RTI in Sikkim: Article 371(F), Land Records, Hydro Power, and the Sikkim Information Commission
A complete guide to filing RTI in Sikkim — covering the Sikkim Information Commission, Article 371(F) land protections, Record of Rights, hydro power project accountability, organic farming schemes, and the difference between state and central RTI in Sikkim.
Sikkim is India's smallest state by area and one of its most constitutionally distinctive. Its merger with India in 1975 was followed by the insertion of Article 371(F) into the Constitution, which preserved a range of Sikkim-specific rights and laws — most importantly, the laws preventing non-Sikkimese subjects from owning land in the state. Coupled with the state's remarkable journey to becoming India's first fully organic state, its status as a major hydro power producer in the eastern Himalayas, and a border with China that brings significant Indian Army presence, Sikkim has a governance profile unlike any other state.
For citizens of Sikkim dealing with land record disputes, hydro project compensation claims, organic farming scheme delays, electricity billing, or employment grievances, the Right to Information Act is a powerful and fully applicable tool. This guide covers how RTI works in Sikkim, which bodies it applies to, and how to use it effectively.
The Two-Track System: State vs. Central Bodies in Sikkim
The RTI Act, 2005 applies to all "public authorities" under Section 2(h). Which appeal body handles your case depends on whether the body is state or central.
State bodies — agencies created under Sikkim law, funded by the state government, or controlled by the Government of Sikkim — are supervised by the Sikkim Information Commission, established under Section 15 of the RTI Act. If the PIO does not respond, your First Appeal under Section 19(1) goes to the First Appellate Authority within the department, within 30 days of the PIO's decision or the expiry of the 30-day response period. A Second Appeal under Section 19(3) goes to the Sikkim Information Commission.
Central bodies — offices of the Union Government operating in Sikkim, central paramilitary forces, central PSUs, and national institutions — go to the Central Information Commission (CIC) in New Delhi via the same two-appeal process.
The quick test: who created the body, who funds it, who controls its senior appointments? Government of Sikkim → Sikkim Information Commission. Union Government or a central statute → CIC.
This distinction is important in Sikkim because several of the state's largest employers and most significant economic actors — the Indian Army, NHPC, Border Roads Organisation, and central universities — are central bodies.
Article 371(F) and Land in Sikkim
Article 371(F) of the Constitution contains several special provisions for Sikkim. Among the most significant for citizens is the protection of laws relating to the prevention of alienation of land to non-Sikkimese subjects. Under the Sikkim Subjects Regulation, 1961 and subsequent regulations, persons who are not recognised as Sikkim Subjects (or "Old Settlers" as defined under these rules) generally cannot purchase or own land in Sikkim. This is a constitutional protection that has survived multiple legal challenges.
The definition of who qualifies as a Sikkim Subject — and who does not — is maintained through the Sikkim Subjects Regulations and related records at the Home Department. This creates a unique documentation ecosystem that is itself a subject for RTI.
Record of Rights (ROR) in Sikkim
The primary land record in Sikkim is the Record of Rights (ROR), maintained by the Revenue Department through the Circle Offices (each of Sikkim's four districts — North, South, East, and West — is divided into circles, and each Circle Officer maintains the ROR for that circle).
The ROR records:
- The name of the landowner or pattadar
- The plot number (khasra or LD number)
- The area in hectares or acres
- The classification of the land (agricultural, homestead, etc.)
- Encumbrances or government-recorded tenancy rights if applicable
When to file RTI for ROR disputes: If the ROR at your Circle Office shows an incorrect owner name, an outdated entry, or an encumbrance that should have been cleared, file with the Circle Officer asking for:
- A certified copy of the current ROR entry for plot number X in circle Y, district Z
- The date on which the current entry was made and the order or file number under which it was recorded
- Whether any mutation application is pending for this plot, and if so, its current status
Mutation (Daakhil-Kharij) in Sikkim
Mutation in Sikkim — the formal transfer of land records from a previous owner to a new owner after a sale or inheritance — is processed at the Circle Officer level. The process requires submission of the registered sale deed, proof of Sikkim Subject status, and other documents.
