RTI in Puducherry: JIPMER, Pondicherry University, Land Records, and the Puducherry Information Commission

Puducherry occupies a singular place in Indian administrative history. A former French colony, the Union Territory is composed of four non-contiguous enclaves spread across three different states — the main Puducherry town on the Tamil Nadu coast, Karaikal further south also on the Tamil Nadu coast, Mahé embedded within Kerala, and Yanam on the Andhra Pradesh coast. This geographic fragmentation, combined with Puducherry's status as a Union Territory with its own legislature, creates an RTI landscape that is significantly more layered than most citizens expect.

This guide explains how RTI works in Puducherry, why JIPMER is not a Puducherry body despite being the most famous institution in the territory, how Puducherry's French-era land records are organised, which bodies go to the Puducherry Information Commission (PIC) and which go to the Central Information Commission (CIC), and what to ask in the most common situations Puducherry residents encounter.

Puducherry Has a Legislature — And Its Own Information Commission

Puducherry is a Union Territory with a legislature (the Puducherry Legislative Assembly) and an elected government. This distinguishes it from UTs like Chandigarh, which have no legislature and no State Information Commission.

Because Puducherry has a legislature, it has established its own Puducherry Information Commission (PIC) under Section 15 of the RTI Act. The PIC is also referred to as the Pondicherry Information Commission.

For all Puducherry government bodies — departments of the UT government, the Puducherry Revenue Department, PESCO, Puducherry Housing Board, Puducherry Tourism Development Corporation, and the state PSC — the appeal chain is:

  1. First Appeal (Section 19(1)): File within 30 days of the PIO's decision or expiry of the 30-day response period, with the First Appellate Authority (FAA) within the same public authority.
  2. Second Appeal (Section 19(3)): File with the Puducherry Information Commission (PIC) if the FAA fails to provide a satisfactory resolution.

Central bodies in Puducherry — JIPMER, Pondicherry University, offices of the Income Tax department, EPFO, central banks — are subject to the CIC in New Delhi, not PIC.

The single most important thing to know: JIPMER and Pondicherry University are central bodies. Their second appeals go to CIC, not PIC.

The Four-Enclave Structure and Its RTI Implications

Puducherry's four enclaves — Puducherry (main), Karaikal, Mahé, and Yanam — each have their own administrative setup under the Puducherry government. The same RTI rules apply across all four enclaves: Puducherry UT government bodies go to PIC; central bodies go to CIC.

However, each enclave is geographically surrounded by a different state (Tamil Nadu, Kerala, or Andhra Pradesh), and this creates a practical consideration: some services in each enclave are delivered by neighbouring state bodies.

Tamil Nadu bodies operating in Puducherry or Karaikal: These are Tamil Nadu state bodies — RTI about them goes to the Tamil Nadu Information Commission, not to PIC.

Kerala bodies operating in Mahé: Mahé is an enclave within Kerala's Kannur district. Certain services, particularly road connectivity and some public utilities, involve Kerala state bodies. RTI about Kerala state bodies in Mahé goes to the Kerala State Information Commission (KSIC), not PIC.

Andhra Pradesh bodies near Yanam: Yanam is an enclave within Andhra Pradesh. AP state bodies operating in or adjacent to Yanam go to the Andhra Pradesh Information Commission, not PIC.

The practical rule: If the body that served you — the contractor, the department, the utility — is a Puducherry UT government body, use PIC. If it is a neighbouring state government body, use that state's SIC. If it is a central government body, use CIC.

Land Records in Puducherry: A French Colonial Heritage

Puducherry's land records system is distinct from the rest of India precisely because the territory was administered by the French government until 1954 — more than seven years after Indian independence. The legal framework for land records is the Puducherry Land Revenue and Land Reforms Regulation, 1967, which consolidated and adapted the colonial-era arrangements.

Land Categories from French Rule

Puducherry's land has certain unique categories that reflect its French administrative past:

  • Patta lands: Private ownership lands, recorded in the Revenue Department's patta registers. The patta documents the owner's name, the survey number, area, classification, and any conditions.
  • Commune panchayat lands: Lands vested in the commune panchayats (Puducherry's local bodies, which use the French term "commune" rather than "panchayat" in some contexts).
  • Government poromboke / UT Administration land: Unallotted government land.

