIO under Section 20 of the RTI Act, and recommend departmental disciplinary action.

Specific Information Requests: What to Ask

FIR Copy and Registration Details

  1. A certified copy of FIR No. XXX/YEAR registered at Police Station Name, including the section(s) of law under which it was registered and the date and time of registration.
  2. The date on which a copy of the FIR was forwarded to the Judicial Magistrate having jurisdiction, as required under Section 157 CrPC (Section 193 BNSS).
  3. Whether any modification to the FIR — addition or deletion of penal sections — was made after initial registration; if yes, the date of modification and the authority under whose direction it was made.

Complaint Where No FIR Was Registered

  1. Whether the written complaint submitted on DD/MM/YYYY to Police Station Name was entered in the General Diary — if yes, the GD entry number and date.
  2. The specific reason recorded by the officer in charge for not registering an FIR on the basis of the complaint, and the name and designation of the officer who made that decision.
  3. Whether a preliminary inquiry was conducted before the decision not to register an FIR — if yes, the date the inquiry was completed and the conclusion recorded.

Investigation Status and IO Details

  1. The current stage of investigation in FIR No. XXX/YEAR — whether ongoing, charge sheet filed, or case closed.
  2. If the case has been closed: the nature of the final report (untraced / false case / mistake of fact / civil in nature), the date of submission to the magistrate, and the name of the officer who submitted it.
  3. The name and designation of the Investigating Officer (IO) currently assigned, the date of assignment, and if the IO has changed, the name, designation, and dates for each officer who handled the investigation and the reason for the change.

Charge Sheet and Court Proceedings

  1. Whether a charge sheet under Section 173 CrPC / Section 193 BNSS has been filed — if so, the date of filing, the name and location of the court, and the case number.
  2. If the charge sheet has not been filed within the statutory period, the specific reason for the delay and the expected timeline for filing.

Case Diary: What You Can and Cannot Access

The case diary is maintained under Section 172 CrPC (Section 208 BNSS) and contains the IO's day-by-day record of the investigation. It is protected from disclosure under Section 8(1)(h) of the RTI Act while the investigation is active, because its disclosure would impede the process of investigation, detection, or prosecution. You cannot obtain the full case diary for a pending matter.

However, Section 8(1)(h) does not extend to all information held by the police. The following remain accessible even when the investigation is active: the FIR copy, GDE details, the name and designation of the IO, the broad stage of investigation, the date a charge sheet was filed (if it has been filed), and case closure details. Once a case is concluded — charge sheet filed and the case is at trial, or a final closure report has been accepted by the Magistrate — the bar under Section 8(1)(h) weakens considerably, and more information from the investigation record may become disclosable.

Departmental Inquiries and Accountability

RTI can also be used to track accountability within Andhra Pradesh Police:

  1. Whether a departmental inquiry or disciplinary proceeding was initiated against Name and Designation, Police Station Name, District in connection with brief description of the alleged misconduct.
  2. The authority before whom the inquiry was conducted, the date the inquiry was initiated, and the date it was concluded.
  3. The final order passed in the inquiry and the punishment, if any, awarded.

Tips for an Effective RTI Application

  • Be precise: State the police station name, district, FIR number and year, and the date of the complaint. Vague applications invite vague or evasive responses.
  • Ask procedural questions: Frame your questions around administrative facts and status — not around legal conclusions or operational investigation details.
  • Include the Section 8(1)(h) note: Explicitly state that you do not seek information that would impede investigation. This reduces the risk of a blanket refusal and signals that you understand the exemption's limits.
  • Invoke the 48-hour urgency provision: If your matter concerns the life or liberty of a person — such as a missing person, an unregistered complaint about physical violence, or a custodial matter — explicitly invoke the proviso to Section 7(1) of the RTI Act and state that the response is required within 48 hours.
  • Keep all records: Retain the acknowledgement number (from the online portal or postal receipt), a photocopy of the application, and all responses. These are essential for appeals.
  • File early: File your RTI application as soon as you encounter non-responsiveness or denial from the police station. Delays in filing can complicate appeals.