If your mutation application is stalled, RTI to the Circle Officer can establish whether the application was received, what its current status is, what objection (if any) has been noted, and the name of the officer responsible. This creates a written record that often prompts the office to act.
Non-Sikkimese and land purchase disputes: If a transaction involving someone whose Sikkim Subject status is disputed has been recorded at the Circle Office, RTI can be used to ask for the documents the office relied upon to record the mutation — including the Sikkim Subject Certificate or equivalent document submitted with the application.
Sikkim Subject Records
For questions about whether a person is or was recorded as a Sikkim Subject — relevant for land ownership, government employment preferences, and other entitlements — RTI to the Home Department, Government of Sikkim or the relevant DC Office can ask for:
- Whether any Sikkim Subject Certificate has been issued in the name of person as recorded in the department's records
- The date of issue and the basis on which the certificate was granted
Energy & Power: SICL and the Energy & Power Department
Electricity in Sikkim is supplied through the Energy & Power Department, Government of Sikkim and, for certain functions, through Sikkim Power Development Corporation Limited (SPDCL). Both are state bodies → Sikkim Information Commission track.
For billing, connection, and supply disputes in Sikkim:
For a billing dispute:
- A copy of the meter reading register for your consumer number for the past 12 months
- Whether the billing for the disputed period was based on an actual meter reading or an estimated figure, and on what basis
- A copy of any test report for your meter and the date of the last physical test
- Copies of any communications or orders under which the disputed demand was raised
For a new connection delay:
- Current status of your application and whether any site inspection has been completed
- Any pending objection or clearance, and a copy of that communication
- The name of the officer responsible for processing applications in your sub-division
For supply failures:
- The date and time of the fault registered for your area
- The reason for the delay in restoration and the name of the engineer responsible
File with the PIO of the relevant sub-division or division of the Energy & Power Department.
Hydro Power: RTI for Project Clearances and Displacement Compensation
Sikkim is one of India's most significant hydro power producers in the eastern Himalayas. Multiple large hydro projects — including the Teesta-III, Teesta-V, Rangit projects, and others — have been developed in the state, some by NHPC (a central PSU) and some by state entities or private developers operating under state licences.
The consequences for local communities have been significant: displacement, loss of agricultural land, damage to the river ecosystem, and in some cases losses from dam failures during the 2023 Glacial Lake Outburst Flood. RTI is a crucial accountability tool for affected communities.
For communities displaced by a state-licensed hydro project: File with the Department of Energy & Power, Government of Sikkim or the relevant district collectorate asking for:
- The Environmental and Social Impact Assessment (ESIA) report and the Social Impact Assessment for the project
- The list of affected families identified in the resettlement plan
- The compensation amounts determined per family and the amounts paid to date
- The status of any pending compensation or rehabilitation commitment
- The name of the officer responsible for administering post-project rehabilitation
For NHPC-operated projects (Teesta-V, Rangit, and others): NHPC is a central PSU → CIC track. RTI to NHPC about project operations, environmental compliance, and compensation disbursement goes to the CIC.
Post-GLOF (2023) compensation and rehabilitation: The 2023 Glacial Lake Outburst Flood caused catastrophic damage to Teesta-III and downstream communities. RTI to the Relief & Disaster Management Department, Government of Sikkim can ask for:
- The number of families registered as affected in district/sub-division
- The total compensation disbursed under each scheme and the payment status for a specific application number
- The list of beneficiaries for each relief scheme by panchayat
Environmental clearances for hydro projects: The Sikkim State Pollution Control Board (state body → Sikkim Information Commission) holds environmental compliance records for projects within its jurisdiction. RTI can ask for inspection reports, compliance notices, and clearance conditions for specific projects.
Organic Farming Schemes: Disbursement and Beneficiary Records
Sikkim was declared India's first fully organic state in 2016 — a policy achievement that involved converting all agricultural land in the state to organic cultivation and phasing out chemical pesticides and fertilisers. This transformation was supported by substantial central and state government spending through schemes like the Sikkim Organic Mission and the PKVY (Paramparagat Krishi Vikas Yojana) central scheme.