The existence of French-era records means that some very old land documents may be in French or in Tamil written in a French administrative style. For any RTI about historical land records, the Revenue Department's sub-offices (at the taluk/commune level) are the correct PIOs.

Using RTI for Land Disputes

For a patta dispute:

  • A certified copy of the current patta record for survey number X, village/commune Y, taluk Z
  • The date on which the current entry was recorded and the order or file number under which it was made
  • A certified copy of any mutation order that changed the name on this patta in the last X years

For a pending mutation application:

  • The date of receipt of mutation application number X by the Revenue Department
  • The current status and the name of the officer holding the file
  • Whether any objection or inquiry has been initiated, and copies of any related communications

For a survey dispute (where the patta area differs from the physically measured area):

  • A copy of the field measurement extract (survey sketch) for survey number X, showing the boundaries and area
  • The date of the last resurvey for that plot

Land revenue matters in Puducherry are administered by the Puducherry Revenue Department — a UT government body. Second appeals go to PIC.

PESCO: Electricity in Puducherry

Puducherry Electricity Supply Corporation Limited (PESCO) is the state electricity utility, wholly owned by the Puducherry government. It is a UT body — second appeals for PESCO RTIs go to PIC.

Important note on TANGEDCO: Parts of Puducherry territory, particularly in areas that are geographically surrounded by Tamil Nadu, may receive electricity supply from TANGEDCO (Tamil Nadu Generation and Distribution Corporation). TANGEDCO is a Tamil Nadu state body. If your billing dispute is with TANGEDCO, the RTI goes to TANGEDCO and the second appeal goes to the Tamil Nadu Information Commission, not PIC.

For PESCO specifically:

Billing disputes:

  • A copy of the consumption register for consumer number X for the past 12 months
  • Whether the billing for month/year was based on an actual meter reading or an estimate, and the basis for the estimate
  • The date and meter reading recorded during the last physical inspection at your premises

New connection delays:

  • Status of application number X for a new connection at address, filed on date
  • Whether a site inspection has been conducted and, if so, the date and findings
  • Any pending requirements or objections communicated or recorded

Tariff and subsidy matters:

  • Whether the consumer account X is currently registered under the domestic/agricultural/commercial tariff category
  • Whether any subsidised tariff benefit or BPL concession is recorded against this consumer number

JIPMER: A Central Body — Not a Puducherry Body

JIPMER (Jawaharlal Institute of Postgraduate Medical Education and Research) is among the most important medical institutions in South India and serves a catchment area spanning Puducherry, Tamil Nadu, Andhra Pradesh, and beyond. Despite being physically located in Puducherry, JIPMER is a central government autonomous body under the Ministry of Health and Family Welfare, established by Act of Parliament (The Jawaharlal Institute of Postgraduate Medical Education and Research, Puducherry Act, 2008).

JIPMER is a central body — second appeals for JIPMER RTIs go to CIC, not to the Puducherry Information Commission.

This is the single most important distinction for Puducherry RTI filers. Many residents file against JIPMER and take their second appeal to PIC — this wastes months. JIPMER second appeals must go to CIC.

RTI for JIPMER:

Medical records:

  • A copy of the patient treatment record, discharge summary, and investigation reports for UHID X, patient name, admitted on date in department
  • The post-mortem report for patient name, UHID X, conducted on date
  • Whether any adverse event report was filed relating to patient name's treatment

Admission and merit lists:

  • The merit list and category-wise cut-off marks for MBBS/MD/MS/etc. admission for the year X
  • Whether candidate roll number X was shortlisted, and if not, the cut-off applied to their category

Recruitment:

  • The selection committee report and minutes for post name interview conducted on date
  • The number of posts in department currently vacant and the date since which they have been vacant

Tender and procurement:

  • Tender document, comparative statement, and evaluation report for supply/equipment under tender number X
  • The name of the successful bidder and the contract value

Pondicherry University: Another Central Body

Pondicherry University is a central university established under the Pondicherry University Act, 1985 — a central body funded by the UGC and the Ministry of Education. Second appeals go to CIC, not PIC.