RTI is useful for:
Scheme disbursement disputes: If you are a registered organic farmer who has not received the promised input subsidy, certification support, or market linkage benefit, file with the Department of Agriculture, Government of Sikkim asking for:
- The beneficiary list for scheme name for district/block/panchayat for year
- Whether your application number X is on the approved list
- The total amount allocated and disbursed for scheme name in year in your block
- The name and designation of the officer responsible for disbursement
Certification records: Organic certification for Sikkim's farms has been handled through the Sikkim Organic Certification Agency (SOCA) or third-party certifiers under state supervision. RTI to the Agriculture Department can ask about the certification status of a specific farm or panchayat area.
PKVY (central scheme): To the extent PKVY funds flow through state implementing agencies, RTI to the state Agriculture Department is appropriate. For the central scheme's own administration, RTI to the Ministry of Agriculture & Farmers' Welfare goes to the CIC.
Gangtok Municipal Corporation: Urban Permits and Records
The Gangtok Municipal Corporation (GMC) is the urban local body for Sikkim's capital and is a state body → Sikkim Information Commission track.
For building-related queries in Gangtok:
- Ask for the building permit or plan approval for a specific property — plan number, date of issue, approved plan, and any conditions
- If you suspect unauthorised construction in your neighbourhood, ask whether any permit exists for that property and the current status of any application
For trade licences and establishment matters at the GMC level:
- Ask for the status of your licence application, any pending requirement, and the officer responsible
Sikkim PSC: Recruitment and Examination Transparency
The Sikkim Public Service Commission (SPSC) is a constitutional body under Article 315 operating within the state framework → Sikkim Information Commission track.
Exam marks and disputes: After any SPSC examination:
- Ask for your marks in each paper for exam name, year, roll number
- The cut-off marks applied for inclusion in the merit list
- The number of candidates who appeared and the number included in the final list
Appointment delays: If you are on the selection list but have not received an appointment order:
- Ask for the current status of the advice process for post name
- Whether any stay or restraint is in force, and the order number

Practical Tips for Filing RTI in Sikkim
Identify your circle: Sikkim's land records are organised at the Circle Office level within each district. Always include the circle name, district, and plot number in any land-related RTI. Directing a land query to the wrong circle will result in deflection.
Article 371(F) and Sikkim Subject status: If your RTI touches on land ownership and Sikkim Subject status, be precise about whether you are asking about a specific application record, a specific certificate, or a specific mutation order. The Home Department holds Sikkim Subject records; the Circle Officer holds ROR and mutation records.
Hydro project queries: For communities affected by hydro projects, specify the project name, the district, and the specific compensation or rehabilitation matter. Broad requests covering entire projects may be declined as disproportionate — targeted queries about specific lists, specific payments, or specific orders are more effective.
Organic farming schemes: Specify the scheme name, year, and your registration or application number when asking about disbursements. Agriculture department records are maintained at the block and district level.
Language: RTI can be filed in Nepali (the official language of Sikkim), English, or Sikkimese. Filing in Nepali is valid and may be more practical for rural applications.
No portal URLs without verification: Always verify the current official URL before using any online RTI portal. Government portal addresses change, and outdated links in any guide — including this one — should not be relied upon.
Proactive disclosure under Section 4: Check the relevant state department's official website before filing. Beneficiary lists for some state schemes, tender awards, and budget documents may already be publicly available, saving you the time of a formal application.
RTISathi: File Your Sikkim RTI
Whether your matter involves a stalled land mutation at the Circle Office, a hydro project compensation claim with the Revenue Department or state Energy Department, an organic farming scheme disbursement with the Agriculture Department, a billing dispute with the Energy & Power Department, or an SPSC examination result, RTISathi can help you draft a precise, well-targeted RTI application and guide you through the appeal process if the PIO does not respond.
Sikkim's unique constitutional status — Article 371(F), Sikkim Subject laws, and its position as a hydro power hub and organic farming pioneer — means that many of its most important governance questions can only be answered by the government itself. RTI is the citizen's legal right to compel exactly that accountability.