RTI for Pondicherry University:

Admission and results:

  • The merit list and cut-off marks for admission to programme, year
  • Whether the applicant with application number X meets the eligibility criteria and, if not, the specific reason for rejection
  • Marks awarded to roll number X in exam, semester, year

Fellowship and scholarships:

  • The number of PhD fellowships sanctioned for department, year and the names of recipients
  • Whether fellowship stipends for month/year have been disbursed, and if delayed, the reason recorded

Faculty and administration:

  • The selection committee report for designation appointment in department
  • The terms of any contract awarded for hostel maintenance/construction/other under tender number X

Puducherry PSC, Housing Board, and Tourism Corporation

Puducherry Public Service Commission (Puducherry PSC): The state-level recruitment body. It is a UT government body — second appeals go to PIC. RTI uses: marks in examination name, year, roll number, merit list position, vacancy details.

Puducherry Housing Board: The UT housing authority, analogous to CHB or other state housing boards. It is a UT body — second appeals go to PIC. RTI uses: allotment status, waiting list position, scheme documents, maintenance complaints.

Puducherry Tourism Development Corporation (PTDC): The UT tourism body. UT body — PIC. RTI uses: tender documents for hotel/resort management, contracts, accounts.

Municipality of Puducherry (Commune Panchayat system): Puducherry's urban local bodies are called commune panchayats, reflecting French administrative terminology. They are UT bodies — second appeals go to PIC. RTI uses: building plan approvals, property tax records, trade licences, sanitation complaints.

Note on Puducherry Police: Unlike most state polices, Puducherry Police functions under the Lieutenant Governor (appointed by the central government) because Puducherry, despite having a legislature, has significant central oversight. In practice, for RTI appeals, Puducherry Police matters have been handled at CIC level. Verify the current position before filing a second appeal.

Key RTI Act Sections to Know

  • Section 2(h): Definition of "public authority" — bodies established by or under law and substantially financed by government
  • Section 6: How to file — in writing, to the PIO, with applicable fee, on plain paper or prescribed form
  • Section 7(1): PIO must respond within 30 days; within 48 hours if information concerns the life or liberty of a person
  • Section 7(5): Information is free if PIO fails to respond in time; BPL cardholders exempt from fees
  • Section 19(1): First Appeal to FAA within 30 days of PIO's decision or expiry of the 30-day response period
  • Section 19(3): Second Appeal to PIC (for Puducherry UT bodies) or CIC (for central bodies)
  • Section 20: Penalty of ₹250 per day, maximum ₹25,000, on the defaulting PIO
  • Section 15: Establishment of State Information Commissions — applies to Puducherry because it has a legislature, giving it the PIC

Practical Tips for Filing RTI in Puducherry

Identify the body's government: The first question is always: is this body a Puducherry UT government body, a central government body, or a body of a neighbouring state (Tamil Nadu, Kerala, or Andhra Pradesh)? The answer determines which Information Commission hears your second appeal.

JIPMER and Pondicherry University: Always remember these are central bodies going to CIC. Filing their second appeals with PIC is one of the most common RTI mistakes in Puducherry.

Land records: For land disputes, file with the Revenue Department sub-office at the taluk or commune level that has jurisdiction over the specific village and survey number. Puducherry's land records are maintained at that level.

Multi-enclave matters: If you have a dispute in Karaikal, Mahé, or Yanam, the Puducherry UT government body there still goes to PIC — the geographic enclave does not change the appeal track for UT bodies.

Language: RTI applications may be filed in Tamil or English — both are official languages in Puducherry. Tamil-language applications are fully valid at Revenue Department offices, commune panchayats, and other UT bodies.

French-era documents: If your land records dispute involves documents from before 1954, the Revenue Department may hold records in historical formats. Your RTI should ask for the current computerised or translated version of the record if a translation or digitisation has been made, as well as any certified copy of the original.

No portal URLs without verification: Online RTI portals change their interfaces and addresses. Always verify the current official URL before filing online.

Fee: ₹10 under the RTI (Regulation of Fee and Cost) Rules, 2005 for central bodies. For Puducherry UT bodies, verify the applicable fee under Puducherry's RTI rules. BPL cardholders are exempt under Section 7(5).
